HomeMy WebLinkAbout2012 Resolution No. 072R.ESOLI.Jl1ON NO.~ SERIES OF 2012 A RESOLUTION AUTHORIZING THE PROVISIONS or THE COLLECTIVE BARGAINING CONTRACT BE1WEEN THE ENGLEWOOD POLICE BENEFIT ASSOCIATION AND THE CITY OF ENGLEWOOD FOR THE YEARS 2013 • 2014 . \VHEREAS, the Englewood City Council authorized "The Collective Bargaining Contract Between the Englewood Police Benefit Association and the City of Englewood for the Years 2011-29112 ; by tile passage of Resolution Nu . 39, Series of2010; unJ WHEREAS, the City of Englewood and the Englewood Police Benefit Association entered into negotiations in April of 2012 in accordance with the Englewood City Home Rule Charter; and WHEREAS, the members of the Englewood Police Benefit Ass!':iJtion duly ratified , by a majority vole , the Collective Bargaining Agreement for the years 2013 and 2014; and \VHEREAS, the significant changes 10 the contract are : I. Anicle 9 -Compensation : Employees covered by the Contract will receive a market adjustment to their 2012 base wage rate effective January I, 20 I 3 and to their 2013 base wage rate effect;ve January I, 2014 . The adjustments 11ill be based upon the salary surveys conducted by Human Reso1.ccos in October 2012 and 2013. 2. Anicle lO -Meri!.fID': Merit pay bas been eliminated. 3. Article 16 -~: The pro,ision gua:anteeing EPBA members ten hours of holiday leave cash out annually was eliminated . 4. Article ! 9 -Personal Leave : The cash out of unused personal leave has been eliminated. Unused personal leave will instead be rolled over into employees' annual leave banks. 5. Article 24 . l:'ension/Retjrgnent Plans : l:ly January I, 2013, City Council will approve a non-binding resolut ion granting current police officers the ability to choose entry into the Fire and Police Pension Association of Colorado . Contributions will remain the same for current officers (10% employcc/10% City), but new officers will contribute 8% and the City will contribute 8% of their base wage. Worl<Week A work -.r.k i.; a regular recurring period of I 68 bours in the form of seven consecutive 24-hour periods . The workweek need not be the same as the calendar week. 1be workweek may begin on any day of rbe week and any hour of tbe day and need not be the same for all employees . B. Work Schedule 1. ]he work schedule for officer.;, incluciing roll call and meal periods, shall consist of five (5) eieJ,t (8) hour work da)'s; four (4) ten (10) bour work days; or other work schedule as determined by the Poli:e Ouef. 2. Any change in an officer's bid or assigned schedule (starting time, quiuiog time, scheduled days off) will be made in accordance with paragraph C except schedule ch:i.ni;es may be m:ide without notice if the affected officer agrees. The Gty agrees to review with Association representatives issues and concerns regarding the method and possible compensation associated with schedule changes. C. Chapging Work Schedules The work schedule may be changed by the Poli.:e Chief provided a minimum five (5) days advance notice is given. Work schedules may be changed without advance notice in the case of emergencies as determined by the Police Oiief. When an employee's work schedule is .:lunged for pwposes of traini.og, special instruction, ""'·• the supon~or shall wake a n:asouable offon to accommodate the employee's intcrem concerning the scheduled change. D. Sraffjng The need for an •?propriatc level of ,staffing is recognized by the City for the purpose of efficiency and safety. The Police Department will address this issue in Depanmeot policy. E. Meal Periods Officers shall be granted a paid meal period of tbiny (30) minutes for each eight (8) hour work shift. Employees working a ten (10) hour work shift shall be allowed a paid forcy-five (45) minute meal ~riod. An employee may conduct personal business during the meal period. The bidding process will begin with the most senior Police Officer bidding the posi:ions of their choice. Io the desc:nding order of seniority, each n:maining Police Officer will have choice of the remaining biddable positions. All spec.iafu:ed positions such as crime pn:vcotion officer, traffic officer, etc. will not be open to bid. The specializ.ed assignments :ilong with any no-bid positions on a v,,atch, will be in addition 10 the biddable position Ou each v,,atch.. Officers may request non-biddable po~irions :md ao attempt will be made to accommodate them, but such positions will be assigned at the cliscn:tion of the division commander. If an employee fails to submit a bid in accordance with the bidding procedwe, the employee will relinquish the opportunity to bid by seniority, and will be assigned at the discretion of th: Patrol Operations Division commander. F. An employee in auot:her assignment, who is =ssigned to the Patrol Operations Division wiD occupy th e position -vacated by the employee they an: repl:icing. If other positions are available, the employee may request assignmem t0 such positions, but may only be assigned at the cliscreuon of the Patrol Operations Division commander. The officer will then be allowed to bid at th:: next bic process . The contract covers approxi mately 54 employees. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Cit)• of Englewood and the Englewood Police Ben efit Association entered into negotiations in April of 2012 in accordance with the City of Englewood Charter. The members of the Englewood Police Benefit Association d••'y ratified, th rough their elected representatives, the Cvllective Barg.aining Agreement. Significant changes to the contract include the following: 1. Article 9, ~.i!.1!2!]: Emplo'(ees covered by the Contract will receive J market Jdjustment to thfr 2012 base wage rate effective January 1, 2013. and to their ~01 ~ bas e wage rate . e ffective January 1, 2014. The adjustments will be based upon the salary surveys conducted by Human Resources in O ctober of 2012 and 20 13 . 2. Artide 10, ~y; Merit pay has been eliminated. 3.
