ENGLEWOOD MUNICIP Al. conF. 2000 WHICH PERT A[NS TO MEDICAL MARIJUANA.
Wl:fEREAS, a Constitutional Amendment aml subsequent lcyislatiou p1ovidcd a method for
the regi st ration of patients and responsibilities regarding cultivation or production of Medical
\farijuana; and
WHEREAS , the Cit y :urthcr wishes to protect and balance the reasonable and lawful rights of
Patients and Primary Care-Givers with the protection, health , safety end we! fare of the people of
th e City through prevention and mitigati on of deleterious and ne11ativc secondary effects that
may occur or arc likely to occur from the presence of Medical Marijuana in the City of
Englewood, Co lora do; ar.d
WHEREAS , federal and state laws arc binding upon home rule m,nicipalitie:;. However,
neither this Article nor its adoption. implementation. or enforcement shall be co nstmerl as an
intent of the City, its elected officials, its employees or contr,ctors or Au:hority members to
violate federal law, including but not limited to , the Controlled Substances Act of 1970, as
amended, nor shall such adoption , implementation or enforcement be construed as acquiescence
or conspiracy by the City, its elected officials, appointed Authority mcmhers, contractors, or its
employees to violate such federal and state law;
NOW, TIIEREFORE , BE IT ORDAINED BY Tl:fE CITY COUNCD.. OF THE CITY OF
E1'GLEWOOD, COLORADO, 11-IAT:
Section I . The City Council of the City of Englewood, Colorad~ hereby authorize s amending
Title 7, Chapter 6D , Section 12, of the En~lewood Municipal Code 2000. to read as follows:

Ordinance is promulg>ted under the general police po.,·er of the City of Englewood , that it is
promulgated for the health, safely,and welfare of the public, and tl.lllt this Ordinan ce is necessary
for the preservation of health and ;afety and for the protection of public convenience and
wclforc . TI1c Cit y Counci i funhcr determines that the Ordinance bears a ra1ionnl rclntion lo the
proper legisla 1ive object sought to be obtained .
~-Scvcrability . If an y clause, senlencc , paragraph, or part of 1h1s Ord inance or lhe
application the reof 10 any person or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid. such judgment shall not affect, impair or invalidate the remainder

Scc1io11 4. lnconsislcnl Ordinances . All other Ordinances or portions thereof inconsistent or
