AN ORDINANCE AMENDING TITLE 1, CHAPTERS, SECTlON 2, SUBSECTION 1,
ENTITLED REGULAR MEETINGS, OF THE ENOLEWOOD MUNICIPAL CODE 2000,
AND AMENDING CHAPTER. I, SECTlON A OF THE RULES OP ORDER AND
PROCEDURE FOR THE ENGLEWOOD CITY COUNCIL PERTAINING TO THE TIME OF
CITY COUNCIL MEETINGS.
WHEREAS, the Englewood Home Rule Charted. Article III. Section 27, provides that Clty
Council shall meet regularly nt the City Hall, at least twice each month al a day and hour lo be
fixed from time to time; and
WHEREAS, the City Council Rules of Order and Procedure, Section A-Re;ulor Meeting
provides II starting Umc of 7:30 P .M.; and
WHEREAS, the Englewood City Council has discussed changina the starting time of Regul i&!
City Council Meetings lo 7:00 P.M.; and
WHEREAS, the new starting lime will provide additional time to consider the Council
A~enda' s, allow for public comment. and provide for a streamlined process; and
WHEREAS, the new starting time shall be etTective on November 7, 2016, the fint regularly
scheduled Council Meeting in November, and sboll continue thereafter.
NOW. THEREFORE, BE IT ORDAINED BY nm crrv COUNCn. OF THE CITY OF
ENGLEWOOD, COLORADO, THAT:

Sectjon 1. The City Council of the City of Englewood, Colorado hereby authorizes amending
Title l, Chapter S, Section 2, Subsection 1 -Regular Meetings of the Englewood Municipal
Code 2000 to read as follows:

Regulnr meetings of the City Council shall be held in the City Hall on the first and third
Mondays of each month at seven~ o'clock (~ ~ P .M., or at such other lime and day ;i
Council may, from time lo time, designate; provided. however, that when the day fixed for any
regular meeting falls upon a day designated by City Council as a City holiday, such meeting shall
be held at the snmc hour on the next succeeding dny not a holiday.
Section 2. The City Council of the City of Englewood, Colorado authorizes amending Chnpler
1 -City Council Meetings, Section A ~ Reguh1r Meeting of the Rules of Order and procedure for
the Englewood City Council to read as follows:
1. City Council Meetings
A. ReauJar Meeting
Regular meeting of the City Council shall be held in the City Hall on the first .·,
Mondays of each monlh at~ 2.!m P .M. or at such other lime and day as City
Council may, from time to time, designate; provided, however, lhat when the day
fixed for any resu\ar meeting falls upon a day designated by law as a legal or
national holiday, such meeting shnll be held nt the same hour on the next succeeding
day nol a holiday.
Section 3. Safety Clauses. TI1e City Council hereby finds, detennines, and declares thnl this
Ordinance is promulgated under the general police power of the City of Englewood, that it is
promulgated for the health, safety, and wclf arc of the public, and that this Ordinance is necessary
for the preservation of health and safety and for the protection of public convenience and
welfare. The City Council further determines that the Ordinance bears a rational relation to the
proper legislative object sought to be obtained.
Section 4, Seyembility, If any clause, sentence, paragraph, or part of this Ordinance or the
application thereof to any person or circumstances shnll for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect. impair or invalidate the remainder
of this Ordinance or it application to other persons or circumstances.
Section S. Inconsistent Ordjrumces, AJl other Ordinances or portions thereof inconsistent or
conflicting with this Ordinance or any portion hereof are hereby repealed to the extent of such
inconsistency or conflicL
Section 6, Effect of repeal or modification. The repeal or modification or any provision of
the Code of the Cily of Englewood by this Ordinance shall not release; extinguish, alter, modify,
or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which
shnll have been incurred under such provision, and each provision shall be treated and held as
still remaining in force for the purposes of sustaining any and all proper actions, suits,
proceedings. and prosecutions for the enforcement of the penally, forfeiture, or liability, as well
as for the purpose of sustaining any judgment, decree, or order which can or may be rendered,
entered, or made in such actions., suits, proceedings, or prosecutions.

Staff recommends Council approve a bill for an ordinance, on second reading,
amending the Englewood Municipal Code 2000 and the Rules of Order and Procedure
for the Englewood City Council, to change the start time of regular Council meetings to
7:00 p.m ., effective November 7, 2016.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Title 1, Chapter 5, Section 2, Subsection 1 of the Englewood Municipal Code 2000
reads that the "Regular meetings of the City Council shall be held in the City Hall on the
first and third Mondays of each month at seven thirty o'clock {7:30) P.M., or at such
other time and day as Council may, from time to time, designate; provided, however that
when the day fixed for any regular meeting falls upon a day designated by City Council
as a City holiday, such meeting shall be held at the same hour on the next succeeding
day not a holiday."
Starting in November. Council will discontinue Study Sessions before the regular
Council meetings on the first and third Mondays. Study Sessions will only occur on the
second and fourth Mondays of each month. Since there will no longer be a Study
Session at 6:00 p.m. before the regular meeting, the regular meeting can start earlier. It
was decided that a 7:00 p.m. start time for regular meetings would be the most
accommodating for the majority of citizens.
