AN ORDINANCE AUTHORIZING AN INTERGOVERNMENTAL WASTEWATER
CONNECTOR'S AGREEMENT BETWEEN SOUTH ARAPAFOE SANITATION DISTRICT
AND THE CITY OF ENGLEWOOD, COLORADO.
W l{EREAS, !he Ci1y of Englewood O\<TIS and opera1es a sewage sys1cm, including a sewage
trealmcnl plant which is _jointly owned and operaled with the City of Lillleton known as the UE
Was1cwa1er Treatment Plant (WWTP); and
WHEREAS, the UE WWTP provides sani1ary sewer service lo districis outside of the
Englewood corporate boundaries through a s1andard connector's agreement; and
WHEREAS, the South Arapahoe Sanitation Distric1 Was1ewater desires to utilize the LIE
WWTP for treatment of the Distric1's sewage; and
WHEREAS, the S,>uth Arapahoe Sanitation Uistricl has 9,750 laps; and
WHEREAS, the LIE WWTP is situa1cd physically as to be able 10 receive and 1rea1 the sewage
from a dc~ignatcd arc.: ,r:rvcd by the South Arnp.ihoe Snmtmion D istrict and gathered by the
Dislrict' s sanitary sewa ;e sys1em; anJ
WHEREAS, South Arapahoe Sa 0 ;1a1ion Districl will continue to o"n the lines and will be
resporuible for capital improvements and maintenance in its system; and
WHEREAS , 1he Englewood W•ter and Sewer Board reviewed and recommended approval of
the South Arapahoe Sanitalion Wastewater ConneclOr 's Agreemenl a11be January 11 , 2011

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TIIE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:
Section l . The lntergovernmenlal Agreement belwe.en the Ci1y of Englewood and South
Arapahoe Sanitation District entitled "Wastewater Conneclor's Agreement" is hereby approved ;
a copy is ouached hereto as [xhibil I.
Section 2. Th~ Mayor is authorized to execute and City Clerk to a11es1 and $ea! 1he
Intergovernmental "Wastewater Connector ':; Agreement'', for and on behalf of the Englewood
City Council.

between the CITY OF ENGLEWOOD, COLORADO, a mllllicipal corporation, hereiJ .:-1\er

City Clerk, and the SOUTI{ ARAPAHOE SANrf A TION DISTRJCT, a quasi-municipal
corpor,tion nod subdivision of the State of Colorado, hereinafter called "District," octing by 11nd
through its authorized Representative .

WHEREAS, the City owns and operates a sewage system, including a sewage treatment plant
which is jointly owned and operat ed with the City of Littleton, so situated physically as to be
able to receive and treat the sewage from a desi;!l1aled w·ea served by the District and gathered by
the District's sanitary-sewape sysl<:.'l; nod
WHEREAS, it is the desire of the District to utilize the facilities owned by the City for the
treatment of sewage and the City is willing to serve th e District for treatment of sewage 1.mder
certain conditions;
NOW, THEREFORE, INCONSIDERATION of the promises and for other good and
vuluablc con,idcratiou hcrci.uaflcr set fo1th, it Ls mutually agreed by the parties as follows :
I . °The City hereby agrees under the conditions hereinafter set forth, to treat the sewage
originating from the District's sanitary sewer system within the area served by the
District as approved by the City and as indicated in the description attached hereto,
incorporated herein and marked as "Exhibit A."
The District sptcifo .. ,IJv agrees to prevent sewage from any area other than that
described herein, from b.:;,,g discharged into the District's sanilary sewage system
connected to U,e Cit) 's lnlnk line and to preveut connections to the system from or in
any area other than those described herein .
2. In the operation of the District 's sanitary sewer system, the District agrees that all
applicable Code provisions and rules and regulations of the City, including amendmcn :.,
thereto during the tellll of the contract, shall be the minimum stBndards for the District's
system. The District further agrees to abide by all applicable state and federal laws,
rules , re1111lations. or permits, including those of the Environmental Protection Agency
(the EPA) as they becorte effective or implemented or upon notice from the Cicy . The
Distric t sbaJl .infonnall users , contractors and subcontractors of such .standnrds, mies and
regulat io:is upon inquiry from such persons , and shall not furnish any information
incrncs istc:,t therewith . In this rcgord, it shall be the responsib ility of the Di strict to
obt ain the applicable requirements from the appropriate governing body . The City shall
attempt to maintain and provide inform:ition on all requirements to the District ; however,

discon nect the service of an y use r pursuant to appropria te law; or take other appropri ate
ac ti on in tbc event of:
