Background :
On August 6, 20 13, th e Planning and Zo ning Co mmissi o n rev iewed a proposal to modify
the exis ting poli cy o n H ome Occupa ti ons (EMC 16-5-4 C 1 ). Thi s rev iew wa s in res ponse to
Ci ty Council concerns abou t ex isting res tri ctio ns that proh ibit home occu pati on s in th e R-1-
A di stri ct, whi ch is the res ide ntial dis tri ct wi th the larg es t si ngl e farnuy lo ts in the city. The
Planning and Zoni ng Co mmissio n supported mos t of th e pro p osed changes , but raised
co nce rn s abo ut so me of the proposed restri ctions o n co mmerci al ve hicles in light of the
Citizen Referendum 20 , codi fi ed a, Ortli 11,m ce 1, Ser ies 20 11 /2012 .

was proposed to preserve the residenti a l c haracte r a nd ex~l•J' l'ily in the R-1 ·A di stric ts.

The C ommission did not reach a consensu s on sal es of goods or services a t a ho me
occupa tio n in the R-1 A zone di s tri ct. Some agreed that sa les, cus tom e rs and c lients shoul d

customers and client s comin g lo a resi dential property i; a vital part of operating a h ome
based busi ness. Th e c oncern focused o n the nu111b e r of people and cars per day, which
could be significant at t imes. One example was a tax accountant in Marci , and Ap ril, whi c h
could genPrale m a ny daily visi ts d uring th e busiest t im es of the tax season.
Staff does n o t believe th a t c ustomer traffic wi ll be si gni fican t in mos t cases. Al so , we belie ve
that most of the potential impac ts of home occu pa tions arc aod essed by lim iti ng u ses,
pro h ibiting e~terior sig n s and display of me rch andis<.:, a nd prohibitin g e mployees no t
res id in g at th e pro perty.
Recommendation
Staff believe·, that the p ro posed draft code changes c a pture the in te nt a nd consensus of th~

Th is matter was heard before the City Planning and Zoning Comm ission on October 8,
2013 in the City Council Chambers of the Englewood Civic Cen ter .
Testimony was rece ived from staff. The Commission received notice of Public Hearing ,
the Staff Report, and a copy of the proposed amend men ts to Title 16 Unified
Development Code wh ich we re incorporated into and made a part of the record of the
