WHEREAS , this Agreement sets forth the requlfemcnls for panicipation in the federal equitable shanng program and the restrictions upon the use of the federal!} forfcitt:<l cush, propeny, proceeds and any interes t earned thereon. which art equitably shared with panicipaling law enforcement agencies : and WHEREAS, Englewood periodically receives monies from the Justice Dcpanment and Treasury Dc-pmmenl for panicipa:ion or assistance provided to chese agencies such as IRS, DEA and the FBI ; aad WHEREAS, one of these federal groups is the South Metro Dmg Task Force, which in exchange for the Englewood Police Dcpanment 's commitment of one officer to the South Metro Dmg Task Force fnr a 2 year period , received the funds in the amount of S2 I 8,000, these funds were 10 o:fset the Englewood Police Dcpanmcnt's cost of the officer's sal ,;y; and WHEREAS , lo panicipale in the program, the City annually signs the Equitable Sharing Agreement and Cenification which in tum is submitted to the federal government cenify1J1g compliance wtth federal forfeirure guidelines; and WHEREAS, authorization of this Agreement is require<! for the City of Englewood's continuation of panicipatian in the United States Dcpanmcnt of Justice Fe ;era! Equitable Sharing and Cenitication and will aut~ori2c the City's panicipation in thi, rrogrmn for 20 I 0, 2011 , 2012 and 2013 . RECOMM, NDED ACTION Th e Pol ice LJ epartment is recomm ending that City Counc il adopt a Bill for an Ordinanct' authorizing an Intergovernmental Agreemen: allowing the Englewood Police Department to accept forfeiture monies from the Department of Justice and the Department of th e Tr ea sury by completing 1he Federal "Equil)• Sharing Agreement and Certification" form, Th is request is for fiscal years 2010, 2011 , 2012, and 20·13 , BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Englewood Police Department periodically receives Fe Jeral forfeiture monies from the Justice and Treasury Departments for our participation or assistancf ovided to these agencies such a,. the internal Revenue Service (IRS), Drug Enforcement Agency (DEA, . ,d Federal Bureau of lnvestigatior, (FBI). These funds are used for law-enforcement purposes, such as equipment purchases and training. A•. part of our participation, we are required to sign a Federal Equitable Sharing Agreement and Certificat .on which sets forth the requirements for participation in the Federal Equitable Sharing Program and the restrictions upon the use of federally forfeited cash, property, proceeds, and any interest earned thereon, "'hich are equitably shared with participating law enforcement agencies, including the Englewood Police Department. The City of Engle\Vood's Finance Department place, this mo ney into des ignated accounts and tracks deposits, expenditures, and interes1 on these accounts. Upon year-e nd, the Chief of Police and Mayor sigrr the Equitable Sharing Agreement and Certificatio n, which is then submitted to the Federal Government certifying compliance with fed eral forfeiture gu idelines . 7bis must l>e dorre within 60 days of the end of the City 's fiscal year. FINANCIAL IMPACT Federal forfe iture funds are deposited into the Police Donor's Fund and are useci to pay for police-related equipment and training which would otherwise require Cily funding .
