HomeMy WebLinkAbout2018 Ordinance No. 018ORDINANCE NO. 18 SERIES OF 2018 BY AUTHORITY COUNCIL BILL NO. 22 INTRODUCED BY COUNClL MEMBER BARRENTINE AN ORDINANCE APPROVING AN ENCROACHMENT AND INDEMNITY AGREEMENT PERTAINING TO THE CONSTRUCTION OF TWO ARCHITECTURAL CANOPIES EXTENDING OVER THE PUBLIC RIGHT-OF­ WAY. WHEREAS, Section 11-3-4 of the Englewood Municipal Code 2000 provides that an encroachment into public right-of-way may be granted upon compliance with certain terms and conditions and the issuance of an encroachment permit and indemnity agreement by the City; WHEREAS, the property owner "Synergy Medical" of 506 East Hampden A venue wishes to construct a medical office and restaurant/retail building; WHEREAS, the City of Englewood received an application for an encroachment permit from the Owner of 506 East Hampden Avenue for the construction of a medical office and restaurant/retail building for: •Two (2) architectural canopies 127.1 feet long in the Northwest Comer and 166.9 feet long in the Northeast Comer and attached to the building. The canopies shall extend no more than five (5') beyond the property lines, and will be a set a minimum of five (5') feet from the back of the existing curb in all locations. The height of each canopy above the existing sidewalk grade shall be eight (8') feet in all locations. WHEREAS, approval of this Ordinance will authorize an "Encroachment Permit and Indemnity Agreement" formally recognizing the dimensions of the encroachment; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1 The "Encroachment Permit and Indemnity Agreement" attached hereto as "Exhibit A" is hereby accepted and approved by the City Council of the City of Englewood, Colorado. lntroduced, read in full, and passed on first reading on the 20th of August, 2018. Number(s): 2077-03-1-03-001 2077-03-1-03-002 2077-03-1-03-020 2077-03-1-03-019 2077-03-1-03-003 2077-03-1-03-004 and commonly known as, Respectively: 506 E Hampden Avenue, Englewood, Colorado 510 E Hampden Avenue, Englewood, Colorado 550 E Hampden Avenue, Englewood, Colorado 558 E Hampden Avenue, Englewood, Colorado 3528 5 Pennsylvania Street, Englewood, Colorado 3532 5 Pennsylvania Street, Englewood, Colorado The City of Englewood, Colorado, hereby grants to said owners of the property at the above described location permission to install and maintain two aluminum canopies over the public Rig ht-of-way and attached to the proposed building structure on the northwest and northeast corners of the building as shown in Exhibit Band C. The canopies will be 127.1 feet and 166.9 feet long, respectively. The canopies shall be no closer than 5.0-feet horizontally from the back of existing curb and will extend a maximum of 5.0-feet into the right-of-way. All portions of the canopy will also be no closer than 8.0-feet vertically above the existing sidewalk grade. Failure to satisfactorily maintain the canopy will result in revocation of this permit. The aforesaid property owners and their heirs and assigns understand and agree that: 1.That the property owner(s)/contractor shall obtain all necessary permits required for the proposed work. 2.That this permission is revocable at will and without cause by the City of Englewoodwithout hearing and without notice other than Notice of Revocation. 3.That the property owner(s) shall remove said structure from the public right-of-way within thirty (30) days after receiving Notice of Revocation by personal service orcertified mail. Page I of 3 City of Englewood 1000 Englewood Parkway Englewood, Colorado 8011 0 4.That the property owner(s) are estopped to deny the right of the City of Englewood, Colorado, to revoke the Encroachment Permit or to deny the property rights of said City. 5.That the property owner(s) agree to reimburse and indemnify the City of Englewood, Colorado, for all necessary expenses of whatever nature that may be incurred in revoking this Permit, removing the structure placed in the public right-of-way, or any other expense as a result of granting the Encroachment Permit. 6.That the property owner(s) shall maintain insurance coverage sufficient to satisfy any liability arising as a result of this Encroachment Permit and Indemnity Agreement, and the City of Englewood shall be held harmless from any and all liabilities arising from this action. 7.That this agreement shall inure to the benefit of and be binding upon the heirs, executors, administrators, assigns, and successors of the respective parties IN WITNESS WHEREOF, the parties have set their hands the day and year first written above.
