HomeMy WebLinkAbout2013 Ordinance No. 051• • • ORDINANCE NO. 5/ SERIES OF 2013 BY AUTHORITY COUNCIL BILL NO. 21 INTRODUCED BY COUNCIL MEMBER WOODWARD AN ORDINANCE APPROVING THE REZONING OF 4201 SOUTH NAVAJO STREET FROM 1-1 TO NAVAJO APARTMENTS PLANNED UNIT DEVELOPMENT (PUD). WHEREAS, Bruce Elsey and 4201 South Navajo LLC are the owners of the property at mid- block on the 4200 Block of South Navajo Street between Oxford Avenue to the North and Quincy Avenue to the South, also known as 4201 South Navajo Street, Englewood, Colorado; and WHEREAS, the 4201 South Navajo Street site consists of two parcels totaling 2.09 acres; and WHEREAS, Elsey Partners, LLC submitted an application to the City to rezone the parcels from 1-1 Light Industrial District to the Navajo Apartments Planned Unit Development (PUD) which allows various residential, commercial and industrial uses; and WHEREAS, the property is approximately 800 feet South of RTD's Oxford Light Rail Station; and WHEREAS, land to the South and East of the subject property is zoned 1-1 Light Industrial District and contains industrial uses; land to the North of the subject property was recently rezoned to the Oxford Station Transit Oriented Development PUD which will include 252 residential apartment units with an option for mixed commercial uses; and WHEREAS, the proposed Planned Unit Development (PUD) would allow a maximum of 146 residential apartment units on the property, although the current building plan shows 141 units; and WHEREAS, all allowed industrial uses shall cease and shall not be grandfathered nor considered legal, non-conforming uses upon the issuance of a Certificate of Occupancy; and WHEREAS, the proposed 4201 South Navajo Street Planned Unit Development will exceed the _development quality standards required by the Englewood Unified Development Code for residential development; and WHEREAS, the Planning and Zoning Commission held Public Hearing on May 14, 2013. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. The 4201 South Navajo Planned Unit Development (PUD), for property located in the 4200 Block of South Navajo Street between Oxford Avenue to the North and Quincy Avenue to the South, in the City of Englewood, Colorado, attached hereto as Exhibit A, is hereby approved with the condition noted below: 11 b i That the final Navajo streetscape section may vary from the curb alignment, sidewalk width and location, and associated landscape zone shown on the PUD; and that the final streetscape section for the Navajo Apartments PUD will be approved by the City Manager or designee in conjunction with the building permit. The site is the former location of Precious Cat INC and cat littler manufacturing company that has since relocated to a larger industrial warehouse off of Dartmouth. The owner is the applicant's father and proposed site has been in the Elsey family for many years. The applicant is a multifamily developer of student housing (www.myprimeplace .com). The applicant designs, bu il ds, and manages their properties through Prime Design, Prime Buil~ and Prime Place. This project presents a unique opportunity for a grass roots father son development within the city Englewood of a family owned business seeking to adjust and change with the City of Englewood . INTENT OF PLANNED UNIT DEVELOPMENT The purpose of the 4201 S Navajo Planned Unit De ve lopment is to convert the owne(s current "l-1" (Light industrial zone district) warehouse to a Planned Unit Development Apartment complex. The owner has attended several area meetings with regards to the Englewood Light Rail Corridor Plan and feels that such a residential apartment complex seems to fit in with future development patterns for the area. The development is to be marketed lo individuals wanting easy access to the Oxford transit station. Federal fair housing laws don't allow the owner to discriminate in who would occupy the units. However, the developer foresees young professionals worl<ing downtown or students at ACC or Metro as being probable tenants. The PUD zone district created will mostly conform with the 2003 City of Englewood Comprehensive Plan and Englewood Municipal Code. This development fits with the goals of TOD in that It creates Multifamily development near transpQrtation hubs. The development will complement the Oxford Station project that was already approved and encourage more development of resldential units replaci ng induslrial warehouses. RELATIONSHIP TO THE CITY OF ENGLEWOOD'S UNIFIED DEVELOPMENT CODE The 4201 S Navajo will generally comply with the development and design standards set forth in the Development code of the City of Englewood for the High density residential. Where conflicts with the UDC exist then the PUD shall prevail. The proposed rezoning meets the following criteria: the proposed development will meet or exceed the development quality standards, levels of public amenities, or levels of design innovation otherwise applicable under the Unified Development Code of the City of Englewood , and would not be possible or practicable under a standard zone district with conditional uses or with a reasonable number of Zoning Variances or Administrative Adjustments. The approved PUD rezoning shall not lapse , but shall remain in effect unUI superseded by a subsequent revision of the approved PUD document. The following modification procedures are consistent with the PUD modification procedures of the city of Englewood !We 16, zoning regulations as listed below in Modificatiori and amendment of the PUD Should any part of these regulations and stipulations be deciared invalid or unenforceable by a court or competent jurisdiction, such decision shall not affect the validity of enforcement of the remaining provisions of these regulations. RELATIONSHIP OF THE PUD TO THE PUD SITE PLAN The provisions of this PUD will establish zone district standards whose details of development will be delineated in the PUD Site Plan application. MODIFICATION AND AMENDMENT OF THE PUD DISTRICT PLAN• The terms, conditions, the adopted PUD District Plan and documents may be changed and/or amended in whole or in part as fotlows: 1. Minor Modifications to the PUD district plan: The city manager or his designee may approve minor modificati ons In the location, sizing, and height of structures or facilities tt required by engineering or other circumstances not foreseen at the time the PUD district plan was approved. Minor modifications shall not be permitled if the modification results in any of the c ircumstances listed below in th is PUD 2. Major Modifications to the PU D : Major modifications may be made to u,e approved PUD district plan pursuant to the same limitations and requirements by which such plans and documents were originally approved. SITE PLAN 1. Minor Modifications to the PUD site plan : The city, through the development review team, may authorize minor deviations from the PUD site plan when such deviations appear necessary in Ught of technical or engineering considerations. Minor deviations shall not be permitted if any of the following ci rc umstances resull: 1.1. A change in the permitted land use 1.2 . A change in general location of land use 1.3.
