A RESOLUTION EST AB LISH IN G FEE SCHEDULES FOR THE CITY OF ENGLEWOOD
CONCRETE lfflLITY.
WHEREAS, the Cit y of Englew ood created the Concrete Utility and tl1 e Co ncrete Utility
Enterprise Fun d b y th e passage o f Ordinance No . 36, Seri e, of 1997; and
WHE REA S, tl1c passace o'Coun cil Bill No . 73, Serie s of 2008 amended ti,e "Us er Fee"
section of th e C:oncrete U11 :•y and Concrete Enterprise Fund establishing fees fo r lhe Concrete
Utilit y lo he set by Re solution ; and
WHEREAS , the Engl ewo od C11y Council approveJ the es tabl ishment of Concre te Fees for
2009 and 20 IO by the pa ss age of Re so luti on Nu . 79 . Series o f 2008; and
WHEREAS . the Eng lewo od City Co un ci l approved cancelin g the 2010 Conc rete Fee increase
for th e Concrete Utili t)' Program by the passage of Resoluti on No . 84 , Seri es of 20 09; and
\VHEREAS, p.:.nicipat ion in th, program is vohmt:iry hecau!-e prop erty own c:rs have the
option lo "o pt-out " of the Conc ret e Util ity and maintain th e conc ret e a.s requir ed by 11 -7-18 EMC
and approxima1cly 96% of the 11 ,~90 eligi ble propcnics in the City pa rticipate in the Coocrc1e
Utility Program ; and
WHEREAS, the Conc ret e Utility requires year round administration (bill ing s, propcny
real igruneots, co ncrete invern ory, trackin g new conc rete ins tal la 1ion.s, phone response, opt -in and
opt-out reque sts, titl e company responses, and delinquent accounts): and
WHEREAS, concrete prices , along wit h the costs to :1dmi.Jlister the Program ha\'e es calated
sin ce 2009. thi s rate increas e will allow the Concrete Utilit)' to better address sub-standard
concrete infrastructure ; 2nd

RECOMMENDED ACTION
Staff recommends Council approval of a Resolu tion establishing fees for the C~nc tete Utility.
BACKGROUND , ANALYSIS, AND ALTERNATIVES IDENTIFIED
Property owners in tht' C il y of Engl~wood are req uired to maintain concre te adjacen t to thei r pro p erty. Th e
Concie te Utility was adopted in 1997 to creat e a funding mechani sm to assist ow ners with th eir
res pon sib ility in the repar r of th e Llty 's aging concr~te infrastructure . Par ti cipati on in tht! µro1,1~.11 is
vo lun tary, as ownetS have the opti on to "op t-out " of the Concrete Utility and main tain the conetete as
req ui red by Municipal Code Sec tion 11 -7-18. Approximately 96% or the 11 ,290 eligible p ropertie s in the
,ity p?.rti cipate. The City participates in th e costs for i nt ersec tion corn ets, alley en tr ances, drainage cross
pan s, conc rete paveme nt and alleys, and City owned propertie s; additionall y, the City pays 70% of the
avenue costs .
The Concrete Util ity req uires year round adrrnni strati on (billing ~. property realign m ents , concre te inv entory,
tra cki ng new conc rete installations, phone respo nse, op t-in and opt-out req uei.ts, titl e co mpan}1 responses ,
and deli nquent a ccounts). AJdit io nall y, adminis tr ation of th e annual cons t1uLl iu11 p1ojec 1 ior th e C oncrete
Utili ty takes approxima tely eight months ftom start to iinish (11 .it1 al rat ings or conc I ete with pic tures,
con trac t quantity de termination, bidding, construction ad mi nirna t1on, 1nspe:1 Ions, contra ct close ou~ an d
cit izen res ponse during const ru ction). Thr ee City em ployees, working for th e Co ncrete Utili ty, handle th e
majority of th ese du ties . The City 's concre te inft.istructure co nsists of 7,3 15,000 sqcue fe et of concrete
worth an est ima ted cost of $54,000.000.
