HomeMy WebLinkAbout2019 Resolution No. 034RESOLUTION NO. 34 SERIES OF 2019 A RESOLUTION AW ARD ING A CONTRACT FOR THE PURCHASE OF SWIMMING POOL CHEMICALS FROM CEM SALES AND SERVICE UNDER THE TERMS OF THE COLORADO MULTIPLE ASSEMBLY OF PROCUREMENT OFFICIALS (MAPO) COOPERATIVE PURCHASING AGREEMENT. WHEREAS, Section l 16(b) of the Englewood Home Rule Charter, allow contracts for public works or improvements associated with capital improvements to be negotiated, provided that contracts for which no competitive bids have been requested are approved and accepted by Resolution setting forth the reason for the exception to the competitive bidding requirement; WHEREAS, Section 4-1-3-1 of the Englewood Municipal Code 2000 allows for the purchase of materials, equipment, machinery or devices without competitive bids where the standardization of such materials and equipment is necessary to ensure the proper functioning of existing equipment, machinery or devices and/or to prevent the duplication of existing equipment; WHEREAS, the Pirates Cove Water Park and the Englewood Recreation Center utilizes Calcium Hypochlorite as a primary sanitizer for the pools located at these facilities; WHEREAS, remaining with CEM would eliminate the need to replace the current chemical feeders at both pools, thereby realizing a cost saving of approximately $30,000.00; WHEREAS, in addition to CEM providing the sanitizer, CEM also services the delivery systems for the chemical at both facilities; WHEREAS, the City, as a municipality, has the opportunity to take advantage of the pricing offered through the Colorado Multiple Assembly of Procurement Officials (MAPO), which are competitively bid or negotiated agreements utilized by various municipalities and the State of Colorado take advantage of the pricing structure negotiated through the cooperative bidding process; WHEREAS, the funds for the purchase of this chemical comes from the 2019 General Fund budget under line item 1308 (Pirates Cove) and 1304 (Recreation Center), Chemicals, Drugs, and Lab Supplies; and WHEREAS, the cost of purchasing this chemical over the next year under the cooperative purchasing agreement is not to exceed $78,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: 1/2 Section I. The Englewood City Council hereby authorizes the purchase of Calcium Hypochlorite for both the Pirates Cove Waterpark and Englewood Recreation Center pool from CEM Sales and Service, in lieu of the internal competitive bid process, in an amount not to exceed of $78,000.00.
