WHEREAS, the City Council of the City of Englewood , Colorado approved sewer rate · s ,hrouglt 2011 with the passage or Ordinance No . 2 1, Sen es of2U0 ~; and "" .. 2REAS , there arc continuing increases in the crnm: of operati on and maimenance fur the collection system and the wastewater treatment pl ant ; and \VHEREAS, the proposed sewer rate increases will provide adequate funds to operalc and maintain the Bi ~C ity Plant as well as the Englewood sewer c ollection system nnd ;tllow complelion of several capital projects at the Bi-C ity Plant; and WHEREAS , the Water and Sewer Beard recommended the proposed increases to fees and charges al their October 9, 2012 meeting. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TIIE CITY OF ENGLEWOOD _. COLORADO, AS FOLLOWS : Section I. The City Council of the City of Englewood , Colorado hereby authorizes amending Title 12, Chapter 2, Section 3, Subsection B, Paragraph 9, of the Englewood Municipal Code 2000, to read as foll ows. If tlie concentration of these pollutants is less than that of Normal Domestic Strength Waste , the User ,hall no! receive a surcharge nor given a cr-di1 to the 1otnl surcharge . 3. Paymcnl rates shall be computed for !CR cuslomers based on the following basic capital costs of the Bi-City plant : Q (Volume): ~ $~ per 1,000 gallon day of capacity BOD: ~ ~ per pound day of capacity SS: ~~per pound day of capa city 4. Specific individual rates will be c.1lculatcd based on the voiume strength and rate of Oow in accordance with current Federal guidelines. Adjustments 10 individual rates will be made annually or more frequently, whenever evidence is received that a major change in wastewater volume and/or charae1cris1ics has occurred . Payment will commence within o~c (I) year of the date of inilialion of service through the Bi-Cily plant. Sec1ion 3. Safety Clauses . The Ci1y Council hereby finds, determines, and declares thal this Ordinance is promulgated under lhe general police power of the Cily of Englewood, !hat ii is promulgated for tho health, safety , and welfare of the public , and that 1his Ordinance is necessary for the preservation of health and safety and for 1he protection of publi c convenience and welfare . BACKGROUND, ANALYS IS, AND ALTERNATIVES IDENTIFIED The results oi numerous cash Oows for the Sewer Utility we re presented to the Water and Sewer Board at their meet ing of Aucust 14. 20 12 . Th e res ult, shnw Pci w1rin11s combinations of revenue increases that would mainta in an adequate balance and adequate bond coverage until the end uf 2015. The proposed increases ranged from 0%1010%. After consi dering the informat io n presented, the Water and Sewer Board reco mmended that Counci l consider incrcJ5cs of '1 % in 2013, 4C?1 0 ir1 2014 .1nd 40/c, in 2015 . The Board also rt!«.:ornmended borrowin3 ~\000,000 in 20 13 because interest rates are so low di thi s time. This combi11 2tion oi rate incre,1ses Jnd borrowing will cov er the cosH of oper1,11on and ma int enan ce, as well as a111i cipt1ted capital i111provemen1s ill th e Bi -City \1\las rt!water Plant through 2015.
