AN ORDINANCE AMENDING TITLE 8, CHAPTER 2 , ARTICLE 8, OF THE ENGLEWOOD
MUNICIPAL CODE 2000, PERTAINING TO THE MECHANICAL CODE OF THE CITY OF
ENGLEWOOD, COLORADO .
WHEREAS, the City of Englewood has used the Unifonn Codes as model construction codes
since 1975; and
WHEREAS, this Code is upcfaterl rr.rin:iically t..1 keep pace with changing construction
technology; md
WHEREAS, the City of Englewood Division of Building and Safely staff has thoroughly
reviewed the International Mechanical Code 2012 and recommends adoption thereofsubjeot tu
certain exceptions, modifications and amendment ;
NOW . THEREFORE, BE IT ORDAINED BY Tiffi CITY COUNClL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS :
Section I . The City Council of the City of Englewood , Colorado hereby authorizes the repeal
of Title 8. Chapter 2, Article D, of the Englewood Municipal Code 2000, in its entirety .
Section 2. The City Council of the City of Englewood, Colorado he;eby adopts the
International Mechanical Code 2012 as Title 8, Chapter 2, Article B, of the Englewood
Municipal Code 2000 , to read as follows :

Section 8-1-7 of the Enslswood Municipal Code pf the Citv of Eoclewood shall

Section 3. Safety Clauses . The City Council hereby finds , determines, and declares that this
Ordinance is promulgated under the general police power of the City of Englewood, that it is
promulgated for the health, safety, and wet fare of the public, ~nd that this Ordinance is necessary
for the pre serv•tion of hettlth aod safety and for the protection of r ,blic convenience and
welfare . The City Council further detennines that the Or<linance tears a rational relation tu the
proper legislative object sought to be obtained.
Section 4. SeverabililY -If any clause , sentence, paragraph, or part of this Ordinance or the
application tl1ereof 10 any person or circumstances shall for any reason be adjudged by a cuun of
competent jurisdiction in\'alid. su ch judgment shall not affect, impair or invalidate the remainder
of this Ordinance or it application to other persons or circumstances .
~ Inconsistent Ordjnanccs . All other Ordinances or portions thereof inconsistent or
conflicting with this Ordinance or any portion hereof arc hereby repealed to the extent of such
incons istency or conflict.
Section 6. Effect of repeal or modification . The repeal or modification of any provi sion of
the Code of the City of Englewood by tnis Ordinance shall not release, extinguish, alter, modify,
or change in whole or m pan any penalty, forfeiture , or liability , either civil or criminal, which
shall have been incurred under such provision, and each provision shall be treated and held as
still remaining in force for the purposes of sustaining any and all proper actions, suits,
proceedings, and prosecutions for the enforcemenl of the penalty, forfeiture, or liability. as well
as for the purpose of sustaining any judgment, decree, or order which can or may be rendered,
entered , or made in such aclions, suits, proceedings, or prosecutions.
~ Choice of Code. Any party who has a pending application, where the permit
application and final site plan have been submitted to th• City before the fate of fmal odoption of
this Ordinance , shall make an election to proceed under either the current Code or the 2006 Code
but not a combination thereof.

RECOMMENDED AUION
Staff requests City Council approve an ordinance adopting the International Mechanical Cnde 2012

BACKGROUND, ANALYSIS, A"JD ALTERNATIVES IDENTIFIEO
The City of Englewood has used the Uniform Mechani cal Code as a model co.,struction code since
t975 and updates this code periodically to keep pace with changing construction technolc,gy.
The Building and Safety staff has thoroughly reviewed the International Mechan ical Code 2012 and
recommends adoption st1bjecI lo cerI .1 in exceptions. modifi :ations and amenc'llents.
FINANCIAL IMPACT
The only cost s associa ted w;th the o rdinance would be fo r the purchase of code books. The
est imated amount is approximately $300.00 and has been budgeted for in the 2012 Budget.
