Call to Order The regular meeting of the Englewood City Council was called to order by Mayor Jefferson at 7:39 p.m. 2 . Invocation The invocation was given by Council Member Russell. 3 . Pledge of Allegiance The Pledge of Allegiance was led by Council Member Russell. 4 . Roll Call Present: Absent: A quorum was present. Consideration of Minutes of Previous Session (a) COUNCIL MEMBER YATES MOVED, AND COUNCIL MEMBER RUSSELL SECONDED, TO APPROVE THE MINUTES OF THE REGULAR CITY COUNCIL MEETING OF MAY 2, 2016. Vote results: Ayes : Council Members Russell, Barrentine , Olson , Jefferson , Yates, Martinez Nays : Council Member Gillit Motion carried . • 6 . Recognition of Scheduled Public Comment (a) Doug Cohn, an Englewood resident, addressed Council regarding historic preservation. • Englewood City Council May 16, 2016 Page 2 (b) Patricia Ross, an Englewood resident, addressed Council regarding public health issues with recreational marijuana . (c) Elaine Hults , an Englewood resident, addressed Council regarding marijuana and the Comp Plan . 7. Recognition of Unscheduled Public Comment (a) Anthony Piute, Englewood resident, addressed Council regarding recreational marijuana. (b) Anna Piute , Englewood resident, addressed Council regarding recreational marijuana . (c) Peggy Lapp, Englewood resident, addressed Counc il regarding recreational marijuana . Communications, Proclamations and Appointments There were no communications , proclamations or appo intments . • 9. Consent Agenda • (a) Approval of Ordinances on First Read ing There were no additional items submitted for approval on first reading . (See Agenda Item 11 (a).) COUNCIL MEMBER OLSON MOVED, AND COUNCIL MEMBER MARTINEZ SECONDED, TO APPROVE CONSENT AGENDA ITEMS 9 (b) (i), (ii) (iii) and 9 (c) (i). (b) Approval of Ordinances on Second Reading (i) ORDINANCE NO . 20, SERIES OF 2016 (COUNCIL BILL NO . 19 , INTRODUCED BY COUNCIL MEMBER GILLIT AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT (IGA) REGARDING STATE SENATE BILL 8, TRAFFIC CONTROL DEVICES MAINTENANCE CONTRACT, ALLOWING THE COLORADO DEPARTMENT OF TRANSPORTATION TO REIMBURSE THE CITY FOR COSTS OF TRAFFIC CONTROL DEVICES, OPERATIONS AND MAINTENANCE. (ii) ORDINANCE NO . 21, SERIES OF 2016 (COUNCIL BILL NO . 20 , INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF CHERRY HILLS VILLAGE , COLORADO AND THE CITY OF ENGLEWOOD, COLORADO PERTAINING TO THE STREET PAVEMENT REHABILITATION OF SOUTH CLARKSON CAPE SEAL FROM HIGHWAY 285 TO BELLEVIEW AVENUE . (iii) ORDINANCE NO. 22, SERIES OF 2016 (COUNCIL BILL NO . 18, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE AUTHORIZING ACCEPTANCE AND DEDICATION OF A TRANSPORTATION EASEMENT AND DEDICATION OF RIGHT-OF-WAY TO THE CITY OF ENGLEWOOD, COLORADO BY KENT PLACE • • • Englewood City Council May 16, 2016 Page 3 REGENCY, LLC. FOR ROADWAY, CURB/GUTTER, SIDEWALK, TRAFFIC SIGNAL EQUIPMENT, SIGNAGE, UTILITIES, AND OTHER INCIDENTALS LOCATED IN SOUTH UNIVERSITY BOULEVARD . (c) Resolutions and Motions (i) RESOLUTION NO . 56, SERIES OF 2016 A RESOLUTION VACATING THE DECLARATION OF PROTECTIVE COVENANTS AT 333 WEST HAMPDEN AVENUE, IN THE CITY OF ENGLEWOOD, COLORADO. Vote results: Ayes : Council Members Russell, Barrentine, Olson, Jefferson, Yates, Martinez Nays: Council Member Gillit Motion carried. 10 . Public Hearing Items No public hearing was scheduled before Council. 11 . Ordinances, Resolutions and Motions (a) Approval of Ordinances on First Reading There were no items submitted for approval on first reading . (b) Approval of Ordinances on Second Reading There were no additional items submitted for approval on second reading . (See Agenda Item 9 (b) -Consent Agenda .) (c) Resolutions and Motions (i) Manager Hogan presented a recommendation from the Public Works Department to approve a motion to award a construction contract for $288 ,600 with W.O . Danielson Construction Company for the ServiCenter PreWash and Wash Facility Project. COUNCIL MEMBER OLSON MOVED, AND COUNCIL MEMBER YATES SECONDED, TO APPROVE A CONSTRUCTION CONTRACT FOR $288,600 WITH W.O. DANIELSON CONSTRUCTION COMPANY FOR THE SERVICENTER PREWASH AND WASH FACILITY PROJECT. Vote results: Ayes : Council Members Russell, Barrentine, Olson, Jefferson, Yates, Martinez Nays : Council Member Gillit Motion carried . 12. General Discussion (a) Mayor's Choice (b) Council Members' Choice (i) There was a Call, by Mayor Jefferson, for a Special Meeting for the purpose of entering into Executive Session with Strategic Government Resources to discuss candidates for the City Attorney position on Tuesday , May 24, at 6:00 p.m. Vote results: • • • Englewood City Council May 16, 2016 Page4 Ayes : Council Members Russell , Barrentine , Olson , Jefferson, Yates , Martinez Nays : Council Member Gillit Motion carried. 13 . City Manager's Report City Manager Keck did not have any matters to bring before Council. 14 . City Attorney's Report (a) Acting C ity Attorney Comer requested Council appoint the previously approved Hearing Officer to hear the Amended Notice of Appeal regarding Officer Andrea Friday MAYOR JEFFERSON MOVED, AND COUNCIL MEMBER BARRENTINE SECONDED, TO APPROVE THE APPOINTMENT OF THE PREVIOUSLY APPROVED HEARING OFFICER TO HEAR THE AMENDED NOTICE OF APPEAL REGARDING OFFICER ANDREA FRIDAY. Vote results: Ayes : Council Members Russell , Barrentine , Olson , Jefferson , Yates , Martinez Nays : Council Member Gillit Motion carried . 15. Adjournment MAYOR JEFFERSON MOVED TO ADJOURN .
