WHEREAS, Sect ion IB, 3(n)(6)(i), of the Municipal Separate Storm Sew .r Sys tems (M S4)

WHEREAS, the exa ct language used to idt111ify the firefighting discharge m the Englewood
Municipal Code must be provided with the required submillal; and
WHEREAS, the passage of this Ordinance authorizes amending the Section 12-5-9 , entitled
"Prohibited Discharges" of the Englewood Municipal Code , 10 reflect stcnn water discharge wocld
he a result of"emergency fire fi ghting"; and
WHEREAS, the Water and Sewer Board recommended the appro val of thi s amendment
:egarding firefighting discharges 10 reflect "emergency fireligh :ing" to allow comp liance with the
Colorado Dcp,.nmcnt ofl-lca:th's MS 4 Permit at their November 13, 2012 meeting .
'IOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, CC,l.ORADO. AS FOLLOWS :
Section I . TI1e City Council of the City of Englewood, Colorado hereb y authorizes amending
Title 12 Chapter 5, Section 9, ot" the Englewood Municipal Code 2000 , en titled Prohibited
Discharges to read as follows :

D. Any person who violates any provision of this section shall b~ subject 10 a civil penalty of
not more that nine hundred ninety-nine dollars ($999.00) per day during which such violation
occurs or continues, or, upon conviction, a criminal penalty punisl:nblc by a fine of 11ot more
that nine hundred ninety-nine dollars ($999 .00) per day during wh:ch such violation occurs
ur cu 1n iuucs or by imprisonment for not more than three (3) montb or by hoth .

Ordinance is promulgated under the general police power of the City of Englewood, that it is
pwmulgated for the health, safety, and welfare ,,r ,he public , and that this Ordinance is necessary
for the preseivaticn of health and safety and for the protection of public convenience and
wo'farc. The City Council farther detemnines that the Ordmance bears a rational relation to the
pr~per legislative object sought to be obtained.
Sectjon 3. ~verability. If any clause, sentence, paragraph, or pan of th is Ordinance or the
applica:ion tilereofto any person or circumstances shall for any reasor, be adjudged by a cour1 of
competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the rem:iinder
of this Ordinance or it application to other persons or circumstances.
Sec1ion 4. Inconsistent Ordinances . /\II other Ordinances or po rti ons thereof inconsistent or
ccmili r.t ing wi1h 1his Ordinance or any ponicm l1t~reof ~re hereby repealed 10 the exten t of such
inconsi:.tcncy or conflict.
Secti,m 5. Effect of repeal or modification . The repeal or modification of any provision of
the Code of the City of Englewood by this Ordinance shall not release, extinguish, alter, modify,
or change in whole or in part any pena lty, forfeiture, or liabili1,.'i either civil or criminal, which
shall have hccn incurred W1Jcr such provision, a.nd each provisnn shri.it ½e trentcd and held as
still ret:iaining in force for the purposes of sustaining any and all p1oper a,,tions, suits,
proceedings , and prosecutions for the cnforcc::1.ucut oflhe penalty, forfoitu1e, vr liability , as well
as for the purpose of sustaining any judgment, decree, or order which cai: ~r may be rendered,
entered, or made m such actions, suits, proceedings, or prosecutions.
Secuon 6. Penalty. The l'enalty Provision of Section 1-4-1 EMC shall apply to each and
every violation of this Ordinance .

The Water and Sewer Board, at th eir November 13, 2012 meeting, re comme,,deC: Council approval of the

firefigh1ing disc harges to reflect "emer~ency fir elighting," to all ow compliance with the Co!o r,1 d o
Department of Health's MS4 Permit
BACKGROUND , ANI\LYSIS, AND ALTERNATIVES IDENTIFIED
Section I-B-3 (a) (6) (i ) of the Municipal SeparatP Storm Sew er Systems (MS4) Per,nit allows discharges from
emergency firefighting aclivities to be excluded from the prohibitions against non-stormwater d ischarges.
rhe Englewood Municipal Code t 2-5·9 does not have the word "emergency " induu~d with firefighting
discharges . If not limited to "emergency firefi11hting" the definition of "fi refighting" may include
m ai ntenance of fire suppression systems and training, which may be a significant source of pollutant to the
MS4 .
Englewood Utilities submitted a self-audit r~port to the Colorado Department of Public Health and
Environment (CDPHE) in acco rdance with Part 11-A-B on the M54 Permit on October 1 5, 201 2 tn refl ect
that Englewood Utilities is progressing to be in compliance.
Being that thP exart language used to identify the firefighting discharg e in the Englewood Municipal code
must be provided with the required submittal, it would be prudent to amend the Englewood Municipal
Code 12 ·5·9 -Prohibited Discharge• tu , e0eei stormwater discharge would be a resu lt of "emergency
fircfighling. •
