Rf.\,arding the provis ion of s•;wer serv ice, the Cit y's pcnnitting requirements shall be followed by the Di st rict and its users. AJ I sewer plans 1 speci fications and methods of work within the Di strict shall be sub mitteC to the City in writing and approved y City prior to any construction or tap in the Di strict's designated area. o pennit shall be fi nal and no service shall be provided to property until construct ion is approved, in writing by the City. 4. The District sh all be responsible for the prop er mnin lcn ance ofi sewer system and shall rectify any problems or co nditions which have been detennined by the District or City to be detrimental to City's trea tm ent process or syste m. Sho ul d the City cictcrmin c that any discharge en ters the sewer system co ntra ry to applicab le laws , ordinances, statut es, rules, re1,"Ulations or permits, the District agrees to proceed at once to lake whatever lawful means may be necessary to rectify any such problem or condition . 5. City shall have the right to allocate service under this Contract, and City may deny arju1onal servu .. ..: :'n r any utility-rela ted reason, but in no event wi ll City terminate or refuse any service without cause. City shall have the right t J disconnect service 10 any area an nexed to the District whe n such annexat ion takes pla ce with out pr ior written City approva l. \Vi thin one year of th is agreement, the Di strict sha ll provide City ,:vith an estimate of the number of equivalen t service taps needed for the next five (5) years under current zoning and planned build cul in the District's area as shown on Exhibit A. The District shall monitor zoni ng changes "ith.in its area to es timate its tnp requirements amt provide Cit y with not ice oftnp requirement for the nex t five (5) ycnr period of time in a form sa ti sfactory to the City. Should any federa l law, rule, perm it or rcbrul ation or should a decree or order of a court render vo id or unen forceab le any provision of this Contract, in who le or in part , the rema inder shall remain in foll force and effect. 12 . 'When more than one district is connected to a sewer line, and lhe City • disco\!~rs any violation of the tenns of this co nnector's agreemen t; the City shall not be required to prove which district is at fault but shall make available to all such a:fer.ted districts all information developed or accumulated by City per,ain.ing to such brca ,·h. Nothing con tain ed h:-rein shnll preclude a cla im fo r indemnity or co ntrib ution by any Distr ict against ;mot "le r District ccnnecled to a common sewer line. CRS-13 -21-11 .5 shall gove·n the percentage of liabi lit y of any distr ict on a commo n sewer line in the event the City seeks to impose liability based upon negligence or fault. 15 .
