HomeMy WebLinkAbout2012 Resolution No. 075RESOLUTION NO . 22 SERlES OF 20 I 2 A RESOLUTION ADOPTING PARK TRAILS AND OPEN SPACE LAND DEDICATION FEE IN LIEU POLICY FOR THE r.1TY OF F.NGLEWOOD, COLORADO . \Vl 1.EREAS, th e subdi vi:;ion regulat ions of the Unified Developmenl Cndr required(~cliratinn of land or payment of the fai r market va lu e of such land as a fee in lieu of the de dication for all developmcut s sub_1a:1 to t.h c subdi vision regulations : nnd WHEREAS, some le vel of fee has bee11 <le tennim:J tu ue appropriate because the impac:s of new resident s on park., an<l recreation facilit ies are real and can be subst ant ial: and WHEREAS , the Englew ood Municipal Code provide s a :nethod for detennining the amount of land to be dedicated; and WHEREAS , the fee in lieu mu st be based on the fai r marke t va lue oftl1e land othe;wise rc:q11i.rt"..tl ; ;mrl WHEREAS, both tl1e Pla.,nins and Zoning and Porh and Recreation Commissions reviewed the requirements and felt it was important for projects to address their impacts to parks trails and open spacc:1 but fell the current requirements were prohibitive to new developments and <lid not accurat:ly reflect the actual cost of pro vi ding those services; and WHEREAS , the Parks and Recre atio n Commission recommended using a value of $60,000 per acre to calculate the fee Ill lieu amount and to amend the Unified Development Cede (UDC) to redu ce the dedication standard to 5 .0 acres/1,000 populat!on; and WHEREAS , the Planning and Zoning Commission reco mmended charging a fee of $0.25 per sq uare foot of building area for each new residential and nos-residential development subject to the subdivi sion regulations ; NOW, THEREFORE , BE IT RESOLVED BY THE CITY CO\J'NCILOF THE Cnl' OF ENGLEWOOD, COLORADO, AS FOLLOWS : Section I. The City Council of the City of Englewood hereby authorizes adoption of a "Fee In Lie u of Parks , Trnils aud Open Spilc e Land Dedication Poli cy" pursuant to 16 -8-5 EMC, attoched hereto as Exhibit A. Cr edit toward meetin g the park and open space dedication req uirem en t will be co nsid ered for recreat ional amenities, buth ac ti ve and passive, o r open space provid ,:,d on-si te by thr rlpv elopment. The am ount of credit s1all be det erm ined by negotiations between City staff and the ap plicant, subiect to the foll owing guidelines : a. On-site rec reati onal ameniti es may include indoor and o utdoor facilities that are designed fo, active or pa ssi\'e rec re ational pursuits, such as sw imming pools, tenn is or volleyball co~rts, exercise rooms, picn ic are as and si 111ila1 fa r.ilitie~. b . On-site recreation?! amen '•ie i ma y include areas and facilities such as trails and shelte rs that ·sed to , ,eet landscape requ i rements that also p r-:,vi de opportunities for pa;sive or active recr eatiun. c. In orde r to be consi nf'red for crf'd it, the applicant must demonstrate that the o n-site facilities will remain in pla ce for a period o:' time equa l to the payba ck period . For th e purposes of this policy only, tne payback period is th e p eno d of time it takes for th e City 's annual property :ax revenue generated by the project to equa l the amount of fee credited . 3. Any developer or appli cant may request a waiver of all or part uf th e ,e1na ining fee - in-lieu after~ nf'dit is agreed upon . Waiver request s shall be considered on a cas e- by-c ase basis and shall be approv ed at the dis cretion of City Council with co nsid erat ion give n to the fo llowing ui terid . a.
