What I ha ve prov ide d for you tonight is ... l just made a copy for yo u ... for yo ur study materials for your Stud y Sess io ns . Th is Is th e current Sena tor Romer draft thal he just redid . The co py of th e Col orado Sheriffs Association proposed bil l. There is a co py of the City of Denve fs ordi nanc e that they j ust voted tonight to go to Pub lic Hearing next Monday . There is a response or an amendment suggestion by one of the Council members and also a bri ef re sponse by Rob Corry , an attorney. You might have he ard his name in th e news , on the Denve r ord u ,Je ce . I provide these material s for your Study Se ssio n. Aga in, I want to applaud you guys, the entire Council, for taking your time . De nver did comment that it to ok them 34 da ys to rush th eir ordinance . And they rea lize that th ere are prov isio ns in this ordinance that are controversia l, tha t are proba bl y goi ng to be nu llified or trumped by State law an d ther~ were also a couple of challenges in there. They see that will have legal challenges . So , taking your time and stud yi ng th is really is very importa nt. The six areas they tagged ... and we will put together some more materials for your Stud y Sessions so you can tear into this a li ttle more , and you wil l see that the ir summary is very si mp le . They talk abou t effective dates , a general provision abo ut defini ng and not rede fi ning , medical mari juana and using Amendment 20 as the guidel ine , wh ich jus t makes sens e. The City Attorney said tha t there is a relations :1ip to State law and th ey recogn iz e that , and they • recog nize that pat ients an d caregivers possess medica l marijuana , and th ey nee d to clarify that iss ue , as yo u all • are approac hing defining . There are certa inly perso ns prohibited as li cens ees that th ey have ident ified . I am tota lly in agreement with that. And prohibited dis pensary loca tions So we would urge you to look carefu ll y at those th ings . They ha ve a 1000 foot number they have come up with in Denver but , again , they have struggled wit h tha t a little bit an d th ere may be changes to that alter the ir Pub lic Hearing . They are having their first read ing . Al so, they have performance stand ards, wh ich I thin k are pretty common sense . You'll see that. So , hopefully we 're able to ... the 7th ... coming to Rick 's meeting ... and bring some mo re materials and the n we 'll develop some more study mater ials for you , for your Stud y Se ssions . The one thing that we wanted to clarify is that the re are cert ain issues th ey did not address in thei r ordinance , and that is because the y re cog nize that Stat e is obviou sl y moving ve ry qu ick ly wi th three or four bills to try and resolve th ese ... you snow ... gray areas ... you might say . And one of those , of co u•se, is the legitimacy of doctor/pa ti ent re lationships and those kinds of th in gs . So , again, than k you for unde rs tandi ng the pat ie nt on the end of this and helpi ng to provide them safe acce ss in the City and h;.ve it under th e guidelines th at protec t all of the City's assets , to make it a very safe and lega l place for the pa tie nts in Englewood to go . I am here tonight lo disc uss Baker Park agai n. Today I made over 140 flyers which I handed out in the im med iate neighborhood of Bake r Park . And I have made copies for the person who take s the minutes , the City Manag er, Ci ty Attorney and City Counci l members that you are getting now . You can peruse it al your leisure . Th e lnformatic 0 in the flyers was provide~ by Bob Toll of Arapahoe County , Dave Lee and Jerrell Bla ck of Eng lewood ,'arks & Recre ation and the Englewood Cit izun . The information provided by Dave Le e and Jerre ll Black has alread y been sent to City Council members , City Mana ger and City Attorney . The point is that Ba ker Park is the onl1 park In th e Ci ty of Englewood that had a winter port-o-potty 1n th e past. but currently doer not. Alter sitting ,n the December 7, 2009 City Council meeting and watching the majority of the City Coun cil • members vote for 1/, million dollars to go to Pirates Cove and Centennial Par k co mp lex, I find ii la ugh able that the City ca n't fur,d the $95 .00 monthly fe e rent al for a regular toilet , the $30 .00 for its delivery an d the $14 .25 for Ire 15% mon thly fuel surcharge on the to ilet from October to Ap;i l. Yet Belleview Pa ,·k has two port -o -potties , • Englewood City Co uncil Jan uary 4, 2010 Page 3 as does the CentP.nnlal complex . And what appears to be a handicapped port-a-potty at Canine Corral , which costs , supposedly , $125.00 a month for rental and is there year aro•Jnd , to which Englewood Unleashed contributes noth in g to ... even though their motto has been "ded ica ted to public education for off-leash dog recreation site selection , park ma intenance and fund raisir,g ·. Where are the ir funds going to that they raise from their annual chili cook-off th at is held at the Malley Center, etc ., if not to help the City maintain Canine Corral , especiall y in these tough economic times? Mayor Woodward has stated a separat ion of City of Englewood and Englewood School Boa rd and Schools . Yet there are two poli ce officers at the regular High School and Middle School . Who Is paying those officers salaries , since the police officers are City employees ? And why is there not a police officer going to the Alternative High School. al least sporadically , when known juvenile delinquents attend there? I know City Council members cannot make co mments till the end of the meeting . If it does not run too lo ng , as It did last lim e, I will be here to listen to your co mmen ts . If I do have to leave , I suggest you mak e the comments anywa y, so I can get the min ute s at a later date to see what was said by City Council members . Thank yo u. Mayor Woodward said than k you . (c) Brian Ble ile , an Englewood resident , said good even ;ng la dies and gentlemen . I have been ,n th is roor.i many times before, but never to address City Council . So , bear with me . I am here as both a citize n and for those of you that know me , as the Chair of the Plan ning and Zoning Commission . But over the last couple of weeks , I have been follow ing along with the med ical marij uana issue pretty closely . Both , again , as a citiz en and through Pla nn ing and Zoning , obv io usly . But I have a few items of feedback I would like to bring forth regarding the December 7th meeting that you all had . There was an in-de pth discuss ion regard ing the medical marij u na ordinance that was sent to the Counc il via Plann ing and Zoning . But , aga in, my feedback . To begin with , I th ink that the prism through whic h any City Council membe r, or any elected official , should view legislation is the prism of what do you want Englewood to look like? You know . What do you want it to • represent? What character do you want ii to have ? What perception do you want to create? And in listening to th e on-line meeting minutes , I sense we really don't ha ve a lot of those questions answered . I am very frustrated both as a citizen , but probably more so as Chair . In lis ten ing to the on-line meeting recordings ... specificall/, I am referring to questions and discussion points that came up from the December 7th Council meeting , in which ii is apparent that not all of you actually ,ead or listen to the meeting minutes of the Planning and Zoning Commission . So, I am very frustrated by that . If you would have taken time to read and list en to the very numerous amount of hours that the P & Z committee actually discussed this ordin ance and the many , many meet ings we had on this topic , I think yo u wou ld have realized that som e of th e questi ons that were asked , we re already answe red . For example , Member Penn , you asked about the 500 fool bu ffer . There was a ve ry good dis cussion on why we had that. Member Gilli!, you asked if Plann ing & Zoni ng re vi ewed fo od items . Aga in, that was very well covered in the meeting minutes . So , it's , it's apparent to me, tnat either ... I don 't know ... l'm making the assumption . If you are asking questions about topics that were already dlscussed ... you :::c c!!her shirk ing your responsibllities and not reading the minutes and the notes from your vc ::.mteer citizen committees . Those are a plethora of informat ion by which lo ascertai n what the co mmittee is feeling And the re were many questions and comments that we re made that were very well answered in our num erous meeting min utes . But , on another front , I am equally frustrated that ... it Is ironi c that we are vo ting on anothe r morato riu m ton ight. Although , I th ink the moratori um is probably a good idea , I feel that th e reason that the Counci l ~ac ided on a moratorium was because you needed more time to do you r homework and study the fa cts And I remember Mccaslin, you specifically said we ne ed to do additional homework . And I am frustr ated by the fact that this ordinance came to Planning & Zoning four month s ago . The moratorium '" now five months old . So , this Coun cil , now that it is January , has had almost six months to do your homework and it is clear to me that you didn't read the minutes and you didn 't review what was discussed and now yo. are still do ing your homework . That frustrates me . But , you know , regarding additional comments tonight. We are not Denver and they are discussing 500 , 1000 foot , 2500 foot buffers . But , we are not Den ver; we are Englewood . We don 't need to wait for an other commun ity to make a decision . And , yes , the State doesn 't have it all figured c ut. I gi·,e you that. We are Englewood . Step up to the plate , City Cou ncil . Stand by your conv ictio,1 s and ask yo urself : • wh at do you wan t Englewood to re pres ent? Do you want t~ be kn own as the pot cap ita l of the worl~'/ Do you want to have th e sam e bu sine ss improvem ::rtt district issues com ing before ~1s because a legiumate business , that has been legalized , is not real ly welco,ne in my backyard? I don 't know . Those are tough qu estions . I don 't have all th e answers , but I know Plann ing & Zoning discussed It heavily and I would recommend you Englewood City Council January 4, 2010 Page 4 definitely go back and read those meet ing minutes . But... I digress . It is well ... it is well known that... especially a lot of topics that ~ave come before Council in the la st couple of months is sort of the ... the sq ueaky whe, gets the fix . And I am not here to be a squeaky wheel and I don 't really think anyth ing needs to be. fixed . What I •m here to ask , is that as you spend another four months , on top of the six months thet you ha ll' ;, •rly had , that you think abo ut... on how to make this right... do so , not because I provided feedbac • but bee•·,,.. have as ked you to view this ordinance with the question of what would you wa nt Englewood to be? Wha . ·••· ,pt ion do you want to create? And what commun ity do you want to live in? Thank yo u for your time . Mayor Woodward said than k you Brian . Council Member Wil son said thanks Bri an . I have prepared some brief handouts for you he re to review . And what the;e are , are flyer s 'hat I plan to distribute th roughout the community , all over Englewood ... com munit ies all over Englewood . :o get people invo lved in the medical cannabis iss ue and try to gel some people from various walks of life and parts of town and varied typ Js of knowledge to come in and give their viewpoints on Just what their ideas are and what their concerns are anrl so forth , for the medical csn nab is fa cilities in tile City . And at the end of th e fiyer , I would like to be able to Inclu de the dates of your respt •tive community meetings and the times and loca tio ns, if I could please . And then I drop in a district map at th,· end of those or up somewhere where it loo ks good, so that people know where these locations are for the mee, 1gs and then may be that way we can get some other people ou t to share the ir view and so forth an d th eir kn owledge on this issue . And then there is a little 3 ½ by 5 ½ card It 's an abbreviated version of the fiyer . An.' I would like to put the date s and times of your community meetings on that as well . So , if you could provide me with feed back , I would like to get these out in th e ne xt several da ys , If that is possible . I did not put Rick's community meeting for the 7th on here , because I knew th is wo uldn 't be read y to go out by then . So , thank you , A that Is wha t I have for this evening . Oh , and by the way , I applau d you for extending the moratorium . I think that "9 was extremely intelligen t, because there are so ma ny different aspe cts and viewpoints and issues to consider , in order to make this fair for everyone and in ord er fo r the way th at it is set up to be able to grow with the progression of this whole program . Communications , Proclamations and Appointments (a) Mayor Woodward said Vincent Atencio will be sworn in as Mun icipal Ju dge for th e City of Engle wood by the Hono rable Randal l J. Davis . The Honorable Judge Atenc io wo e the election as the Mun icipal Judge , the only one I believe in the Slate, by a landslide in November . There was la ughte r. Judg e Davis sa id good even ing . Thank you for having me here ton ig ht. Up unt il recently , I was the full -ti me Co unty Court Judge in Broomfield County . I am now on sem :-retired on senior st atus ... that not only refers lo my advanced age , bu> a!so desc ribes the work that I do . I am th e subs lilut e judge for lack of a belier descriptio n, trave ling jurisd ic tio n to jurisd iction, wandering aim lessly look ing for judi cia l work . Llnfortucal ely, I haven 't had the oppo rt unity to s't here in Englewood , because as you are all aware you have a residency requirement. But in my senio r sta tus , ; do , occasionally , get to travel to other jurisdictions, such as Englewood for momento us occas,ons , such as s•vean ng-,n ceremonies This 1s actually th e thi rd time that I have appeared before you wi th the honor of swearing -i n the Hon orable Vincent Atencio . So, I am pleased to be here , yet aga in, to do this for my friend . Judge Aten c1c and I go back a long time . An d I am not necessarily referring to our chronologica l age , but our careers have ti ;1r:.kA~ ~1m il arly over th e years . We both were admitted to practic.~ in the 1970's and had cases together and that is how we got to know each other and become friends . We both became municipal judges almost sim ult;,neously in 1987 . First , as part-time judges , worki11g ourselves up to full -time judgesh ips , eventually . So , I am delighted to be he re , ye' again , to swear hin, In tonight. Judge Atencio Is notorious ... ! • mean fam ous , .. among our mu nici pal judge ca llings , bec:2.use he Is, in fact , the only elected Judge In the State of Colorado . Not oniy at the municipal co urt leve l, but he is the only e.lected judge in all of the State of Colorado , eit her at the mun icipal court level , the State court level or the Feae ral court level . I am here to present the recomm, oded action for the approval of the construction contract to Stanek Constructors for the major Air Pipe ... mJjor infrastructure repair project tha t was identified during a previous project. The project, which is called the Soli ds Contact Tank Air Pipe and Storm Water Project, encompasses a variety ... a small variety of projects of wh ich the major items include a replacement of a varied section of an air pipe that has been structurall y damaged and needs to be replaced . Additionally, there is a digester tank that has an interior PVC liner that has been dam aged and is leaking , that also needs to be repa ired . We nave been working with the Public Works Department. They 've identified a drainage area wit hin the plant site that needs to be med iated . There is a detention pond currently on this plant site and we've worked with the Public Works Department to identify ... to install a water qual ity detention pond and install a storm water inlet that will go to the South Platte Rive r. So that is the project , in a nutshel l. We had a bid opening in th e summer . We had seven con tractor s bid on this project. We had a good range of prices or • bids co me in , which reflects a go od compe titi ve market that we are currently in right now . Stan ek Constructor s were identified as the lowest responsive bidd er. We have re viewed their bid package , verified their references and found them to be the best qualifi ed con tra ctor . So we are , with the supervisory committee , wh ic h has already approved Stanek Constructors , we are recommending that they be awa rd ed this contract to perform thi s project. I will say that th is amount , $964 ,000 00 , is in the 2010 budget and it is actually under budget...under what we estimated for this project. Mayor Wood ward asked if there were any questions . Council Member Mccaslin sa i~ the lowest bid . Were yo u asked to go with the lowest bid or are you comfortable wi th th is contractor , that they can do th is job? We don't necessarily always go with the lowest responsive bidder but we do have to do our due diligence and I believe that we have done our due d1h9ence here . Stanek Constructors rs a local Co lorado com pany . They are actually based in Golden , Colorado . They are widely know, .. , Colorado as a water/wa~tewater contractor . They actually have an office in Californi a as well but they are mainly ba sE:!d in Colorado . They do proj~c ts all throughout the reg ion ; th e Front Range areas , the mountains , the western slope They range in projects from as low as $20 ,000 .00 , all the way up to $25 ,000 ,000 .00 . In verifying ·''of ''ie other references we did, because they were quite a bit lower than the averag e, we did question why th~. Nue so low . In talk ing wi th the other refere nces , as far as change work contingencies , th ey were all well below the 5%, which is the industry standard , so we feel very confid c,,t that Stanek ,swell qualified and can do this job . I met with staff members ,,f Representat ive Dia na DeGette's office regardin g this , who ... they are going to be working with us on it and I wou ld like to ask Randy , as representing the Chamber , to bring it forward lo the Chamber si nce this pa rt icular facility serves a la rge po11ion of our business commun ity, our retail bu sines s community, and certainl y th e Charr.oer has those people and could possibly write a letter in regard to that.
