PREVIOUS PLANNING COMMISSION ACTION The Planning and Zoning Commission consil1er,:,d the proposed Aila Cherry Hill s Major Subdivi5ion ut the Public Hearing conducted on Septemher 18, W l 2. The Commission considered testimony and voted 7-1 to forward the Alta Cherry Hills Major Subdivision to City Council w ith a favorable recommendation for adoption. RECOMMENDED ACTION . Staff recommends adoption of a proposed bill for an ordinance approving the Alta Cherry Hills Major Subdi vi sion and setting November 19, 2012 as the date for Public Hearing to consider public testimo~y on the Major Subdivis io n. BACKGROUND 'The former Flood Middle School site is a property consisting of two parcels totaling 4.56 acres located at the northeast corner of South Broadway and Kenyon Avenue. In 2006, Englewood Public School District mad e the decis ion to consolidate two middle schools and close th e Flo od Middle School site . In 2006, Eng:ewood Public School District m~de the deci;ion to consolidate two middle schools and close the Flood Middle School site. The school then dose-~ in 2007. Subsequently. the district issued a request for proposals 10 redevelop the Flood Middle School !lroperty. In 2011, Barbury Holdings, LLC. came forward with a proposal to purchase the property consisting of two parcels totaling 4.56 acres. 13arbury Holdings development proposal 'ncludcd a maximum of 350 residential apartment units contained within two buildings. The property's existing .w11i11g desigr.a tion would not accommodate the proposed development; therefore, Barbury Holdings began the process of requesting a reL011ing to a l'UD. A preliminary subdivision plat, based on the PUD, was also submitted. NEIGHBORHOOD MEETING SUMMARY: Pursuant to the PU D procedure, the applicant conducted a neighborhood meeting on May 16, 20 12, prior lo submitting the appliot,on for ~ PUD rezoning on June 4, 2012 . Notice of the pre-application meeting was mailed 11;. property owners ; 1d occupants of property within 1000 feet of the site. Parking: The proposed Flood Middle School PUD will follow the parking regulations outlined in 16-6-4 of lhe Unified Development Code (UDC). These requirements arc 1.5 spaces for each studio, 1 bedroom, or 2 bedroom unit; and 2 spaces for each 3 bedroom unit; plus 1 suest space for every 5 units. With the cur:enl unit mix, thi, would amount lo approximately 604 required parking spaces. The majority 'lf these spaces would bl! irr the parking structure wrapped by the apartment building. Bicycle parking will be required at a rate of one bicycle space for every two units . Traffic A traffic impact study was performed for the proposed Flood Middle School PUD. I he traffic study shows an increase in overnll traffic volume; however, the development can be accommodated by the existing study area roadways and intersections without mocification and without creating significant impacts to the study area through 2030. The lruffic impact study was reviewed by the Public Works Traffic Division and COOT who both concu·:·ed with its iindings. Signagc: The propc:·sed PUD will follow the signage regulations outlined in 16-6-13 of the UDC as amended except that the PUD would permit the maximum height a projecting sign to be 50 feet high rather than the UDC's maximum height limit of 25 feet. 6 Landscaping: The UDC requ ires that a minimum of 2 5% of the properly be landscaren for multi-unit dwellings in the R-2-B and MU-R-3-B zone districts and 20% in the MU-B-1 zone district. The Flood Middle School PUD proposes a minimum of 15% of the proper'.)' be landscaped. Additionally, the UDC requires that a minimum of 70% of the required landscape be "living" landscape. The Flood Middle School PUD proposes that a minimum of 50% of the landscape be "living". This is due in part to the urban nature of the project that may include sc1 t:cialty paving, plazas, w ater feat~res, etc. as "non-living" landscape. The PUD will meet the requirements of the UDC in terms of plant q~antities and sizes; additionally, 50% of the required trees must be located between the building and street which will result in street trees for the project. Screening and Fencing: The PUD proposes an 8 foot high fence/wall between the apartment building and existing residential uses at the northern boundary of Parcel 02 . The fence/wall must be con sistent with the overall building design. All other screening or fencing must comply with the requirements of the UDC. Drainage: The proposed Drainage Plan and Pr elimin ary Drainage Reporl were reviewed and approved by the City's Public Works Department. We moved here beca use we were ve ry impress ed with what Englewood lia s done with the Civic Cenkr area. we lik e heing a "fir st ring suburb .. close lo downtown Denver, and wc fell in love with our hi storic 1930, ho use and o ur neighborh ood. My husband & I rid e our bikes to the train stati on to get to ou r jobs, we shop fir st and foremost at Englewood ;hops and we take our friends lo all the local re staurant s. We hav e wonderful neighbors , have invested a lot lo pres erve and enhance th e 1:haracter of our modest home, and are champions to our friend s in the region o f just all that the city of Engkwouu has lU offer. The Mary-Flood rezoning pro posal will have a profo und impact on our neighborhood and on the city of Englewood in general. I have not had an opportunity to review the plans for th e si te, as it requires going to U1 e ci ty offices, whic h are clo sed when I gel off work. [ did att end a neighborhood meeting, but it wasn't the one required hy th e city 's regulations . For some reason , I d id not receive noti c.e of th at meeting, th ough I live withm tile di stance I bel ie ve is lega ll y req uired to rece ive noti ce. Instead I got a ll ye r Ii-om a neighbor who ho sted ano ther meetin g that I th ough t was very informative. Alier that meeting, I looked ~t the city websi te and reviewed th e staff memo to try to find out as mu ch as 1 cou ld . Aft er wa king up to th e liter that th e lovely sc hool -site and Mary Flood neighb or hoo d park cou ld be co mplet ely dem olish ed and trnnsfonned into an apartment co mpl ex with nG public access. the biggest question I was left with was--how does th e city decid e th ese kinds of questions? What is the justification for this redu ction in parkland dedi cat ion fee reduction , especially since the development w ill he remnving what lor1My is clc-faclo parkland for the nrighborhonr1 , sncl will add about 600 peopk or mocr to the area, which will mv:1 r enainl y put a strain on existing parks? Since the City Council repn,s,:nts the larger communitv interests of Englewood, I do hope thot you will J\OT approve this change unless and until th e upplicont shows how th eir proposul benefits our community. As I sec it , it prov ides them more units and p,esumably more profit, but signifi cantly LESS in the way of "devdup111cnt yuality standards, levels o f public 2.111cnitics, 01 kvcb uf design innuvatiun" as required in the city regulations. Th ere arc other mod els in 1he Denver/ Metro region of rc-dcvciuped sd1001/ park s 'tcs that have become amenities to th eir surrn11ndi :1g neighborhoods . It appears that the apanmcnt-complcx proposal is no t one such example, so I urge you lo deny ll11s rezoning.
