AND
THE CJTY OF ENGLEWOOD
NHEREAS, Article 18 . HOLIDAYS of the Co llective Bargain:.ng A1,,r cem ent (CBA)
between U,e En g lew ood Firelighters Local 1736 (Local 17 36) and th e C ity of E nglewood (C11y)
provid es fo r. am o ng oU,cr things. compen sation for accru ed but unused ho liday time off; imd ;
WHEREAS , there r.as been confus io n in th e tran sition from th e 2009-20 1 I CDA to th e
20 I 2-2013 CBA; and
WHEREAS. th e parties w.i sh to amend certain provi sions o f Article 18 .
NOW , TfilREFORE, the City nnd 1"ocnl 1736 enter into this Memorandum o f
Understanding (MO U) and hereby agre e as fo ll ow s:
I. In Article I 8 for the duration of tJ1e 2012 -2013 collective bargainin·g agreement
Secti o n A.(2) and (4) shall be ch anged 10 read as follow s:
(2 ) For an y employee wh o has not used th e ninety-six (9 6) h o urs o f holiday
lime off by the en d of Decembe r o f each year, th e hours will be converted 1 : 1 to
the employee's com pensatory time bank. ConYersior, will occur in th e n ex t pay
period fo llowing the pay peri od that in clud es December 3 1 .
(4) Holi day hours fo r terminating an d new hire Gmpl oyees will be determined
on a monthly pro ra la basis . (Ex ample: if ao em pl oyee re'.ircs on Jun e 30, the
employ~e is eligibl,: on a mont hly pro rata basis fo r six (6) mo nths or one-h al f
(1/2) oflhe nin ety-six (96) hours h o liday b enefit.)
2. Because collective bargaining agreements are effecti ve from January 1 through
Decemb er 3 1, and the gran ting and use of holid ay hours mos .from November I through
0 tober 3 1, th ere has been confus ion durin g th e transiti on from the 200 9-201 1 CBA to
th e 20 12 -20 13 CBA, th e parties al so agree th at:
(a) Each shift work employee covcrcc by lbe Agreement wi ll be credited with a
prorated I) .3 hou rs of holi day leave (80 hours/12 months X 2 months (November and
