AN ORDINANCE APPROVING AND AUTHORIZING THE
ENGLEWOOD DOWNTOWN DEVELOPMENT AUTHORITY
(EDDA) PLAN OF DEVELOPMENT
WHEREAS, the City Council of the City of Englewood approved the
formation of a Downtown Development Authority pursuant to section 31-25-801 et.
seq., of the Colorado Revised Statutes ("C.R.S.");
WHEREAS, the Englewood Downtown Development Authority ("EDDA")
was formed by the passage of Ordinance No. 25, Series 2020, and approved by
the voters in November 2020;
WHEREAS, the EDDA was formed and approved for the purpose of
promoting the cohesive improvement and redevelopment of the downtown area of
the City of Englewood;
WHEREAS, pursuant to 31-25-807(2)(f) C.R.S the EDDA Board in
cooperation with the Community Development Department may develop long-
range plans to carry out the purposes of the authority as set forth in section 31-25-
801 C.R.S., and to promote economic growth of the district;
WHEREAS, on July 7, 2021, the Englewood Planning and Zoning
Commission was presented with the Englewood Downtown Plan and
recommended approval by the Englewood City Council;
WHEREAS, subject to 31-25-807(3)(a) C.R.S. the governing body is
charged with approving the plan of development as originally adopted by the
Board, and as later modified by the Board;
WHEREAS, the EDDA Board approved Resolution No. 6, Series of 2021
along with Exhibits 1 and 2, which together comprise the Englewood Downtown
Plan (the "Plan") and recommended the proposed Plan to the City of Englewood
on June 23, 2021;
WHEREAS, the Englewood City Council held a public hearing on the Plan
on August 16, 2021, wherein staff was directed to bring back an ordinance for City
Council approval;

WHEREAS, the Plan defines three sub-areas within the downtown
development area: 1) the Englewood Station-CityCenter District, 2) the South
Broadway Main Street District, and 3) the Medical District area around Craig
Hospital and Swedish Medical Center (each a "Sub-Area");
WHEREAS, the Plan activates collection of TIF in two of three Sub-Areas
and treats sales tax increment and property tax increment separately;
WHEREAS, more particularly, the Plan authorizes collection and use of tax
increment financing via sales tax increment in the South Broadway Main Street
and Medical District Sub-Areas, and authorizes collection and use of TIF via
property tax increment in the Medical District Sub-Area; and
WHEREAS, no mill levy increase is planned at this time.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ENGLEWOOD, COLORADO, THAT:
Section 1. Subject to 31-25-807(4)(d) C.R.S. the Englewood City Council
may approve a plan of development if it finds there is a need to take corrective
measures in order to halt or prevent deterioration of property values or structures
within the plan of development area or to halt or prevent the growth of blighted
areas therein, or any combination thereof, and if further finds that the plan will
afford maximum opportunity, consistent with the sound needs and plans of the
municipality as a whole, for the development or redevelopment of the plan of
development area by the authority and by private enterprise.
Section 2. Additional City Council approval of an amendment to the Plan
and voter approval would be required if imposition of an additional mill levy
throughout the downtown development area were to be sought.
Section 3. The findings required by state law, as outlined in Section 1,
above, are hereby made, and the Englewood Downtown Development Plan
attached hereto as Exhibit A, is hereby accepted and approved by the Englewood
City Council.
