Logic would tell me that since you are reviewing a proposal that asks for a change in zoning on the property, you would only do this if it would result in something that is better for the city of cnglewood and the immediate neighborhood than what the current zoning allows . I didn't see any mention of this in the staff memo, so I looked at the city's regulations on-line as best I could, and lo and behold, it appears that the city's regulations match what simpl e logic would suggest: That is, the regulations say that the city can only recommend approval of this propnsal if it finds that, "the proposed developmcm will exceed the development quality standards, levels of public amenities, or levels of design innovation otherwise applicable under this Title, and would not be pos sible or practicable under a standard zone disbct". I got this from Section 16-?-7H(?.) oflhe city's code . In this section , it says that the only other way you can recommend approval is if you find "That the property cannot be developed, or that no reasonable economic use of the property can be achieved, under the existing zonmg" etc, but that certainly wouldn't be the case here , since the applicant (Banburry LLC) doesn't even own the property & hasn't done the analysis of what they could do under the current 1.0ning. They are just proposing something that they think will be good for Englewood, and make them a profit--a perfectly reasonable thing to do . If I am correct, the basis of your decision is whether this proposal would be better than a project that would be designed under me existing zomng. I am no expert, but just trying to understand all of this, hore·s what I sec: This proposal would allow for almost twice the amount of development that is allowed under the current regulations, wit 11 sig,nificantly lower qualiry--not even dose to meeting the legally required criteria. Just as an example : The proposal is for more than twice the density allowed uncler the {)l)C (current regulations)-· the y are proposing 310 units. where 156 un its would be allowed under current zoning--and the y are proposing to reduce some of the standards rather than exceed them . For example, page 7 of the staff memo says the UDC requires 25% landscaping of which 75% has to be live and the Banburry PUD proposes : Wo landscaping with 50% of it being living. Further , and thfr one is very confusing to me, since the p.-oposed project would take away a park and the city has said that they don't have money for more parks : they request to pay only $57,780 in park land dedication fees where the regulations require $20 ,000 per acre, or S 134,800 (and the staff memo suy s 111:11 "council has prelir.iinarily agreed ... " to this??). Whm is the justification for this reduction in parklnnd dedication fee reduction, especially since the development will be removing whnt today is de-facto parkland for the neighborhood , and will add about 600 people or more 10 the area, which will 111os1 certuinly put a s1ruin on existing parks?
