AN ORDINANCE AM ~ING TITLE 8, CHAPTER 2, ARTICLE H, OF THE ENGLEWOOD
MUNICIPAL CODE 2000, PERTAINING TO 'llfr. FUEL GAS CODE OF THE CITY OF
ENGLEWOOD, COLORADO.
WHEREAS, the City of Englewood has used the Unifvm1 Cod,:s as a model construction codes
sine• 1972; and
WHEREAS , thee• Codes are updated periodically to keep pace with changing constniction
technology; and
WHF..REAS, the City of Englewood Division of Building and Safety staff bas thoroughly
reviewed the International Fuel Gas Code 2012 and recommends adoption thereof subject to
certain exceptions, modifications and amendment;
NOW, THEREFORE, BE 17 ORDAL'IED BY TI£E CITY COUNCIL OF THE CITY U.1'
ENGLEWOOD, COLORADO, AS FOLLOWS:
Section 1. The City Cowicil of the City of Englewood, Colorado hereby authorizes the repeal
of Tille 8, Chapter l, Aniclc °J, oftl1• Engk•uuu Muuicipal Code 2000, in its entirety.
Section 2. The City Council of the Cit> ~r Englewood, Colorndo Lcreby adopts the
International Fud Gas Code 20 I 2 as Title 8, Chapter 2, Article H, of the Englewood Municipal
Code 2000, to read as follows:

~ Safety Clauses The City Council bereb~• finds, detennincs , and declares that this
Onlillance 1s promulgated under the generul police power of the City of Englewood, that it is
promulgated for the health, safely, and welfare of the public, and that this Ordinance is necessary
for the preservation of health and safely and for the protection of public cnnvenicnce Rod
welfare. The City Council further detennines that the Ordinance bears a rutional relation to the
proper legislative object souaht to be obtained.
Section 4. Severability, If any clause, sentence, paragraph, or pan of this Ordinance or the ·
application thereof to any person or circumstances shall for any reason be adjudged by a coun of
competent jurisdiction invalid, such judgment shall not affect , impair or invalidate the remainder
of this Ordinance or it application lo other persons or circumstances.
Section S. Inconsistent Ordinances . All other OrJinar1ces or ponions thereof inconsistent ur
conflicting with this Ocdinance or any ponion hereof are hereby repealed to the extent of such
inconsistency or conflict.
~ Effect of repeal or modification . The repeal or modification of any provision of
the Code of the City of Englewood by this Ordinance shall not release, extinguish, alter, modify,
or change in whole or in part any penalty, forfeiture, or liability, either civil ct criminal, which
shall have been incurred under such prn,isinn, and each provision shall he treated and held as
still remaining in force for the purposes of sustaining any and all proper actions, suits,
proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well
as for the purpose of sustaining any judgment, decree , or order which can or may be rendered,
entered, or made in such actions, suits , proceedings, or prosecutions.
Section 7. Choice ofCoc.e. Ar.y pan)· who bas a penrling application, where the pennit
application and final site plan have been submitted to the City l>oforc the date of final adoption of
this Ordinance, s:,all make an election 10 proceed under ei ther the ~WTcnt Cod; o: the 2006 Code
but not a combination thereof.
Section 8. Penalty. The Penalty Provision ofE.M.C. Section 1-4-1 shall apply to eacli and
every violation of this Ordinance .

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
The adoption of the International Fuel Gas Code 2012 was reviewed by City Council at the May 7,
2012 study session .
RECOMMENDED ACTION
Staff reque.ts City Council approve an ordinance adopting the International Fuel Gas Code 2012 to
establish minimum requirements to safeguard the public health, safety and general welfare.
BACKGROUND, ANALYSIS, AND ALTEKNATIVES IUENTIFIEU
The City of Englewood has used the Uniform Codes as ,1 model construction code for installation of
fuP.I gas systems since 19 72 and updates this code perit•dically to keep pace with changing
~o nstructiun lt!c;hnulogy.
The Building and Safety staff has thoroughly reviewed the International ruel Gas (ode 2012 and
recommends adoption subject to certain exceptions, modifications and amendments.
FINANCIAL IMPACT
The only rost< as.ociatPd with the ordin ance would be for thf' p11r~ha<P of corlP C10 oks . ThP
estimated amount is appro,imately $200.00 and has been budgeted for in the 2012 Budget.
