I regret I will not be able to fulfill a role on the Cultural Arts Commission. The Englewood Urban Renewal
meetings are at an influx, with meeting times conflicting with the EAC meeting times. Last night 11 /5 was an
example where EURA met with a developer we are currently with.
Although I am a sculptor working in the public sector, my civic expertise lies in the area of using cultural arts to
engage economic development. The projects I have been involved with cross over into a broad form of
community development. This expertise comes from a real estate investment perspective. It is my observation
the Cultural Arts Commission is not quite yet, integrated with those sectors of government for me to function as
an effective member of the board.

PROCLAMATION
WHEREAS, the Sock It To Em Sock Campaign strives to raise awareness for the homeless throughout
the winter months and gather donations of new and gently used socks to warm the feet of those without
shelter; and
WHEREAS, 2014 marks the fourth annual Sock It To Em Sock Campaign and Sock It To Em Work
Day, where Colorado communities are asked to forgo their socks and support the homeless as a show of
solidarity; and
WHEREAS, those who participate in the Sock It To Em Sock Campaign are encouraged to post
pictures of themselves on the Campaign's Facebook page sporting bare feet and ankles in order to help
raise awareness of the cause and help encourage others to donate warm comfort to those in need; and
WHEREAS, the Sock It To Em Sock Campaign is a joint effort of volunteers, local businesses and
donations who have a goal of providing socks to 50,000 fellow Coloradoans in need this winter; and
WHEREAS , the Sock It To Em Sock Campaign encourages communities, schools and organizations
to adopt the day and start their own sock campaign throughout the winter months to raise awareness, lend
a helping hand; and
WHEREAS, the residents of Englewood, Colorado join this effort and contribute to the Sock It To Em
Sock Campaign benefiting the homeless.
NOW THEREFORE, I, Randy P. Penn, Mayor of the City of Englewood, Colorado, hereby proclaim
December 10, 2014:

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
The Assistance to Firefighters Grant (AFG) program through the Federal Emergency Management Agency
(FEMA) provides funding for a variety of programs, equipment and facility needs within the United States
fire services. The AFG conforms to the following City Council objectives:
• A City that provides and maintains quality infrastructure
• A safe, clean and attractive City
• A progressive City that provides responsive and cost efficient services
City Council has approved AFG applications during the past 12 years since the inception of the program in
2002. The Fire Department has received grants through AFG in 2002, 2003, 2004, 2009 and 2011.
RECOMMENDED ACTION
Staff recommends Council approve a resolution authorizing an application to AFG for the purchase of
replacement portable radios, mobile radios and base station radios for the Fire Department.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The communications systems currently used by the Englewood Fire Department are now approaching end
of life and will no longer be supported by the manufacturer. Parts and repairs will become increasingly
more difficult to find and more expensive to purchase. Further, the Federal Communications Commission
(FCC) has mandated a new emergency response framework that will go into effect in 201 7 requiring all
emergency service providers to have P25 compliant radio equipment with a narrowband format.
Englewood Fire Department radios do not meet the 201 7 FCC P25 requirement. City Council approved a
similar AFG application in 2013 but the Fire Department was unsuccessful in obtaining that grant. The Fire
Department desires to submit another application to AFG for funding to purchase 19 P25 compliant mobile
(vehicle) and 34 P25 portable (handheld) radios along with five P25 base station radios (stationary) to bring
the department up to the P25 standard as well as to replace our currently obsolete radios . Communication
equipment is a high funding priority for the 2014 AFG program . The amount offederal money allocated to
the Assistance to Firefighter Grant program is evaluated annually as part of the Federal Budget. It is
unknown how much money will be allocated in the future, or what the funding priorities may be in future
grant periods. The AFG application deadline is December 5, 2014.
FINANCIAL IMPACT
•
The AFG, for a city of Englewood 's population, is a 90% Federal grant, which means the City would be
required to provide a 1 0% match in funds for the project if awarded by FEMA and then approved by City
Council. The Fire Department is actively preparing the application and is still working out the details of the
total cost of the project with our current service provider. The current estimate of the total cost of the •
project including radios, batteries, chargers, and accessories is $279,453. The AFG amount would be
$254,049, and the City's responsibility would be $25,404. The upcoming move to MetCom Dispatch does
not affect this need whatsoever. Englewood Fire Department is still required to have our own radios and to
meet the Federally Mandated P25 standard by 201 7. Our City's Public Improvement Fund (PIF) for capital
purchases could be used as a source for the required match. Submitting this grant application does not
commit the City to accepting the funds should the grant be awarded.

reflects Western States Contracting Alliance (WSCA) Pricing (Colorado State Contract) .

A RESOLUTION AUTHORIZING THE APPLICATION FOR A FEMA ASSISTANCE TO
FIREFIGHTERS GRANT (AFG) AW ARD TO THE CITY OF ENGLEWOOD, COLORADO.
WHEREAS, the City of Englewood has received grant awards from the FEMA Assistance to
Firefighters Grant Program in 2002, 2003, 2004, 2009 and 2011; and
WHEREAS, the radio communication systems currently in use by the Fire Department were
acquired approximately 11 years ago and are now obsolete; and
WHEREAS, technical support through the manufacturer and service provider ended last year,
and while repairs are still possible, parts for the current radios will no longer be available when the
current inventory of parts on the market is depleted; and
WHEREAS, the Federal Communications Commission (FCC) has mandated a new emergency
response framework that will go into effect in 2017 (originally 2013) requiring all emergency
service providers to have P25 compliant radio equipment with a narrowband format, which the Fire
Department currently does not have; and
WHEREAS, the Englewood Fire Department desires to submit an application to AFG for
funding to purchase nineteen P25 compliant mobile (vehicle) and thirty-four P25 portable
(handheld) radios along with five P25 base station radios (stationary) to bring the department up to
the P25 standard as well as to replace currently obsolete radios; and
WHEREAS, the AFG for the City of Englewood's population, is a 90% federal grant (the
expected total cost of the project to be approximately $279,453, expected 90% federal grant to be
approximately $254,049, which means the City responsibility would be $25,404 for the project if
awarded by FEMA and then approved by City Council; and
WHEREAS, the City's matching funds are not currently budgeted and an appropriation request
is anticipated from the Fire Department should this Grant be awarded .

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:
Section 1. The City Council of the City of Englewood, Colorado hereby authorizes the
Englewood Fire Department to submit an application for a FEMA Assistance to Firefighters
Grant (AFG), for federal funding to purchase nineteen P25 compliant mobile (vehicle), and
thirty-four P25 portable (handheld) radios along with five P25 base stations radios (stationary) to
bring the Department up to the P25 standard as well as to replace our currently obsolete radios,
attached hereto as Exhibit A.

The City of Englewood is an urban, full-service community which borders the city of Denver Colorado on the
south side. The city is located near the intersection of two state highways, the South Platte River, and is an
employment site for close to 80,000 people during the work-day . The city is home to Swedish Health One -a
regional level 1 trauma center, and Craig Hospital, a world recognized spinal rehabilitation hospital. The city
occupancies include a mix of light industry, commercial and residential properties.
The Englewood Fire Department [EFD] is a full-service urban career department serving the citizens, work
force, and visitors of the city of Englewood. The Fire Department provides the following services:
• Fire suppression I investigations
• ALS-level EMS treatment and transport
• Hazardous Materials response I mitigation
• Technical Rescue -confined space I trench I rope
• Code Enforcement -IFC / IBC code enforcement
• Fire Prevention & Safety Education programs
The Fire Department is an active member in the Arapahoe/Douglas County Regional Hazardous Materials
Response Team, and the regional trench rescue response team. The department cooperates in automatic aid
and mutual aid agreements with its surrounding jurisdictions. Additionally, the department maintains a local
training center in cooperation with the City of Littleton Fire Department.
The City of Englewood covers 7 square miles. Heavy and light rail lines run through the city at a rate of 15
trains per day. Approximately 200,000 vehicles travel the city's two major highways each day . The city
contains four buildings of ten stories or more, and twenty-eight of four or more stories .
The city is home to 31, 727 residents as of the last census. The Fire Department consists of three stations.
fifty-one line personnel and six administrative staff. The department staffs two engine companies, one heavy
rescue engine, and two ALS medic units. The department also houses a haz mat response unit. a mobile
air/light trailer, and a utility/support response vehicle. Shift personnel work a modified Berkeley schedule and
average 4,000 responses per year, or twelve calls per day. Administrative staffing includes the Fire Chief,
Deputy Chief of Operations, Assistant Chief of Support Services, EMS Bureau Chief, Training Bureau Chief,
Fire Marshall, Assistant Fire Marshall and Administrative Assistant.

The City of Englewood, Colorado has slowly recovered from the 2008 financial downturn. Since 2009 the
City's revenues have exceeded expenditures only once. The City's revenue growth which is mainly driven by
sales taxes, while recovering, still struggles to meet personnel cost increases which comprise 91 o/o of the Fire
Department budget.
The City has relied on using one-time transfers and reserves to make up the lack of revenue growth. The City
has held fire positions open and kept other vital city personnel positions open to reduce spending.
While the City expects revenues to meet or exceed expenditures in 2014, the 2015 Budget projects a deficit
of $2.5 million. The capital budget for 2014 and 2015 is extremely limited and will mainly consist of
maintenance needs with little remaining to fund additional capital requests. The Fire Department has many

capital requests include station refurbishing/station replacement, and replacement of an aging apparatus fleet
The lack of capital funds will also severely restrict the ability of the Fire Department to be approved funds to
upgrade Its radios.

As the duly authorized representative of the applicant I certify that the applicant:
1. Has the legal authority to apply for Federal assistance and the institutional, managerial
and financial capability (including funds sufficient to pay the non-Federal share of project
costs) to ensure proper planning, management and completion of the project described in
this application .
2. Will give the awarding agency, the Comptroller General of the United States, and if
appropriate, the State, through any authorized representative, access to and the right to
examine all records, books, papers, or documents related to the award; and will establish
a proper accounting system in accordance with generally accepted accounting standards
or agency directives.
3. Will establish safeguards to prohibit employees from using their positions for a purpose
that constitutes or presents the appearance of personal or organizational conflict of
interest. or personal gain .
4. Will initiate and complete the work within the applicable time frame after receipt of
approval of the awarding agency.

7. Will comply, or has already complied, with the requirements of Title II and Ill of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 91-646)
which provide for fair and equitable treatment of persons displaced or whose property is
acquired as a result of Federal or federally-assisted programs. These requirements apply
to all interest in real property acquired for project purposes regardless of Federal
participation in purchases.
8. Will comply, as applicable, with provisions of the Hatch Act (5 U.S .C. §§1501-1508 and
7324-7328) which limit the political activities of employees whose principal employment
activities are funded in whole or in part with Federal funds.
9. Will comply, as applicable, with the provisions of the Davis-Bacon Act (40 U.S.C. §§276a
to 276a-7), the Copeland Act (40 U.S.C. §276c and 18 U.S.C. §87 4), and the Contract
Work Hours and Safety Standards Act (40 U.S .C. §§327-333), regarding labor standards
for federally-assisted construction subagreements.
10. Will comply, if applicable, with flood insurance purchase requirements of Section 102(a) of

to EO 11990; (d) evaluation of flood hazards in floodplains in accordance with EO 11988;
(e) assurance of project consistency with the approved State management program

(f) confomnity of Federal actions to State (Clean Air) Implementation Plans under Section

of underground sources of drinking water under the Safe Drinking Water Act of 197 4, as
amended (P.L. 93-523); and, (h) protection of endangered species under the Endangered
Species Act of 1973, as amended (P.L. 93-205).
12. Will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. Section 1271 et seq.)
related to protecting components or potential components of the national wild and scenic
rivers system.
13. Will assist the awarding agency in assuring compliance with Section 106 of the National
Historic Preservation Act of 1966, as amended (16 U.S.C. 470), EO 11593 (identification
and protection of historic properties), and the Archaeological and Historic Preservation Act
of 1974 (16 U.S .C. 469a-1 et seq .).
14. Will comply with P.L. 93-348 regarding the protection of human subjects involved in
research, development, and related activities supported by this award of assistance.
15. Will comply with the Laboratory Animal Welfare Act of 1966 (P .L. 89-544, as amended, 7
U.S.C. 2131 et seq.) pertaining to the care, handling, and treatment of wamn blooded
animals held ror research, teaching, or other activities supported by this award of
assistance.
16. Will comply with the Lead-Based Paint Poisoning Prevention Act (42 U.S .C. Section 4801
et seq.) which prohibits the use of lead based paint in construction or rehabilitation of
residence structures.
17. Will cause to be performed the required financial and compliance audits in accordance
with the Single Audit Act Amendments of 1996 and OMB Circular No. A-133, "Audits of
States, Local Governments, and Non-Profit Organizations."

(c) Are not presently indicted for or otherwise criminally or civilly charged by a government entity
(Federal, State, or local) with commission of any of the offenses enumerated in paragraph (1 )(b)
of this certification: and
(d) Have not within a three-year period preceding this application had one or more public
transactions (Federal, State, or local) terminated for cause or default; and
B. Where the applicant is unable to certify to any of the statements in this certification, he or she shall attach
an explanation to this application .
3. Drug-Free Workplace (Grantees other than individuals)
As required by the Drug-Free Workplace Act of 1988, and implemented at 44CFR Part 17, Subpart F, for
grantees, as defined at 44 CFR part 17, Sections 17.615 and 17.620:
(A) The applicant certifies that it will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is prohibited
in the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition;
(b) Establishing an on-going drug free awareness program to inform employees
about:
( 1) The dangers of drug abuse in the workplace;
(2) The grantees policy of maintaining a drug-free workplace;
(3) Any available drug counseling, rehabilitation and employee
assistance programs; and
(4) The penalties that may be imposed upon employees for drug
abuse violations occurring in the workplace;
(c) Making it a requirement that each employee to be engaged in the performance
of the grant to be given a copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a
condition of employment under the grant, the employee will:
( 1) Abide by the terms of the statement and
(2) Notify the employee in writing of his or her conviction for a
violation of a criminal drug statute occurring in the workplace no later
than five calendar days after such conviction.
(e) Notifying the agency, In writing within 10 calendar days after receiving notice
under subparagraph (d)(2) from an employee or otherwise receiving actual notice
of such conviction. Employers of convicted employees must provide notice,
including position title, to the applicable OHS awarding office, i.e. regional office or
OHS office.
(f) Taking one of the following actions, against such an employee, within 30
calendar days of receiving notice under subparagraph (d)(2), with respect to any
employee who is so convicted:
(1) Taking appropriate personnel action against such an employee,
up to and including termination, consistent with the requirements of
the Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug
abuse assistance or rehabilitation program approved for such
