Ordinance# 12, Series 2009; and Ordinance #27, Series of 2009; Ordinance #16, Series of 2010 ;

WHEREAS , the Justice Assistance urant ts a non-m., ;hing grant for 2012 , awarding tbe City

WHEREAS, the Justice Assistance Grant incorpornlcs fund s fro:n the U.S. Department of

Formula
Once e;,~h fi scal year's overall JAG Program funding level is de termined, IJJA partner,, with the

1. Comp uting an initial JAG alioc at1on for each state and territory, based on !heir shc1re of
v iolenl cri me and population (w eight ed equally).
2. Reviewiroy the i1il :ai J AG allocation amount t-. determine If the state or territory alioca;io1
1s less than th e minimum (":le minim11 s") awa J amount cefin ed in the JAG leg islation

JAG iunds may be used for stat3 and I-Jcal initiatives , technical assistance, strateg ic plann in g,
res ea rch aid evaluation, data r.ollaction, training, personnel, equip ment, for0nsic laboratories ,
supplies, cJntractu al suppo1, and crim inal justice Information systems that witi ;mprove or
en hdn t:,; such areas as:
• Law enjorcem ent programs .
Prosecution and court programs
Prevention and educa!ion programs.
• Corrections and c~mmun lty corrections programs
, Drug treatmen t and enforcement programs .

JAG funds may alsJ be used to add ress key statutory requiremen ts that rray not be otherwise
funded, including requirements from th e state anri federal level, such as addressing limited
English proficiency requirerient, 1nj other similar mandates.
Responsibilities
The C~ief :cxeo~tive Officer (CEO) of an eligible snit of loca l government er other ohicer
desigrated by the CEO mu st s~bmi: the application for JAG fonds . A unil of local gove rnment
receiv ing a JAG award will be responsible fo r th e admlnistr~liun u: ti"' fu nu s inducing:
di stributing the funds; moni:orin~ th e award; submitting quarterly finan:ial st atus (SF -4 25) and
performance metrics reports and annual programmatic repo rts; and providing ongoing overni gl·I
and assistance to any subrccipients of the funds
Length of Awards
Awa rds are made in the first fiscal year of the a;:,propriation and may be expended during the
following 3 years, bra tota : grant pe 1iod uf ~ year:;. Exten si ons beyond th is p e riod may be
made on a case -by-ca se basis 3t the discretion of the Di mcto r of BJA and must be requested

Trust Fund
Award recip ients may draw down JAG funds in advance. To do so, a trus1 fund must be
established In which to deposit the fun~s . The !rust fund may or may not be a, interest-bearing
ar.r.oun:. If subrecipienls draw down JAG fu,:~s in advance, they also must establish a trust funci
in which to deposit funds . This trust fond requirement only applies lo dilecl JAG award
recipients as well as subrecipients that are not on a reimhursement hasis
Match Requirement
While ma1ch is r,ol required with the JAG Program, mater. is as an effective strategy for states
and units of local govemment to ex pand justice funds and build buy-in for local criminal justice
lnit:atives. If an appli:ant proposes a voluntary match amount, the match amount incorporated
Into the OJP-approved budget ~ecom!s mandatory and subject to audit.
Prohibited Usos
No JAG funds may be expended outside of JAG purpose areas . F.ven within these purpose
~re as, however, JAG funds cannot be used directly or indirectly for see11rlty enhancements or
equipment for no~gcvernmcntal enlilies not engaged in criminal justice or public safety . Nor
may JAG funds be used airectly or Indirectly to provide for any v f the following matt.,rs unless
BJA certifies• that extraoxlinary and exigent circumstances exist, making them essential to the
maintenance of public safety and good order:

Budget Information
Limitation on Use of Award Funds for Employee Compensation; Waiver
With respect to 3ny 3ward of mc•re than $250,000 made uncer this solicitation, federal funds
may not be used to pay lctal cash compensation (salary plus bonuses) to any emplo1ee of the
award recipient at a rate that exceeds 110 percent of the maxim.,m annu31 salary payable to a
member of the Fe~eral Government's Senior F.xec11tive Service (SES) at an ag~ncy with a
Certified SES Performance Appraisal Sys,em ior that year. The 2012 salary table for SES

compe1sate an employee al a higher rate, provided the amount in excess of this :ompensallon

services programs and innovative prcgrams and appro3ches in probat ion and pa·ole

development and implementati on of strateg ies for the ide ntification , supervisi:>n , and treatment
