AN ORDINANCE AL'THORJZING A LEASE AGREEMENT BETWEEi~
CENTENNIAL WATER AND SANITATION DISTRICT AND THE CITY OF
ENGLEWOOD, COLORADO, ElfflTLED "AGREEMENT FOR TEMPORARY
LEASE Ai'ID/OR RE -DIVERSION OF REUSABLE RETURN FLOWS or WATER".
WHEREAS, Englewood injects granular activated carbnn to im?rovc water
qi:ni ity ncu Union Ave , and South Platte River, but the process creates ·:,lackened water
that cannot be directly introduced inlo 1he City Ditch for exchange; and
WHEREAS, c!e3l' waler can be exchanged up city ditch but must be pumped into
the City Ditch from the reservoir adjacent 10 the i\lien Filter Plant ; and
WHEREAS, Englewood has no pump or pipe for pumping thi s water . but
Centennial is agreeing to prov :de and install the pump and pipe al Centennial 's sole
expense; and
\vllEREAS, Centennial Water aad Sanitation District owns reusable was1ewater
return flows to the South Platte River, and 1he City of Englewood has means to re-divert
these nows ot Union Avenue and either ose them or redeliver them to Centennial; and
WHEREAS , the Agreement authorizes diversion of the return flows and
p,.ymcot to Centennial of$85 .00 an acre foot for the flows, plus pumping costs; and
WHEREAS , Centennial would acquire all retum flows delivered to Mclellan
Reservoir that arc not acquired by Englewood and shall pay Englewood $30.00 an acre
foot , plus pumping co sts ; and
WHEREAS , tee Englewood City Council approved an lntcrgovcmmentnl Agreement
for the lease of Englewood's Surplus water in 2003 anc 2004; and
WHEREAS, the Englewood Water and Sewer Doa:d recommended approval of
the Agreement r'or T,:mporary Lease And/Or Re-diversion of Reusable Return Flows of
Water between Centennia l Waler and Saniiation District and the Ci1y of Englewood at its
June 11 , 2U 12 meet ing .

Funds for this Agreement have been budgeted, authorized and appropriated .by the City and
Disuic1 fo r the 2012 fiscal year. Nothing herein ob li ga tes the City or D:1tric1 to budget,
