WHEREAS, City Council wished to review the required notification area for Planned Unit
Dcvelopmen:s (PlJDs) and th e time between the required pre-application neighborhood meeting
and the Englewood Planning and Zoning Commission public hearing; and
WHEREAS , the Englewood Planning and Zoning Commission reviewed the issues and made
recommendations which sho rt zn the notification date, clarify that the notice is to be sent lo the
owner o:record but keep the current 500 feet notification radius at their August 2, 20 11 meeting;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, CO LORADO, THAT :

The follow ing table summarizes the review and decis ion-making responsibilities of the entities
that have specific roles in the administration of the procedures set fu1U1 in this Chapter. for
purposes of thi; table, an "'(Approval) Lapsing Period" refers to the total time from the
app lication's approval that ar. applicant has to proceed with, and often complete , the approved
action . Failure tu Lake the required action with.in the specified 11 lnps ing period" will automatica ll y
void the approval. See Sec tion 16-2-3 .L EMC, "Lapse of Ap::,roval ," below .

I. Published Noti~•-Notice shall be by one publication on th e City's official website or in the
newspaper designated by City Cowicil as the City's official newspaper at lea st ten (10)

2. Posted Nouce . The propcny shall be advcnised by posti ng fur not less than Len ( I 0)
consecutive days prior to a bearing before the Co uncil , the Commission, or the Board ;
provided, however, th at where the case does not involve a specific property, no posted
notice: shall be required . A posted notice shall consist of a sign not less tha n twcnty.fwn

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
Council discussed current Unified Development Code (UDC) mailed notice requirements for
rezu11i11g applications (including PUD applications), major subdivisions, and telecommunication
conditio nal uses al the May 23, 201 1 study session. Coun ci l provided direction to staff to prepare
UDC amendments to increase the notification area to one thousand feet ( 1,000') ior ce rtain
required meetings and public hearings and to establish a ma xi mum time between a µr e-aµplica ti on
neighborhood meeting and a public hearine.
PREVIOUS PLANNING COMMISSION ACTION
The Plannin g and Zoning Commission conducted a public hearing on August 2, 2011, to consider
the proposed amendments to Title 16: Unified Development Code. No members of the public
Wt!re presenI to provi de testimony. following discussion the Commission voted 4 to 2 lo forward
to City Council amendments to mailed notice requirements (or re zonings, major subdivisions, and
telecommunication conditional uses as proposed but m ;;intai n the notification radius at five
hundred feet (SUO') as presented in the anached Bill for an Ordinance.
RECOMMENDED ACTION
Recommendation from the Community Development Department lo adopt a Bill for an Ordinance
authorizing amendments to Title 16: Unified Devt1lopment C0de rega rding requirements for mailed
public notices on First Read ing and to set September 19, 2011 as the date for Public Hearing to
consider tes Iimony 011 the propos"d amendments.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
This issue arose regarrling thP mail Pd public notice process for a recent rezoning application.
Concerns were expressed that the notification area did not extend far enough and that the time
between the required pre-appli ca tion neighborhood meeting and the Planning and Zoning
Commission public h~aring was too long.

the property owners, ii the area is uniformly divided into lots . However a numhPr nf
factors affect the number of properties within the notification area, thus affecting the
number of people actually notified. Factors include:
► The size and configuration of properties: Areas with small lots yield more
notices than areas with large properties .
► Public right-of-way: The more public right-of-way (streets and alleys) within the
area, the! fewer properties to be notified .
► Multiple versus individual properties : When a single entity owns mu lliple
properties within an area fewer people are notified .
Based on the above the Commission perceived no added benefit to the public hearinR
process from increa sing th e notification rad ius to one thousand feet (1 ,000') from the

Development staff often recommends to applicants that notices also be sent tv: building
m anagers requesting the notice be provided to tenants, all properties on a block when thP
notice area includes only part of the block, and occupants of ren tal properties. This is a
re:ommendation only an~ d cne at the applicant's discreti o n ; however many applicants
send lo more property owners than required by the UDC.
4 . Require a mailed notice for the Plann ing and Zoning Commission public hearing for all
rezonings .
This new requirement affects only rezoning applications. It would be in addition to mailed
notices for the required pre-applicatio n neighborhood meeting, meaning that property
owners would receive a nutice of the neighborhood meeting and the Planning and Zoning
Commission public hearing.
5. Require a ma<imum of 160 days between a req uired neighborhood me~ti11g aml tlie Planning
and Zoning Commission r,uhli~ hearing for all re zonings.
This new requirement affects only rezoning applications. It limits the time between the pre·
application neighborhood input meeting and the Plann ing and Zoning Commission public
hearing to 160 days . A shorter time period, fo r e,ample 90 days does nnt r,rnvirl e enough
time to:
Adjust plans based on neighborhoo d input (ii necessary),
Submit application,
Review by Development Review Team and outside agencies,
Adjust plans based on Development Review Team comments (if necessary), and
Schedule the public hearing to meet posting and publication requirements.

BACKGROUND:
The proposer! ~mP.ndme nts arc based on Council directives provided during the May 23, 2011
stucy session on public notice ,equiremenls. Co ncern was exp ressed that public notice for a
recent re zo ning did not extend far enough to properly inform potentially attected landowners.
Section 1-10-2-6 : Public Notice of rhe Englewood Municipal Code sta tes : "If requirPd , public
notice of the date, time and place of the public hearing shall be give n in the manner provided by
th e Charter, sratute or ordinance pursuant to which said hearing is lo be held." To that end, the
UL)C's hble 16-1-2.1: Summary of Oevelopmc/11 Revi ew anc/ De -ision-Making Procec/11,es lists all
UDC development procedures and identifies their public notice requirements . The UDC
provides for three methods of public noti ce : Published (official City newspaper and websrte),
Posted (sign on subj ect property), and Mailed (sent via fir st class mail). Council's concern
iocused on th e requirements for mailed notices .
UD C requirements for mailed public noti ces are provided in Table 16-2-1.1 'i11 mm,1ry of Mailed
Notice Requirrments for developmecil applications for any rezoning, major subc:ivision, or
tele communication conditional use. In each case the applicant is requir ed to mail the notice via

The proposed amendments for all mailed public not ices for any rezoning, major subdivision, or
telecommunication conditional use are:
1, Slandardizc lhe required nolificalion area based on radius from lhe subject properly.
2. Increase the required notification area radius from 500 lo 1,000 feet.
3. Standardize the minimum deadline by which a nolice must be mailed tc> 1 0 day~.

16-l-3: Development Application Procedures.
G. Notice Requirements .
1. Publish ed Notice. ,'lotice shall be by one publication or. the City's official website or in the
newspaper designat ed by City Council as th e City's o fficial newspaper al least ten (10) days
before any hearing before the Council, th e Commission, or the Board . The City shall be
responsible for all required published notices, and for providing ev,de"'.:e o f timely
pub lis hed nolic.e at the time of !he hearing or consideration
2. Po;led Notice. The property shall h e advertised by posting for nol l ess than ten (10)
consecutive days prior to a hearing befort the Counci l, the Commission, or the Board;
provid ed, howeve r, !hat where the case doe s not involve a specific property, no posted
notice shall be required. A posted notice shall consist of a sign not less than twenty-two
inches (22") by twenty-e ight inches (28") in size, located not less than four feet ( 4') above
ground level in a conspicuous p lace, with letters not less th an one inch (1 ') in height in
t,lack paint, which letters can be read fro m the adjoining street ri ght-o f-way. The applicant
sl ,.,II be respons ible for complying with posted notice provi sions and for providing evidence
of timely posted notice at the tim e o f th t l,e.ri11g or consideration. All req L1ir ed posted

accordan ce with City procedures to describe their proposal before an application for
re7.o ning can be accepted by the City. The ne ighborhood meeting is an opportunity for th e
applicant lo d esc ri be th e proposal as well as for area re si d ents and property owners to offer
input about the proposal at an early stage. I he applicant shall hold th e meeting at a time
and loca tion access ibl e and conv eni ent for the publi c. The City shall be represented at th e

This matter was heard before the City Planning and Zoning Commission on August 2, 2011
in the City Counci: Chambers of the Englewood Civic CPnter.
Testimony was received from staff. The Commission recei ved notice of Public Hearing, the
Staff Report, and a copy of the prop -J sed amendments to r,,re 1 b Unified Development
Code which were inco rporated into and made a part of !he record of the Public Hearing.
After considering the statements of the witness, and reviewing the pertinent documents,
the members of the City Planning and Zoning Commission made ihe following Findings
and Conclusions.
1. THAT the Public Hearing on the Unified Development Code Mailed Public Notice
Amendments were brought before the l'lan111ng Commission by the Department of
Community Development, a department of the City of Englewood.
2. THAT notice of !he Public Hearing was published in the Englewood Herald on July
1 J, 2011 and was on !he C ity of Englewood website from July 7, 2011 through
Augusl 2, 2011.
