BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED This bill for an ordinance does not sobstantiaily change the current level of pension henefits for the Firefighters Per.sion Pla n partici pants . The bill for an ordinance makes changes ~ by the Internal Revenue Service (IRS). The Plan document is amended to comply with federal or state requirem ents . 1. Add the ioilowin)I to Article II, Section 4 to clarify the application of Code section 414(u) requirements th at have been in effect since Decemb er 12, 1994: A Participant who returns to employment with the City from qual ified military service during the period within which re employment rights are guar anteed by law will rece ive Serv i:e with respe ct l o the Pa rticipant's period of qualified military service (within the meaning of Sect ion 414(u)(l) of the Code) in accordance with Section 414(u) of the Code and applica ble regulations, and as described in subseclions a and b below. a.
