Call to Order The regular meeting of the Englewood City Council was called to order by Mayor Penn at 7:30 p.m. 2 . Invocation The invocation was given by Council Member Mccaslin. 3 . Pledge of Allegiance The Pledge of Allegiance was led by Council Member Mccaslin. 4. Roll Call Present: Absent: A quorum was present. Consideration of Minutes of Previous Session (a) COUNCIL MEMBER WOODWARD MOVED, AND COUNCIL MEMBER OLSON SECONDED, TO APPROVE THE MINUTES OF THE REGULAR CITY COUNCIL MEETING OF NOVEMBER 4, 2013. Englewood City Council November 18, 2013 Page 2 Vote results: Motion carried. (b) members . Ayes : Council Members Jefferson , Mccaslin, Wilson, Penn, Woodward , Olson, Gillit Nays : None City Council recognition of departing member and swearing in of newly elected City Council (i) The Mayor asked the City Clerk to announce the status of the election . City Clerk Ellis said, based on the Un-Official Election Results provided by Arapahoe County, the newly elected Council Members are : Council Member District 2 -Linda Olson, Council Member District 4 -Rick Gillit and Council Member At-Large -Steven R. Yates . (ii) City Council made a determination of the election and qualifications of its membership. COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER WOODWARD SECONDED, TO ACCEPT THE ELECTION RESULTS AS PRESENTED BY CITY CLERK ELLIS. Vote results: Motion carried. Ayes : Council Members Jefferson, Mccaslin, Wilson, Penn , Woodward, Olson, Gillit Nays: None (iii) There were comments and recognition of the family and guests by the departing member of City Council, Mayor Pro Tern Woodward . Mike Fordyce , President and CEO of Craig Hospital recognized Mayor Pro Tern Woodward . Ida May Nicholl , an Englewood resident , thanked Mr. Woodward for his many years of service . She commended him for his huge amount of time and for his dedication as a public servant. Ms . Nicholl wished him good health and success in his future endeavors . (iv) The newly-elected/re-elected City Council members were sworn in by the Honorable Judge Vincent Atencio . After they were sworn in, they all signed their oath of office. (v) Members of City Council were seated (in temporary spaces). (vi) Mayor Penn called for nominations for Mayor. COUNCIL MEMBER YATES MOVED, AND COUNCIL MEMBER GILLIT SECONDED, TO NOMINATE COUNCIL MEMBER JEFFERSON FOR THE OFFICE OF MAYOR OF THE CITY OF ENGLEWOOD. Vote results: Ayes : Council Members Yates, Jefferson, Gillit Nays : Council Members Mccaslin, Wilson, Penn , Olson Motion defeated . COUNCIL MEMBER McCASLIN MOVED, AND COUNCIL MEMBER WILSON SECONDED, TO NOMINATE MAYOR PENN FOR THE OFFICE OF MAYOR OF THE CITY OF ENGLEWOOD. Vote results: Motion carried. COUNCIL MEMBER JEFFERSON MOVED, AND COUNCIL MEMBER YATES SECONDED, TO NOMINATE COUNCIL MEMBER GILLIT FOR THE OFFICE OF MAYOR PRO TEM OF THE CITY OF ENGLEWOOD. Vote results: Ayes: Council Members Yates , Jefferson, Gillit Nays : Council Members Mccaslin, Wilson, Penn, Olson Motion defeated . COUNCIL MEMBER WILSON MOVED, AND COUNCIL MEMBER McCASLIN SECONDED, TO NOMINATE COUNCIL MEMBER OLSON FOR THE OFFICE OF MAYOR PRO TEM OF THE CITY OF ENGLEWOOD. Vote results: Motion carried . guests present. Ayes : Council Members Yates, Mccaslin , Wilson, Penn , Jefferson , Olson , Gillit Nays : None (viii) Permanent seating assignments were selected by seniority . (ix) The newly-elected/re-elected members of City Council recognized their families and (x) Brief Reception. Council recessed at 8:07 p.m. for a brief reception . The meeting reconvened at 8:36 p.m. with all City Council members present. 6 . Recognition of Scheduled Public Comment There were no scheduled visitors. 7. Recognition of Unscheduled Public Comment (a) Elaine Hults , an Englewood resident, said she is thrilled with the way the election was handled and that people were fair with their behavior. She is appreciative of the beautiful Christmas lights surrounding the Civic Center and she hopes someone will add lights along Broadway . (b) Ida May Nicholl, an Englewood resident, presented a letter to Council regarding some clarifications regarding previous statements she had made at prior Council meetings . She congratulated those elected and reelected to Council and the Judge . She hopes Council will move forward to preserve the history of Englewood and to work with the Englewood Preservation Historical Society. Ms. Nicholl wished the Parsons well with the Depot. (c) Abigail Berry , an Englewood resident , spoke regarding the Home Occupations discussion and the Cottage Food Act. She wanted to inform Council how important this is to her and to others . Council responded to Public Comment. 8 . Communications, Proclamations and Appointments (a) An email from Jeannette Sarconi announcing her resignation from the Alliance for Commerce in Englewood was considered . Englewood City Council November 18, 2013 Page 4 COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER JEFFERSON SECONDED, TO ACCEPT THE RESIGNATION OF JEANNETTE SARCONI FROM THE ALLIANCE FOR COMMERCE IN ENGLEWOOD. Vote results: Ayes : Council Members Yates, Mccaslin, Wilson , Penn, Jefferson , Olson, Gillit Nays : None Motion carried. 9 . Consent Agenda COUNCIL MEMBER OLSON MOVED, AND COUNCIL MEMBER WILSON SECONDED, TO APPROVE CONSENT AGENDA ITEMS 9 (a) (i), 9 (b) (i) and (ii). (a) Approval of Ordinances on First Reading (i) COUNCIL BILL NO . 61, INTRODUCED BY COUNCIL MEMBER OLSON A BILL FOR AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF AN INTERGOVERNMENTAL PUBLIC LIBRARY GRANT FROM THE COLORADO STATE LIBRARY . (b) Approval of Ordinances on Second Reading (i) ORDINANCE NO . 62, SERIES OF 2013 (COUNCIL BILL NO . 58, INTRODUCED BY COUNCIL MEMBER WOODWARD) AN ORDINANCE AUTHORIZING ADDENDUM NO . 1 TO THE BROKEN TEE GRILL, LLC . CONCESSIONAIRE AGREEMENT . (ii) ORDINANCE NO. 63 , SERIES OF 2013 (COUNCIL BILL NO . 59, INTRODUCED BY COUNCIL MEMBER GILLIT) AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF ENGLEWOOD AND THE ARAPAHOE COUNTY SCHOOL DISTRICT NO. 1 CONSOLIDATING PREVIOUS SHARED SERVICE AND JOINT ACTIVITY INTERGOVERNMENTAL AGREEMENTS BETWEEN THE TWO PARTIES; MODIFYING AGREEMENTS CONCERNING HOSANNA FIELD AND AUTHORIZING APPLICATIONS FOR GRANTS. Vote results: Ayes : Council Members Yates , Mccaslin, Wilson, Penn, Jefferson, Olson, Gillit Nays : None Motion carried. (c) Resolutions and Motions There were no resolutions or motions submitted for approval. 10. Public Hearing Items No public hearing was scheduled before Council. 11. Ordinances, Resolutions and Motions (a) Approval of Ordinances on First Reading • • • ... • • • Englewood City Council November 18, 2013 Page 5 (i) Senior Planner Neubecker presented a recommendation from the Community Development Department to approve a bill for an ordinance authorizing amendments to Title 16 : Unified Development Code regarding Home Occupations . Staff further recommends setting December 2, 2013 as the date for a Public Hearing to gather public input on the proposed amendments. COUNCIL MEMBER GILLIT MOVED, AND COUNCIL MEMBER YATES SECONDED, TO TABLE AGENDA ITEM 11 (a) (i) -COUNCIL BILL NO. 60 AND TO SET A STUDY SESSION DATE OF JANUARY 6, 2014 FOR FURTHER DISCUSSION. Vote results: Motion carried . Ayes: Council Members Yates , Mccaslin, Wilson, Penn, Jefferson, Olson, Gillit Nays: None (b) Approval of Ordinances on Second Reading There were no additional items submitted for approval on second reading . (See Agenda Item 9 (b) -Consent Agenda.) (c) Resolutions and Motions There were no resolutions or motions submitted for approval. 12. General Discussion (a) Mayor's Choice (b) Council Members' Choice (i) There was a d iscussion of the results of Question No. 28 and Question No . 300 on the November 5, 2013 ballot.
