WHEREAS, in 2003, Arapahoe Co unty voters approved a ten year, quarter-of-a-penny sales and use tax to pa y lor preservanon of open space; protect land s; preserve water quality; and to provide, maintain and improve neighborhood parks. sport fields , pi cnic fa cili ties and trail s; and WHEREAS, tl1c City of En glewood has received annual sharebacf· funds generated by the tax si nce 2004 ; and; WHEREAS , in 2005. the Cour.ty set aside a portion of the tax revenue s to fund competit ive grant projects ; and WHEREAS. the City of Englewood ts eligible to apply for up to two grants per year and since 2005 Englewood has rece ived eleven grant s totaling S 1,907, IQ0 ; and Wl-lER.EAS, 11 -:o,mcil of theCityofEnglewood approved Resolution No . 42 , Senes of2012 support ·ai'ahoe County Open Space Grant application fo, the Playground Renovation at the ~o,u,west Greenbelt : and WHEREAS , the City of Engl ewoorl has heen a warned an Open Space Gram of $156,600 for the Playground Renovation at Northwest Greenbelt; and WHEREAS th e total project costs are estimated at S2i0,300. which will be paid by this grant award and $113,700 budgeted from shareback fonds in th e Ci ty 's 20 12 Open Spa,:e Fund ; and WHEREAS, there ere no federal funds being used for the renovatio n oftJ1e playground at Northwest Greenbelt ; and WHEREAS, the pa ssage of this Ord ina nce authorizes 1ltc acceptance of th e Arapahoe Coun!y 20 "'Open Space Grant ;md the ln '.t:rgovcrnmcnta l Gran• greemeJ1t bciwten Arapaho e County Com . 1issio ner s amt the City of En glewood for the Pl ayg.rotind Renovation at Northwesl Grct·ribeh . Grante e agrees to erect and permanently maintain at le as t on e sign in a p11blicly visibl e area in re.c:oenition of tlu : grant from the Arnpnh oc Co u!1ty Open Spnce Program. The location , fonn, design , and wording of such sil,'11 shall be approved by the County. Such sign shall be en:clcd pri or tu lhe completion of the Gran! Project or it s public opening, which ever is earlier. 9. Report Requirements . On or before ,lanuary 31, 2013 the Grantee B!a,'l'Ces w provide the Co unty with an init ial Grant Project status report that describes :he amount of progress in completing the Grant Proj~-ct, Gra~t Project mile stones, anci the use of the Grant l"unds lo d-1tc . Upon completion of lhe Grant Proj ect, the Grantee also agrees to submit ,o tnc County a final report, including a cover letter and a final spreadsheet comparing the originul budget to actual expenses that certifies what 1he Grnnt Funds have been used for and that the Grant Funds have been used in accordance with the Open Space Resolution. The final report shall als o includ~ a detailed project summary along with high rosolulion photograph s uf the various stages of the Grnnt Project deve lopment and its completion. The Grantee further agrees to provide the County with an electronic copy of the fmal report, including separate high reso lut ion dib~tal photographs. 11,e final rep o,• shall be submiucd within three (3 ) months of project completion unless a longe r period of time has been agreed to by the County in writing. The County shall he allowed to use information and photographs from reports in publica1ions, public inform ation updat es , and on the County's web site . 10 . Fa ilure to Submit Required Re-pons . Up · n wriiten nm ic c from the Co unty 's Open Space Grants Admin istrator, infonr.mg ,he Gra ntee that it has fai led to submit any requ ired status report and /or final report, the Grantee shall submit such rep orts to the Coun ty through the Coun:y's Open Space Grants Admin istrat or with in thirt y (30) days, and, if il fai ls to do so, the Grantee shail be deemed to be in violation this Agreement. The Grantee shall be ineli gible for any future Grant Funds . until and unle ss such reports have been submilled to the County . 11 . Re::ord Keeping Requirements . The .Grantee shall maintain a complete set of books and records documenting its use of the Grant Funds and its supervision and administra '.ion of the Grant Proj ect. The County or any of its .duly authorized repre sen tatives shall have re asonable access to any books, documer,ts , papers , and rec.o rd s o f the Gra ntee whi ch are pertinent to the Grant Pr oiect for the purpose of mak in g an audit , examination, or excerpts . The Gr antee shall keep all book s, documents , papers, and reco rd s, which are pertinent to the grant Project, for a minimum ot three years. Grantee agrees .to report to the Coun:y .any unexpended Grant Fund s and co nsult with .the County co ncerning prope r accounting fo r uncxpenden Grant Funds prior to c_o_mfl~ti_on of the Grant Project final report . . 12.· . · Re imburscmcnt ,qf Grant Funds ,. The Grantee further agree; if such sale, lease, trade or conveyance is made or an exclusive license or interest ha.; been given , the proceeds shall be ,deposited in an open space fund to be used for purposes co nsist ent with -th e 0pen Space Re so luti on. 17. l).se Restrict ions 0 11 Acquired Land s. Jnconioration of Exhib its . Unless otherwise stated in this Agreement, a~y exh ibits, appli cat ions, -resolut ions, or other documents refereqced in this Agreement shall be ·incorporated by reference into this Agreement for · all purposes . 29. Section Headings . The headings for any section of thi s Agreement are only for the conv enience and reference of the Parties and are not intended in any way to define, limi t or des cribe the scope or intent o f this Agreement. 30 . Disbur~!,.IJ)!m,t of Grant Funds . For land acquisition projects, the Grant Funds arc to be made available to the Grantee by the County at th e time of real estate cl osi ng , subject to the provi sion. of Section 17 . For all other types c>fprojects, the Grant Funds shall be tran sferred soon after the execution of this Aer eem ent.
