We JU,I celebrated that a week ago . last Mond ay nig ht, with Dr. Roscoe Davidson Mr . Furman said wh o put him 1n? W as 11 on e of you guys who put him in? Because I have been tellin g you guys about Ma rk DeHa ven, who ha s volunteered for 20 so me years ... and helping out Special Olympics and stuff an d I told you g uys that was th e p~rson I thought deserved it. And I have been tell in;J you guys that and it sound s like you are no t hearing from the c1 t1zens who see the voluntee rs wh o volunteer a :')t of time . (b) Diane Re inhold , an Englewood resident, said my question Is about th e ,a nd fill and I only moved here in November of '07, so I know nothing abo ut it ... if we even have one . In 1984 and '85 I worked on ... for gett ing the new landfill'" Rockford , Ill inois and they were getting new proposals for the la ndfill. And I took the min utes for 11 and one th .ng they co ns idered very importa nt was an inc inerator . And I would like to know ... do we have one? And then tllere wa & thi s article in Parade Magazi ne .. ." A College Powered by Garbage". It is a coll ege up in New Ham pshire that the local landfill .. they used the methane gas for it and their college campus Is powered . 85 % of their power co mes from that methane gas I wonder if we do anyth in g like that around here? So, my th ing ... my ques tion wa s ... do we have an incinerator? Because the head of the landfill pro1 ect. .. the lady tha t was head o: 11... she reall y intbled that we needed a landfill.. that was in '84-'85. And th en I was won dering if we do anyth ing with th e methane gas from th e landfills . Can an ybody answer me ? And , as you stated Mayor the Council Communication that you received the packet you received mcluded letters and e-mails both for and ag ainst the proposed amendments .that were received by the City by noon on May 13th Those ,terns that were received following that deadline . have also been s bmitted to you and I submi t those for the record First, before we begin with the background and history. I 1ust ·.-.a nt to clear up some mIsconce ptIons that I understand that are going around , mostly from having read th ee- m ails Fm:l off, :t1ese am endm ents do not affect lattoo or pawn shops many way They are still prohib1ted In the 8-1 D1stnc t and that I~ not being changed In any way The amendments any amendments that are aoopted affect the entire zone district. not any one particu lar property 3nd not Just the South Broadway comdor that Is part of the 8-1 District and that portion of the 8-1 District that Is along Broadway Is Just tne blocks the 3300 to the 3500 bl ocks that's basically Floyd to US 285 One ex,st,ng thrift store m the downtown Is considered a .. right now a non-conforming use It has been In existence , I believe some 35 or more years and 11 Is non-conforming, as 11 Is not m comphance w ith the current zonmg As a way of ba ckgrounn th e early Ci ty Codes allowed retail uses m the downtown dIs1nct /I• :C included In that language was a catch•all p rase or any use that was s1m1lar to those downtown uses even mough there was a long probably 90 items of J ses tnat were allowed , but the n that last phrase was and any s1m 1lar use So, that Is bas1 c ally how thrift or second -hand shops came to exist In B-1 They were deemed, at 1hat time. to be similar uses In 1997 as a result of the South Broadwa y Action Pla n , zoning amendments were enacted that proh1 b1ted 1he pawn and second-hand stores in th e 8 -1 District . along with bu y back second -hand and consignment shops ln 2004 , th ose uses the pawn still remamed proh1bIted In 8 -1. but second-hand buy-back, thrift and consignment wer~ separated out as and grouped into one category of use typ e w11h1n the Table of Allowed Uses Per the table bu y-back second-han d thnft and consignment , were considered to be prohIbIted As a result of a cI11ze 11 inq uiry this past January about consignment store use In the D1stn ct, Council directed the issue be sent 10 the Planning and Zoning Commission And on March 2nd the Comm1ss1on held a Study Session and discussed a number of options for how th1s issue rrnght be addressed Or April 6th the Comm1ss1on held a Pubhc Hearing And rive people spoke In favor of the proposed amendm ents and th e proposed amendments are the ones m the packet and the ones that you saw at first reading two weeks ago T e pubhc or the Planning and Zoning Comm1s s1011 re commended to you that the four uses 111 the group tha l again Is buy-back . second -hand thnft and consignment sllll remain as one group or one use type wI thm the Table and that they all be allowed as a use -b y•right w1th1n the 8 -1 Zone District As I said , the ordinance m your packet Is as the Comm1ss 1on re commended At first reading two weeks ago , on May 3rd , you directed staff to prepare separate def101t1 ons for those four separate uses And those requested defm1t1ons are included In your Cou ncil Communicat1on this • • • • • • Englewood City Council May 17, 2010 Page 5 evening . They begin on page 2 of lhe Communication . They were written based on the use 's reta il operation and the ex isting use of second -hand goods . If you would like to follow along on page 2, I will go over those four definitions. Again , as I said , they are based on the reta il operation of the use , as all four are still retail uses . Bu ,-~•~~ p.er tne proposed definition , or the definllion that was included ... a retail establishment that deals primalil f •n ,h o ~uying , selli ng , trading , or trade for credit of second -hand good s, such as sporting goods , and eie,;,ron lc games and system s. Cons ignment is de fined as a retail establishment that deals primarily In second - hand goo,ls resold through a broke r for the owner , with the pro•,ision that payment is expected only on •:ompletec l sales and that unsold Items may be relumed lo the owner. Second-hand ... a retail es:Sbllshmenl lhat deals prir,arily in second-hand goods , such as apparel , household items , furniture , and books . This use type does not ,nc lude the sale of second-hand motor vehicles , parts or accessories , scrap or waste . And the defin ition of thrift is a retail establishment that deals primarily in donated second-hand goods operated by a non- profit charitable organization , as defined in Internal Revenue Serv ice Code 26 USCS 501 as amended . Th is use type does not Include the sale of second-hand motor vehicles, parts or accesso1i es , scrap or wa,te. Included in your packet are three amendment alternatives and I will go over those , for the cenefit of ••!! :~e folks here . These , again , are listed in your packet . Number 1 is ... adopt the amendments as prop,,sP.~ by tMe Planning and Zon ing Commission and that would keep all four uses as a single us e type with in the Table of Allowed Uses and permit all four of those uses in the MU -B-1 Distrlct. The existing , non-conforming thr,it use in the MU-B-1 , under this alternative , would become a conforming use . There would be no amendments Meded to the Council Bill , as required , and the bill would proceed to second reading two weeks from tonight •Jn June 7, 2010 , with an anticipated effecli vs date of the ordinance of July 12th. Option 2, or alternative 2, is ,ep1rate the four uses into individual use types , with the separate definitio ns , as I read them. Th is would require an amendment to Table 16-5-1 -1: Tat•le of Allowed Uses to show each of those uses as separate uses and also to show in which District each one of 1he individual uses is either allowed as a permitted or conditional use . Any ex ist ing use not permitted un derthls re-des ignation ... would become a non-conforming use . Th is amendment alternative requires tha t Council Bill 11 be sent back for first readi ng , as amended and antic ipated effect ive date of th e ordinance would then i,s delayed two to four weeks , depend ing on the degree of amendment . Third option , also included hi your packet, was based on some suggestions that the definition of thrift store also be ame nded to allow lwo types of thrift stores ... sma ller and a large thrift store . And the de finitio n in your packet is based on the sr,uare footage and in the packet...that basis is that 10,000 square feel This would also req ul•e amendments 10 th e Table of Allowed Usts, this time with 5 categories ... the 3 uses of buy-back , consi gnment and second-hand ... and then :i llnes ... one each fo r the large thrift and then small thrift . Any ex isting use not al lowed in B--1 by th is amendment , would also become a no n-conform ing use and th is amendment alternative would requ ir,, that Cou nc il Bill 11 be sent back for firs t read ing , as amended . The anticipated date , aga in, for effectivenes,, of the ordinance change would also be 2 to 4 weeks . Again , depend ing on the degree of amendments. I nee d to point Jut though , that based on the definition in the Unified Development Cod e ... a floor area of a struc :ure ... it's co nce ivable that a structure ... maybe at 15 ,000 square feet...could actually have ... onl y have ma ybe 5,0~0 squa re reel of storage and then that would be 10,000 feet of store area and so that would still be considered a small tr rift use . So , depending on the size of the store , oepending on how the store is used , or the bui lding is u•;ed, th e degree of storage and other items that ca n be subtracted out of the gross floor are a, the figur e that is inc :ludeci In your packet at 10 ,000 square feet , ma y or may not be th e des ired size . In other words , th e differe ntiation in size at 10 ,000 square feet , ma y not ach ieve what is intended . Aga in, depend ing on how the stru ct ure is used . Just in summary , the add itions of the definitions to each type wou ld require a reput·li cation . As I stated two weeks ago at the first reading , other municipal ities do not differentiate between these tour uses and no one uses ... no one us e Is singled out as be ing prohib ited . The primary funct ion of all four ,,,es included in th is am emt ment are retail and It is the operation of the use that Is different for each use . An~ Ihat Is wh y the Pla nning Commission proposed the amendments that you received ... that all four uses be allowed as perm itted in the B-1 Zo ne District. I will be happy to address any of your q1Jest ions . Council Member Mccaslin sa id I know you just probably said It .. but I am go ing to ask it again . The Plann ing and Zon ing Comnis slon agreed that all fo ur usages should be allowed in MU -B-1. Is that correct? Ms Lan gon said correct. Mr. Mccaslin said that I all I wanted to know . Mayor Woodward sa id Tric ia, on the ... what you called the amendment alternatives ... just to verify that none of these optio ns have to go ba ck to Plann ing and Zoning ? They can be done .. Ms . We will have staff on hand , we will hJve volunteers . If we need to, we will put a new structure in to have donations iccepted . If we need to , we will move it to the s:hools and not have donations accepted on site . We want to be good neighbors , just as we ~•peel the businesses around us to be good ne ighbors . We are goi,1g to be part of the community for the long 1, •JI . Although we are designated as a non-profit, our intent is to ger.drale as r,,ooy sal •?c as possib le. The ~"ality of our merchandise and the appearance of our stor~ is c11t•::a1 to our success . We are a non-profit t ,:siness . We want to make a lot of money for Denver Christi~r,. So , It is In our best interest to have quality gl,Ods and a great store . For the business people here ... whe,1 you fi rst opened your business , you made ;,rom ises to your customers and asked them to trust you. n,ey gave you a chance and you were able to stay in business . I am a native of Colorado and I grew up in southeast Denver. I have shopped Broadway for as long as I can remember . Broadway , Includi ng downtown Englewood , has a long standing repu tation and image as be ing a destination for resale shopping . Antiques , thrift stores , pawnshops , co nsignment shops , refurbished appliances , furniture , used cars , costumes , mus ical instruments , books ... and I could go on and on . And I have often looked fur many of the~• things . These ty,::es of businesses and this type of destina ti on are attra cliv e to all socioeconom ic groups They always have been and lhey always will be . No matter If th e economy is goo d or bad , there will always be people who ne ed th ri ft ... lo shop thrift for the ir bas ic needs and people who love lhe thrill of find ing a barga in or that ec lecti c Item that they just can't find at your typical store . For this reason , and more , we have focused our search for a location on Broadway and we are very excited about the possib ility of partner ing with the existing businesses and th e Yellow Rose 10 add va lue , to Increase foo t traffi c and have a pos itive impa ct on the community . The larger retail spaces that ran ge from 30 ,000 to 50 ,000 square feet...big box usern ... will not fit in this particular building either, because th e concept will not work . Basically, the family from Greeley , the Wiiiiams ... private guys, with a small cha in, brought that bu ild ing, hoping their bus iness , the Artarama , the Artarama art store would actually thrive th are . And It turned out... over the las t four years ... it didn 't. They made good progress , they had , unfortunately , too high of an overheard and the profit margins were not really enough in order to support that particular bus iness . They had to close the store , the property went into forecl osure ... It is now owned by Lehman Brothe rs ... or whatever Is left from Lehman Brothers . The current retail environment doesn 't have enough pr0fit marg ins in order to support a bus iness on a square footage of like 13 ,000 square feet. That's why a non -profit organ ization like ReNew is , basically , an ideal tenant for that kind of space, because they have higher profit ma rg ins, they don 't have the overhead that a trad ition al business ... and they fill th is very vital gap in the new reta il world , wh ich cannot really be filled by any other business . Like the gentleman before sald ... he has two buildings vacant and th ey have been vacant sin ce Janua ry 1st. Th is building has be en vaca nt for a mini mum of six months . I wasn 't Invol ve d on the purchasing sldr , Will iams hired me to try to find a buyer on the se lling side . I market ed the building probably for over a ye _. and I generated , I think , three showings on the bu ilding . And those guys were local mom and pop stores that reflected on that square footage and could just not make that size work . Another problem is ... it Is a very long ... act ua lly, it is a more deep building than ii is wide . ii is a unique floor plan ... you cannot really split it. So , If you sa ld ... hey , maybe we can split in four separale units and lease it to differe nt ten ants ... the plan that It Is built on ... II just doesn 't lend Itself to do that. It's either 13 ,500 or it's vacant. And I think whatever ReNew likes to do with the bui ld ing , it is the ideal use for tha t. It'~ ... they are the guys that actually reflected on th is build ing ... was a year In working on ii and the only guys that actually had a viabl e concept to make this space work , generate retail dollars for the community ... a vital part for the neighborhood and to generate more traffic for this downtown environment. would like to ask you to pass this amendment in their favor and I than k you so much for listening . When I had moved into Englewood , we had severa l thrift stores in the area . One was located at Table Steaks , on e was at th e Dollar Store next to Country Buffet. There was the Goodwill and the Neighborly Thrift. For some reason , over th e pa st years , Englewood changed the zoning code for this area . I assume ii was to help im prove this area to make it look better for the res idents and the commun ity . Befo re you change the zoning ba ck to allow thrift , buy - ba ck , co nsignment, resa le ... I hope you will lo ok at the past and why they changed It to the new current laws . Some of my conc erns with allowing a thrift store Into the downtown area ... ls peopl e will drop off the ir junk and they wili ... when the y move or after a garage saie ... will it be in front of the store or will ii be in the bac k? How long will it be the re? Will it be the re long en ough so people can go through it, pick what they want and leave the rest? Leav ing us , the , esidents of Englewood , to walk down the street and again see the trash on th e street. Th fs area is important to me . I live within five blocks of this area . I alread y get the crowds from th e Gothic and from the Table Steaks le aving the ir trash on my yard and in the park ing lots across from Wells Fargo . Leaving , aga in, lor somebody el se to pick up the stuff. I would li ke to attra ct peop le who would bring bu si ness to help accent some of our existing store s In Englewood We have Ted 's, Kaufman 's, Wagner's and the Sta ined Gla ss Warehouse . Th c,e businesses have been here for many ye ars ... through pr,od times and through ba d. So, please look at what would be good for them . Don 't look at...that th ere's an empty buliding ... let's just fill ii tor the tax revenue . The economy will change and bus inesses will come ba ck to Englewood . And It has been a proven fact through many years . Please think lo ng -term and what do we want this area to look like . It it's a thrift store that wants to be in there , let's put them someplace other than ... In Englewood , rather than our main streets of downtown . More people Gell the ir high end items either on Cra ig's List , E-Bay or in a cons lgr ,ment store wilere they can make some mo ne y. The stuff that is be ing dropped off at the thrift stores are not that high end So , they will be going through a lot of stuff to try to fill a square footage spot. You know the last definition for thrift stores , obvio usly, is defin ing the use ba sed on the operator , not on the use . It was primarily saying that an operation , operated by a non-profit is being defined as a thrift stme . And I kind of have an objection to th at. II doesn 't feel right to me that the use Is defined by the operator, nc ,t t y the actual use . And so I think yo u need to really consider carefully whether It is fair to not approve all us 11s and to maybe drop that use ou t... wh ic h I know maybe some of you have considered . So , that clearl y ap pli es to land use ordinances . Now I po int th at ou t, but I would also say that the City of Englewood , and yo u as a City Council , have always sent a positive message to non-profits and I nbserved in the last Council meeting your patient attention to the Special Olympics and your supp ort of that. And , you know, incidentally , there is a thrift store in Pensacola that specially puts its proceeds for th e Special Olymp ics . So, we just really want to be part of your com mun ity. We are actually looki ng for the special kind of location that th is real estate prov ides . We would no t be inte rested in going by odd lots in that kind of a center. And , matter of fac t, our oth er altemat ivet would be to go into like a King Soopers ... anchored shopping center with an Office Depot... In Centennial , al Arapahoe and 1-25 . So , we are loo king for a retail location that we can have a special reta il nic he . And 11,at is what th is section of Broadway provides fo r us and that's what we are ... because of our special store , that we think is special .
