At th e State 's so le di sc reti on, payments made to Grantee in error for any reason, including, but not
limited to ove rpayments or improper payments, and un ex pended or excess fund s rece ived by Gra ntee,
may be recovered fr om Gra nt ee by dedu ction from subsequent payments under thi s Grant or oth er
Grants , grants or agreements between th e State and Gra ntee or by other appropriate methods and
co ll ected as a debt due to th e State. Such funds shall not be pa id to an y party oth er th an th e Sta te.

8. REPORTING AND NOTIFICATION

A. Performance, Progress , Personne l, and Funds
Gra ntee shall submit a report to the State up on exp iration or soo ner terminati on of thi s Grant, co ntai nin g an
Eva luation and Revi ew of Grantee's perform ance and th e final status of Gran tee's obligation s here under. In
add iti on, Grantee shall CJmply with all reporti ng requirem ent s, if any, set forth in Ex hibit A.
B. Litigation Reporting
Within IO day s after be in g se rved with any pleadi ng in a le gal actio n filed witlt a co urt or adm inistrative
agency, related to thi s Gra nt or whi ch may affect Gran tee's ab ili ty to perfo rm its obli ga tions hereunder,
Gra ntee shall notify the State of such acti on and deliver cop ie s of such pl ea ding s to (he St ate's prin cipal
rep rese ntati ve as iden ti fied herein. If th e State's prin cipa l rep rese ntative is not tn en :iervin g, such notice and
cop ies shall be deli vered to th e Exec uti ve Dire ctor of OED IT .
C. No ncompliance
