in accordance with the zoning district regulations of th is Chapter 16-3 EMC, the use regulations of
Cha pter 16-5 EMC, the development standards of Chapter 16-6 EMC, and all other applicable
regulations of this Title .
Section ,. The City Council of the City of Englew ood, Colorado hereby authorizes amending Title
16, Chapter 3, Section 2 "Disrrict Charactenstics" and Title 16 , Chapter 3, Section 2, Subsection D,
"Residential Districts " of the Englewood Municip al Code 2000 to read as follows :
16-3-2 : District Characteristics.
On o of the goals of the City is to encourage a variety of housing types to n,eet the needs of differing

Englewood req uires looking beyond housi ng typ e to housing tenure and maintenance.
About two thirds of Englewood homes are single farnily dwellings of which 85% are owner-
occup ied . Of the one third that are multi-family homes. less than 3% are owner-occupied.
Taken togethN, SJ% of Englewood homes are occupied by their owners . Nationallv, about
06% of homes are owner-occupied. The City is commined to increasing Englewood owner-
occupancy rates to more closely reflect national rates ." Goal #2 states "Improve the quality
of the City's existing housing stock"; under Objective 2.1 it ,.1ate, "Encourage home
ownership, property improvement, and house additions ". In the Medical District Small Area
Plan Goal A, Medical Area Sub-area 2. Objective 2A.1 states "Reduce the number of single
unit renta l homes through conversion to home ownership". By establi -.1,ing the Overlay you
are inducing liome ownership.
Mr. Welker stated he feels some of tonight's discussion is premature in that th e bounciaries
of this distri ct were really the intention of the third part of the public hearing tonight. He
stated that an NPO District as an overldy is an advancement in the types of discussions the
Commission t,,i, 11,,J tlidt have bee n eitlrer 1,een to one ex treme, downzoning, or to the
nthP.r P.xtrP.m e, op ening the area up to mixed-use on a grander scale . Whl!e over time this
area r,iay evo lve into being a denser , more commercial typ e of district b~!.:?d on pressure
from ownership and use of adjoining properties the north two blocks ar e kind of a
transition between strict single fomily homes and co mmerci al deve lopm ent . Putting them in
an overlay district that allows them to be kept as is, which is primarily single family homes
or duplexes, is appropriate. He doesn't feel the bugs are worked out of the paperwork ju st
yet. It would havia, been better if this i,~ue lrad gone through the steps that were omitted; a
Planning and 7.oning study session and either a neighborhood meeting or a study session in
which the p16lic attended .

Mr. Roth stated there are too many issues to work out. There are loo many potential

Mr. King said he not opposed to an overlay. This area is fairly diver;e and that may be the
only way to go. The Planning and Zoning Commission has a fiduciary responsibility to the
entire community. Otherwise, we would just allow everybody to zone the ir properties

Mr. Fish said he has reviewed the materials provided b~ Slaff. There has been minimal
public inpul other than to the process, but not to the substance of this molion. He stated he
has reviewed the tables and finds the idea of an MU-R-3-C wne clistri<:I cornpell111g, but
some of the proposed tables seem 10 be in conflict. The Commission did a 101 of work lo
pul together the MO-1 m·erlay for good reason and considering the intent of lhe lhird case
lonighl he is troubl ed by the rem oval of that.
Mr. Brick slated in Section i of Roadmap Englewood under Busine ss Employment that in
Go<1I 1, Objec tiv e 1.2 it stJl.c> "Actively engage in att1;;cting new businesses to the City". In
Goal 5. Objective 5.1 ii ,tales "E ncourage the development of mixed-use projects in order
lo achieve a vibrant community". Objective 5.2 states "Increases the value and appeal of
Englewood's retail and industrial corridors in order to stimulat e economic growth".
Mr. Welker stated even though the Planning and Zoning Commission did 1101 specifically
discuss MU-R-'.l-C this is a fitting classification for the use of the area that it is proposed. He
stated he ha5 no problem with changing the ~,ca zoned MO-1 lo M -1 bec;iuse of what M -1
allows.
Mr, Kinton finds lh al the designation of an MU-R-3-C zone district reasonable.
Mr. Roth stated he has concerns changing th e MO i 10 M -1, however the area is small
enough he doesn 't believe there would be room 10 build a 145 foot building on that
•,ection of land .
Mr King said this is another u11ique area but this area is als o highly, dt.ns ely populated with

Testir'ony was received from staff and the public. The Commission received notice of
Publk Hearing, the Staff Report and a copy of the proposed amendment to the Official
Zoning Map which were incorporated into and made a part of the record of the Public
Hearin•.
After conside rin g the statem ents of th e witnesses, and r~viewing the pertinent do cuments,
the members of the City Planning and Zoning Commission made the following Findings
and Conclus io ns.
FINDINGS OF FACT
1. THAT the Public Hearing 01t in e Amendment of the Unified D eve lop ment Code

3. THAT res,d.,nts, riror,P.rty owners, and business owners having personal interests
within and one block beyond the original Downtown and Medical District study
area boundaries were invited to participate JS community stakeholders in th e
Medical District Phase II stakeholder me eting planning process.
4. THAT community stakeholder meetings were held on April 1, 1S , and 27, 20 .0 in
order to gather feedback on stakeholder prefere:1ces fur ,u11i11g 1dun11 strategies
that were later incorporated into amP11dn11'!nts in the Englewood Downtown and
Medica l District Area Plan .

conceptual wning ,~forms that were used by staff to develop the new MU-R-3-C
bas e zone district.

7. THAT all testimony received from staff members and the public has been made part

10 . THAT the proposed Amendments related to the creation of a MU-R-3 -C Zone
District sh-:iuld be adopted as part of Title 16 : Unified Development Code of the
Englewood Municip~I Code .
CONCLUSIONS
I. THAT the Public Hearing on the Amendment of the Unified Development Code
establishing the MU-R-3-C Mixed Use High Density Kesidential District and limited
Office Zone was brought before the Planning Commission by the Department of
Comr:.unity Development, a department of the City of Englewood .
2. THAT notice of the Public Hearing was published in the Englewood Herald on
February 17, 2012 and was on the City', website from February 15"' through
February 27'", and again February 28th through March 6, 2012 with a corrected
case number .
3. THAT notiiication letters were sent to all residents and property owners within 1000
feet of the affected area on February 23, 2012.
4. THAT all testimony receiv ed from ~taff members and the public has been made part
of the record uf the Public Hearing.
5. THAT the goal of the new MU-R-3-C zone regulations is to allow property owners
mare regulatory flexibility and protect neighboring residential property owners and
residents from inappropriately-scaled development.
6 . THAT the proposed amendments related to the crl'ation of a Ml.l-R-3-C Zone
District are consistent with the 1• and objectives ol Roadr,,ap Englewood: The
2003 Englewood Comprehensive , ... n and the Englewood Downtown and Medical
District Small Area Plan.
7. THAT the proposed Amendments relaled to the creation of a MU-R-3-C Zone

Englewood Municipal Code .
DECISION
THEREFORE, it is the decision of the City Pl.inning and Zoning Commission that Case
#2012 -02, Amendment to the Official Zoning map to rezone an area of the City should be
referred to the City Council with a favorable recomrnenda,;on.
The decision was reached upon a vote on a motion made at the meeting of the City
Planning and Zoning Commission on March 6, 2012, by Mr King, seconded by Mr.
Welker, which motion states:
