SERIES OF 2020
A RESOLUTION OF THE CITY OF ENGLEWOOD CITY
COUNCIL URGING THE WEARING OF FACE
MASKS/COVERINGS IN PUBLIC SPACES AND BUSINESSES
DURING THE TERM OF THE DECLARED PANDEMIC
EMERGENCY, ALL WITHIN THE CITY OF ENGLEWOOD,
COLORADO.
WHEREAS,on March 10, 2020, the Governor of the State of Colorado declared a
statewide state of emergency in response to coronavirus (COVID-19) virus and disease;
WHEREAS, on April 17, 2020, the Governor issued Executive Order D-2020-039,
ordering workers in Critical Businesses and Critical Government functions to wear nonmedical
face coverings while working, except where doing so would inhibit the individual’s health, and to
also wear gloves, to the extent possible when in contact with customers or goods if gloves are
provided to workers by the employer;
WHEREAS, On April 26, 2020, the Governor issued Executive Order D-2020-044,
introducing the “Safer at Home” phase of slightly relaxed state regulation, through which he urges
individuals to wear non-medical cloth face coverings that cover the nose and mouth whenever
possible, and directing the Public Health Officer to implement further regulations;
WHEREAS, On April 26, 2020, Public Health Order (PHO) 20-28 was issued, setting
forth the standards and regulations necessary to comply with the “Safer at Home” Executive Order,
including directing employers and sole proprietors to implement measures to encourage customer
use of protection like gloves and face coverings, and mandating face masks in limited healthcare
settings, personal services settings, and critical and noncritical retail;
WHEREAS, on April 25, 2020, the Tri-County Department of Public Health issued a
Public Health Order adopting, incorporating, and extending (a) Executive Order D-2020-024
issued by the Governor on April 6, 2020, (b) Fourth Updated Public Health Order 20-24 issued by
CDPHE on April 9, 2020, and (c) Updated Notice of Public Health Order 20-22 Closing Bars,
Restaurants, Etc. issued by CDPHE on March 19, 2020 (“State Stay at Home Orders”) through
midnight May 8, 2020;
WHEREAS, the City Council confirms that protecting the public health is the Council’s
top priority;
WHEREAS, the City Council is empowered by Article XI of the City Charter of the City
of Englewood to do all acts and make all regulations which may be necessary or expedient for the
promotion of health or the suppression of disease within the City, not otherwise in conflict with
State law;
WHEREAS, on March 18, 2020, the City Council approved Emergency Ordinance No.
10, series 2020, declaring a public health emergency as a result of the Covid-19 virus pandemic
and granting authority to the City Manager to take necessary enumerated actions to address
pandemic related matters within the City;
WHEREAS, the wearing of cloth masks by an individual has been shown to reduce the
transmission of virus-laden droplets between that person and others, and the risk of virus

transmission is further reduced when two people wear masks during properly socially-distanced
interactions;
WHEREAS, the use of face coverings offers additional protection for and from those who
may have the virus but are asymptomatic, and helps protect those most vulnerable to the virus who
still must go out to obtain necessary items such as groceries, prescriptions and other health care
necessities;
WHEREAS, reductions in the risk of transmission between persons may equate to greater
public confidence for residents to resume normal activities which promotes economic recovery
and development;
WHEREAS, Englewood has a long history of voluntary compliance with practices that
improve health, safety and quality of life such as voluntary water restrictions during recent
droughts in which Englewood achieved higher rates of water conservation through voluntary
compliance than other cities achieved through mandatory compliance; and
WHEREAS, the City Council finds and determines that the adoption of this Resolution
urging individuals to voluntarily wear masks whenever they are in places with a likelihood of
interaction with others is an important measure for the promotion of health and the suppression of
disease within the City, the region, and the State.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD, COLORADO, AS FOLLOWS:
Section 1. The Englewood City Council hereby urges the following during the term of the declared
pandemic emergency:
Businesses: All businesses operating within the City establish a policy requiring customers
and visitors to wear medical or non-medical cloth face coverings at all times when the customer
or visitor is in the indoor public areas associated with the business.
Customers and Visitors: All customers and visitors in indoor public areas associated with a
business wear medical or non-medical cloth face coverings at all times, including, but not
limited to, when inside critical businesses operating within the City.
