Thrift store s typically accept .d2n.i!lil2fil of goods that are then resold . In order for those donated items to receive tax deductions for their donations, the organization to which the item s are donated needs to be a non -p rofit charitable organization. With the oth er types of stores, those bringing goods that are th en resold are llilisl for thos e goods . 2. Please provide information and the names of the nine metro municipalities zoning regulations referenced in the Council Communication from May 17. Attached is a memorandum with a chart showing th e municipalities surveyed and whether th ey have sepa rate definition s and designated zone districts for the various retail estab lishm ents se lling used goods. 3. On Novemb er 16, 2010, City Council app roved an amendment to the Ameresco agreemen t fo r the in ves tigati on, design and development of PV systems. During the Study Session of March 8, 2010, Holly Green , Am eresco Senior Account Executive , prese nted informuti on on th e PV sys tem and ou tlined the terms of th e Power Purchase Agreement. Ameresco would be eligible for rebate s from Xcel En ergy and tax credits that apply to a private corporati on but not a public (tax exempt) entity . If agreement on outstanding issues is reached and the timing is workable, the PPA will be presented fo, ';ity Council consideration at the June 21 regular Council meeting. Memo randum --------------------------- City Manager's Office TO: Mayor Woodward and Members of City Council THROUGH: Gary Sears, City Manager FROM : DATE: Michael Flaherty, Deputy City Manager June 3, 2010 SUBJECT: Energy Perfonnance Contract Update During the March 8, 20 10 City Co uncil Study Session, Holly Green, Senior Account Ex ecutive for Ameresco, the City's Energy Service Company (ESCO), presented findings and recommendations of the Technical Energy Audit of City facilities. By way of background , Am:resco completed the draft TEA in December. The findings and initial recommendations of the draft TEA were reviewed by staff and :ifk, consideration of several scenarios , City staff and Amere<,co staff developed an energy conservation and facility upgrade program that maximizes savings from energy conservation and balances those savings with much need improvements that are not possible to fund with existing re so urces. A brief summary of the find ings and recommendations are as fo ll ow~: • The TEA evaluated all City building, irrigation and pump ing sys tems and exterior lighting owned by the City. (Ameresco conducted a separate TEA for the Wastewater Treatment Plant.) • The TEA identified 21 Energy Conservation Measures (ECM) for further review and studied but did not include in their final recommendatio ns an additional 12 ECM, which were rejected due to lack of practical , technical or financial feasibility . • Of the 21 ECM initially identified, staff working with Ameresco selected 12 ECM for inclusion in the proposed program . These ECM maximize the City 's energy savings and provide for upgrade of facilities on a priority basi s. • Project cost is $1.4 million tl1at will be funded enti rely from energy savings ove r a 15 year tenn. • Xcel Energy reb ates will provide fo r program benefits of over $125,000 . • Ameresco, on behalf of the City, successfully applied for an allocation of S 1.3 milli on in Qualified Energy Perfonnance Bonds (QECB) from the GEO that will benefit the City's lease-purchase through savings of appt'lx imately $400,000 over the term . • Ameresco will provide annual measurement an1 verification to in sure continued energy savings. While we had hoped to preseut the contract documents to Council for approval in April , we have been delayed due to issues raised by the initi ation of a Colorado ballot initiative, Amendment 61 , that if passed would limit debt financing by State and local governments. However, our Finance Department and Ameres co has worked through thes e issues with legal staff and is now prepared to move forward with a favorable financing package .
