Call to Order The regular meeting of the Englewood City Council was called to order by Mayor Jefferson at 7:35 p.m. 2. Invocation The invocation was given by Council Member Russell. 3. Pledge of Allegiance The Pledge of Allegiance was led by Council Member Russell. Consideration of Minutes of Previous Session (a) COUNCIL MEMBER RUSSELL MOVED, AND COUNCIL MEMBER BARRENTINE SECONDED, TO APPROVE THE MINUTES OF THE REGULAR CITY COUNCIL MEETING OF MARCH 21, 2016. Vote results: Ayes: Council Members Russell, Barrentine, Olson, Jefferson, Yates, Martinez Nays : None Abstain: Council Member Gillit Motion carried . Englewood City Council April 4, 2016 Page 2 6. Recognition of Scheduled Public Comment (a) City Council recognized the Englewood nominees for the 2016 Arapahoe County Mayors and Commissioners Youth Awards. (c) Flora Coleman, an Englewood resident, addressed Council regarding Cherokee Kivas and problems with the City of Englewood Building Department. (d) Leroy Cockrell, an Englewood resident, addressed Council regarding Cherokee Kivas. (e) William Duchane, an Englewood resident, was scheduled to address Council regarding Cherokee Kivas but did not speak. (f) Doug Cohn, an Englewood resident, addressed Council regarding historic preservation . 7 . Recognition of Unscheduled Public Comment (a) Phil Raschmeyer, a commercial broker in Denver, had questions for Council regarding the Shea Property lease. (b) Danielle Holley, an Englewood resident, addressed Council regarding the Shea Property lease. Council responded to Public Comment. 8. Communications, Proclamations and Appointments (a) Police Community Relations Specialist Toni Arnoldy introduced Mickey Kempf, a Littleton Police Volunteer and serves at the CERT Coordinator and sets up all of the CERT Trainings and Exercises and George Sullivan and Englewood Citizen and the Director, CPRS American Red Cross. The 2016 Englewood/Littleton Community Emergency Response Team-CERT training class graduates are Aspen Jensen , Russell Nokes, Peter Sendroy, William Stevens , Karen Trujillo and Stephanie Willingham . (b) A Proclamation declaring April 15, 2016, Arbor Day was considered. COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER YATES SECONDED, TO APPROVE A PROCLAMATION DECLARING APRIL 15, 2016, ARBOR DAY. Consent Agenda (a) Approval of Ordinances on First Reading There were no additional items submitted for approval on first reading. (See Agenda Item 11 (a).) COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER YATES SECONDED, TO APPROVE CONSENT AGENDA ITEMS 9 (b) (i), (ii), (iii), (iv) and (v). (b) Approval of Ordinances on Second Reading (i) ORDINANCE NO. 13, SERIES OF 2016 (COUNCIL BILL NO . 16, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE AUTHORIZING THE CITY OF ENGLEWOOD, COLORADO TO APPLY FOR AND ACCEPT FUNDING FROM THE U.S. DEPARTMENT OF JUSTICE -OFFICE OF JUSTICE PROGRAMS, FOR THE PURCHASE OF BULLET PROOF VESTS. (ii) ORDINANCE NO. 14, SERIES OF 2016 (COUNCIL BILL NO . 11, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE AMENDING TITLE 2, CHAPTER 14, OF THE ENGLEWOOD MUNICIPAL CODE 2000 PERTAINING TO THE BUDGET ADVISORY COMMITTEE. (iii) ORDINANCE NO. 15, SERIES OF 2016 (COUNCIL BILL NO. 14, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT TO COSPONSOR THE UNITED STATES SMALL BUSINESS ADMINISTRATION COLORADO EMERGING LEADERS PROGRAM BETWEEN THE U.S. SMALL BUSINESS ADMINISTRATION, THE GREATER ENGLEWOOD CHAMBER OF COMMERCE AND THE CITY OF ENGLEWOOD. (iv) ORDINANCE NO. 16, SERIES OF 2016 (COUNCIL BILL NO. 13 , INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE APPROVING AUTHORIZING THE VACATION OF THE NORTHERN 78 .5 FEET OF THE ALLEY EAST OF THE 3400 BLOCK OF SOUTH ACOMA STREET AND DEDICATION OF A 125 FOOT TRANSPORTATION/UTILITY EASEMENT LOCATED IN A PORTION OF LOTS 5 AND 6, BLOCK 2 OF CITY GARDENS SUBDIVISION EAST OF THE 3400 BLOCK OF SOUTH ACOMA STREET BY THE ENGLEWOOD URBAN RENEWAL AUTHORITY TO THE CITY OF ENGLEWOOD, COLORADO . (v) ORDINANCE NO. 17, SERIES OF 2016 (COUNCIL BILL NO . 15, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE AUTHORIZING A GRANT OF TEMPORARY CONSTRUCTION LICENSE, A GRANT OF RIGHT-OF-WAY AND AN EXCHANGE OF RIGHT-OF-WAY AGREEMENT FOR RELOCATING THE CITY DITCH AT 707 EAST JEFFERSON AVENUE, ENGLEWOOD, COLORADO IN ORDER TO ALLOW FOR THE CONSTRUCTION OF A RITE AID PHARMACY . Vote results: Motion carried. Public Hearing Items No public hearing was scheduled before Council. 11. Ordinances, Resolutions and Motions (a) Approval of Ordinances on First Reading (i) Deputy Chief Sanchez presented a recommendation from the Police Department to adopt a bill for an ordinance which would add a new section (B)(15) to Title 11 of the Englewood Municipal Code -Part 6, Section 705 (2)(a)(b)(c) -Operation of vehicle approached by emergency vehicle -operation of vehicle approaching stationary emergency vehicle. COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER OLSON SECONDED, TO APPROVE AGENDA ITEM 11 (a) (i) -COUNCIL BILL NO. 17. COUNCIL BILL NO. 17, INTRODUCED BY COUNCIL MEMBER GILLIT A BILL FOR AN ORDINANCE AMENDING TITLE 11, CHAPTER 1, SECTION 1, SUBSECTION B, OF THE • 2000 ENGLEWOOD MUNICIPAL CODE BY THE ADDITION OF A NEW SECTION 15 PERTAINING TO THE • OPERATION OF A VEHICLE APPROACHED BY AN EMERGENCY VEHICLE. Vote results: Motion carried . Ayes: Council Members Russell, Barrentine, Olson, Jefferson, Yates, Martinez, Gillit Nays: None (b) Approval of Ordinances on Second Reading (i) EMRF Board Member Brennan presented Council Bill No. 12, on second reading, approving the lease of the EMRF property in PA 81 to Shea Properties, with an option to purchase following a lease term of 20 years . COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER OLSON SECONDED, TO APPROVE AGENDA ITEM 11 (b) (i) -ORDINANCE N0.18, SERIES OF 2016. ORDINANCE NO. 18, SERIES OF 2016 (COUNCIL BILL NO. 12, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE APPROVING A LEASE WITH AN OPTION TO PURCHASE AFTER 20 YEARS ENGLEWOOD MCLELLAN RESERVOIR FOUNDATION AND SHEA PROPERTIES d.b.a. CENTRAL PARK HIGHLANDS RANCH, LLC. IN PLANNING AREA 81(PA81). Vote results: Motion carried . General Discussion (a) Mayor's Choice (i) Mayor Jefferson presented Notice of a Special Meeting on April 19, 2016, at 6:00 p.m . to review the Comprehensive Plan. (b) Council Members' Choice 13. City Manager's Report 14. City Attorney's Report Acting City Attorney Comer did not have any matters to bring before Council. 15 . Adjournment MAYOR JEFFERSON MOVED TO ADJOURN .
