Call to Order The regular meeting of the Englewood City Council was called to order by Mayor Penn at 7 :37 p.m. 2 . Invocation The invocation was given by Council Member Wilson . 3. Pledge of Allegiance The Pledge of Allegiance was led by Council Member Wilson. 4 . Roll Call Present: Absent: Council Members Jefferson, Olson, Gillit, Wilson, Yates , Penn Council Member Mccaslin A quorum was present. Also present: City Manager Keck City Attorney Brotzman Deputy City Manager Flaherty City Clerk Ellis Deputy City Clerk Carlile Planner I Kirk, Community Development Deputy Police Chief Sanchez 5 . Consideration of Minutes of Previous Session (a) COUNCIL MEMBER OLSON MOVED, AND COUNCIL MEMBER WILSON SECONDED, TO APPROVE THE MINUTES OF THE REGULAR CITY COUNCIL MEETING OF JULY 6, 2015. Vote results: Ayes : Council Members Yates, Wilson, Penn, Jefferson, Olson , Gillit Nays : None Absent: Council Member Mccaslin Motion carried . 6 . Recognition of Scheduled Public Comment • (a) The Englewood High School Future Business Leaders of America (FBLA) team were scheduled to provide an update on the National FBLA Conference in Chicago. They were not present. (b) Barbara Chumley was scheduled to address City Council regarding Englewood Unleashed . She was not present. Englewood City Council July 20, 2015 Page 2 (c) Garnett Stewart was scheduled to address City Council regarding Englewood Unleashed . She was not present. 7 . Recognition of Unscheduled Public Comment (a) City Manager Eric Keck updated citizens on the flooding issue that was d iscussed in tonight's study session . He explained the steps the City is taking to address the flooding issue. The City can study this issue without going to FEMA. We are trying to be responsible and to the best of our ability mitigate the flooding . There will be meetings in the future, he said . (b) Polly Page, an Aurora resident and Area Chair for Arapahoe Responsible Energy Advocates , referred Council to a handout she provided . Her organization is dedicated to educate citizens on the facts of Oil and Gas Development in Arapahoe County. (c) Elaine Hults, an Englewood resident , vehemently objected to the development of apartments around every one of our parks . Council can't seem to maintain businesses in the City , she said . She suggested Council does not understand how much it is going to cost the City. (d) Laurett Barrentine , an Englewood resident, objected to the ballot question regarding Mclellan . She has concerns about the sale of the land. She feels the City needs buffer land to protect the quality of our water. (e) Ida May Nicholl, an Englewood resident, addressed Council regarding the Mclellan ballot question . She asked Council if they had looked at the history of our water rights . She was horrified at the thought of losing any of our water rights . She asked Council if they have really thought it through and if they have done their homework on the issue . (f) Ann Cockrell, an Englewood resident , wanted the City to explore ideas of providing opportunities for community service programs . She also had concerns regarding landscaping with tall grass and the low visibility at intersections . (g) Cassandra Letkomiller, an Englewood resident, addressed Council regarding development in the Bates-Logan neighborhood . She is requesting a study session or future opportunity for discussion to address her concerns. (h) in the City. Laurel Westfall , an Englewood resident, expressed concerns about over building of apartments Council responded to Public Comment. 8 . Communications, Proclamations and Appointments There were no communications , proclamations or appointments . 9 . Consent Agenda (a) Approval of Ordinances on First Reading There were no items submitted for approval on first reading. COUNCIL MEMBER OLSON MOVED, AND COUNCIL MEMBER GILLIT SECONDED, TO APPROVE CONSENT AGENDA ITEMS 9 (b) (i), (ii), and (iii). • • • • • Englewood City Council July 20, 2015 Page 3 (b) Approval of Ordinances on Second Reading (i) ORDINANCE NO . 29 , SERIES OF 2015 (COUNCIL BILL NO . 27, INTRODUCED BY COUNCIL MEMBER OLSON) AN ORDINANCE AMENDING TITLE 3, CHAPTER 4 , SECTION 16, SUBSECTION 3, OF THE ENGLEWOOD MUNICIPAL CODE 2000 , ENTITLED "CITY OF ENGLEWOOD NONEMERGENCY EMPLOYEES RETIREMENT PLAN AND TRUST AS AMENDED AND RESTATED EFFECTIVE DECEMBER 31 , 2012 ." (ii) ORDINANCE NO . 30 , SERIES OF 2015 (COUNCIL BILL NO . 30 , INTRODUCED BY COUNCIL MEMBER OLSON) AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN ARAPAHOE COUNTY CLERK AND RECORDER AND THE CITY OF ENGLEWOOD , COLORADO , TO CONDUCT A COORDINATED ELECTION ON NOVEMBER 3, 2015 . (iii) ORDINANCE NO . 31 , SERIES OF 2015 (COUNCIL BILL NO . 31 , INTRODUCED BY COUNCIL MEMBER OLSON) AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE BOARD OF COUNTY COMMISSIONERS OF ARAPAHOE COUNTY AND THE CITY OF ENGLEWOOD , COLORADO , FOR INSTALLATION OF A MAIL BALLOT DROP-OFF BOX ALONG WITH VIDEO SURVEILLANCE RECORDING SYSTEM AT ENGLEWOOD CIVIC CENTER. Vote results: Ayes: Council Members Yates , Wilson , Penn , Jefferson , Olson, Gillit Nays : None Absent: Council Member Mccaslin Motion carried. (c) Resolutions and Motions There were no resolutions or motions submitted for approval. 10 . Public Hearing Items No public hearing was scheduled before Council. 11. (b) Approval of Ordinances on Second Reading (i) Council Bill No . 23 , vacating The Broadway Planned Development was considered. COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER WILSON SECONDED, TO APPROVE AGENDA ITEM 11 (b) (i) -ORDINANCE NO. 32, SERIES OF 2015 . • ORDINANCE NO . 32 , SERIES OF 2015 (COUNCIL BILL NO . 23 , INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE VACATING THE BROADWAY PLANNED DEVELOPMENT AND ZONING THE AREA MU-R- 3-B. Englewood City Council July 20, 2015 Page4 Vote results: Ayes : Council Members Yates , Wilson, Penn, Jefferson , Olson , Gillit Nays : None Absent: Council Member Mccaslin Motion carried . (ii) Council Bill No . 28 , authorizing a ballot question on the November 2015 ballot seeking the approval of the requested lease/sale of property was considered . COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER WILSON SECONDED, TO APPROVE AGENDA ITEM 11 (b) (ii) -ORDINANCE NO. 33, SERIES OF 2015. ORDINANCE NO . 33 , SERIES OF 2015 (COUNCIL BILL NO. 28 , INTRODUCED BY COUNCIL MEMBER JEFFERSON) AN ORDINANCE SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF ENGLEWOOD AT THE NEXT SCHEDULED MUNICIPAL ELECTION ON NOVEMBER 3, 2015, AUTHORIZING THE FUTURE SALE OF MCLELLAN RESERVOIR PROPERTY AT THE END OF A NOT LESS THAN 20 YEAR LEASE TERM. ORDINANCE NO . 34 , SERIES OF 2015 (COUNCIL BILL NO . 29, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE SUBMITTING TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF ENGLEWOOD AT THE NEXT SCHEDULED MUNICIPAL ELECTION ON NOVEMBER 3, 2015 A PROPOSED AMENDMENT TO ARTICLE II , SECTION 14 "SPECIAL ELECTIONS" OF THE ENGLEWOOD HOME RULE CHARTER. ORDINANCE NO . 35, SERIES OF 2015 (COUNCIL BILL NO. 32, INTRODUCED BY COUNCIL MEMBER WILSON) • • • • Englewood City Council July 20, 2015 Page 5 AN ORDINANCE OF THE CITY OF ENGLEWOOD COLORADO APPROVING THE REFINANCING OF A LEASE-PURCHASE AGREEMENT FOR THE ENGLEWOOD CIVIC CENTER SITE TO PRODUCE AN AGGREGATE SAVINGS TO THE CITY, AUTHORIZING AND APPROVING THE DOCUMENTATION RELATING TO THE REFINANCING; AND DECLARING AN EMERGENCY. Vote results: Ayes: Council Members Yates, Wilson , Penn, Jefferson, Olson, Gillit Nays: None Absent: Council Member Mccaslin Motion carried.
