A RESOLlJflON RECOMMENDING TO THE CITY MANAGER OF THE CITY OF
E:,.iGLEWOOD , COLORADO A SUSPENS ION OR MORATORIUM ON HIE ISSUANCE OF
CERTAIN BUILDING PERMITS IN THE MU-R-3-B ZONED PORTIONS OF TI-IE 3200 ,
3300 , AND 3400 BLOCKS OF SOlJTH GRANr STREET AND THE 3200 BLOCK OF
SOUTII SHERMAN STREET.
WHEREAS, Community Development was directed to create a proposal 10 conduct a
community pl.inning and visioning process for Downtown Engleuood and the Swedish-Craig
Medi cal Center Districts : and
WHEREAS, the Englewood Down,own and Medical Distri ct Small Arc., Plan is a poli cy
document within the Comprehensive Plan containing goals and objectives thnt were crafted to
represent the va lue :; and desires of stakeholders, Lhe Englewood Planning aml Zoning
1.nmmissi nn, and the Englewood City Co uncil: and
WHEREAS, the Comp rehensive Plan is meant to serve: as a gu ide tu the Planning ;mli Zuning
Commissi on in devel o ping zo ning refonn so lutions for both areas of change and JJ'eas of
stabi lity ; and
WHEREAS, the City Co uncil adopted by resolutions, amendments lo the Downtown and
Medical District Small Arca Plan on December 20, 2010; and
WHERE AS, the next step is 10 implement wning in the se Areas to enhance th e econ omic
development of the Medical District Small Arca Plan a.s adop,ed; and
WHEREAS, there is concern relating 10 the preservation of the characteristics of certain
po rti ons ul""Sub Area 2" ol"thc Medical Uastnct Small Arca during the study and implementation
of the wning reform; and
WHEREAS, lhis moratorium will temporarily stop the issuance of building pennils where the
pennit will result in a change of the existing use type or number of dwelling units; and
WHEREAS , which will help protect the public health , sa fet y and welfo,c uy µ1cse1viJ1i; a safo,
hc.1 lth y, and so tu1d environment within the City; and
WHEREAS , the City Counci l fin& that a six month moratorium or temporary suspension of
the isstarncc of certai n building permits m the 3200 , 3300 and 3400 blocks of South Grant Street
and the 3200 bl oc k of South Shcnnan Street is nece ssary to the implementation of any changes to
the Unified Development Code .

Sess ion . At 1h a1 sessio n Council re viewed lhc draft res oluti on and alternative grandfathering
langu age . There w.15 co nse nsu s to proc eed with th e moratorium ;md lrmg uagP.: 10 grandfather
building permlls subm ined on or before th e effec ti ve date of th e resolution establishing th e
morat orium .
RECOMMENDED ACTION
Approve the attached RP.s olution for a Moratorium o n the issuance of certain building pe rmits in
lhe M U-R -3-B zoned portions of th e 3200, 33 00, and 3400 Blocks of South Grant Street and th e
3200 Block of So uth Sherman Street where such perm its result in• change of use type o r the
number of dwP lling units .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The subject blocks are zoned MU-R-3 -8 and are part of an area iden tified as Su ba rea 2 in the
Medical District Small Are• Pl•n . Current zoning allows office us es and th e conversion of existing
res idential properties to office use . Citizens ra ised concern s during Small Area Plan stakeholde r
meetings regarding preserva tion of the res idential chara c ter o f the sub ject blocks. Ena ctment of the
moratorium will p ruv id e tirne to prepare an anal ysis of existin g con dition s, develop options for the
area including possible rez o ning, and co nduct the require d public hearings t o adopt code and/or
zoning maµ amen dments.
Susp ending certain building permits related to changes in th e use of a property or increasing the
number o f dwelling units on an ex isting property will maintain the status quo of the subj ect blocks
a11d prevent fu rth er change w hile the area is studi ed . Limiting the susp ensi o n of perm its to th ose
related to change in use type all ows general development, such as ne w roo fs, remodeling, and
additi ons, to occu r. Th e proposed Moratorrum would term ina te on Januar1 1, 10 12.
