REC OMMEN DED ACTI ON Staff recommends Council adopt a bill for an ordinance approving Case No. 09SA 133 Common Interest Agreement BACKGR OUND, ANALYS IS, AND ALTE RN ATIVES ID ENTIFIED In 2002, the Farmers Reservoir and Irrigation Company (FRICO), th e Burlington Ditch Res ervoir and land Company (Burlington), the Henrylyn Irrigation Dls tric~ the United Water and Sanitation District ~nc East Cherry Creek Water and Sanitation District (applicants) filed applications to change ,: ,e water rig.~~ whic h di ve rt at the Burlington Canal headga te. Th ese ri ghts also fill several reservoirs as well as diverting wa ter for imm ediate use during the irrigati on season. The water rights in question hav e a history of over-di versions, whic h injure Englewnod's rights . In subsequ en t cases and ru lings th e Water Court has seve rely C\Jl °'ck th e water rights of th e ap pl ica nts, to Englewood's benefi~ and a series of ap peals have resu lt ed. One of th e Water Court rulings is being disp ut ed by Englewoo,i, Denver and the appli cants. TI1e ruling prevented th e ap pli ca nts from pump ing effl uent from Metro Sewer into the Burlington Ca nal, ca usi ng downstream reservoirs to fill slow er, and th erefore affecting Englewood's Mclellan rights . Th e pu n-.pl ng from Metro Sewer, whi ch has been used sin ce 1968, benefits Englewood . Englewood, Denv er and the oth er applicants are jointly ap pealing the rulin g. Englewood will co ntes t sepa rately other rulings which cut back its rights. The Case No. 09SA 133 Common Int eres t Agre emen t will enab le Englewood's legal counse l to share strategies with Denver and th ~ other applicants con ern lng the appea l of th e M etro Pum:, ru ling. Th e agreement grar,ts permission for th e parti es to work together for thi s spec ifi c litigati on to exchange information and share costs and strat egy.
