RECOMMENDED ACTION
Staff rer.ommPnds th~ City Council approve the attached bill for an ordinance authorizing
amendments to the City of Englewood Police Officers Pension Plan Documer,t.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
This bill for an ordinance does not substantially change the current level oi pension benefits for the
Police Officers Pension Plan participants. The bill for an ordinance makes changes ~ by the
Internal Revenue Service (IRS) or Colorado State Statutes. The Plan document is amended to
comply with federa l or state requirements .
1. Add the following to Article II, Section 4 to clarify the application of Code section 4 l 4(u)
requirement, that have been in effect since December 1 ~. 1994 :
A Participant who returns to employment with the City from qualified military service during the
period within which reemployment rights are guaranteed by law will rece ive Service with respect to
the Participant 's period of qualified military service (within th ~ meaning o f Section 414(u)(l) of the
Code) in accordance with Section 414(u) of the Code and applicable regulations, and as described
in subsections a and b below.
a. Serv ice Necessary for a Deferred Vested Pension . A Participant's qualified
military service counts toward the five years of Servi ce required for a
Deferred Vested Pension.
b . Service ior All Plirposes Other Than Def~r..-e d Vested Pensi on Requirements.
