Section 5. USE OF THE PREMISES .
Trai ner shall have the right to possession of the Leased Premises for the purpose of
providing video golftrn.ining , instruction, club fittin g, club snlcs en d club rcpn.ir. i-l owcvcr,

Section 6. SERVI CE3.
All serv ices provided by U,e Trniocr shell be reviewed nnd approved by U1e Director of
Parks nnd Recreatio n. The Trnincr will provide lesson s and clinics for the ::::ity. The City
w;JI continue to offer the Holc-N-One Program, Por 3 Lea&'llc, golf tc ,m nnd some lessons.
The Trainer will provide free instruction fo r the Hole-N-One Program. The Trainer will ·
provide Jesse n di scounts for Englewood resid ents and Parks and Rccrer.tion sponsored
programs.
Section 7. 8O'.JRS OF OPERATION.
a) From Moy 1st th rou gh Se ptemb er 30th of each year, the Tra iner shall provide digital
,~deo golf ana lysis six (6) days per week and durin g t!Jcsc month s shall be open each
duy to the public from 9:0 0 AM and shal l remai n open W1til 5:00 PM .
b) During the months of October 1st through Apri l 30th of each year, the Trainer shal l
provide video golf analysis five (5) da ys per wt:ck 1md during these months shall be
open eac h d,,y to the pu bli c nt 9:00 AM und sha l remain open unt il 5:0(l PM .
c) Nothing he rein shall be com;trucd as prohib it in g the Trainer from bein g op en for
ot her hours in additi on to those sta ted in Purn grnphs 11 a11 1md 11 b" nb ovc. Trninc; may

Section 10 . RENT .
a) Treiner shall pay rent to the Ci ty:
Commencing on January 1•. 2010 , the Trainer shall pay $20,000 per year, in
accordance wi th the following schedul e:
Apri l throu gh November: $2.500 per mooth .

of th e Director of Parks and Recrea ti on or his dcsigncc. Pcrmnnentl ) atta ched fixtures or
equipment shn ll become property of the City upon termination of th e lea se. Permanently
attached fixtur es are consid ered to be any item that causes damage tc, th e building upon
r emov lU . L'l no event will a golf simulator be cons idered a permnnerJ.ly atta ched fix ture.

personal property of Trainer. Such policies sball conta in no right of subrogotion against
the City. Trainer shall provid e a copy of the poli cy to the Dircetor of Parks and

d) Neither lhc Trainer nor the emp loyees who per fo rm servi ces pursuant to the
Agreement sh all be co nsidered emplo yees, servant s or agents of the City of
En glew ood as a result of the perform an ce of services under the Agree nen t.
c) Vi ol ence or acts pro hi bited by law commi tted by th e Trn in cr and employees of
Tra iner shall ca use immcdi nt tenuinati on of the Lcnsc, if not resolved to the
sa tisfact ion of th e Ci ty, nfier notifi cat ion.

egnin.st all liability, cl aims, and demands , on eccount of injury, loss or dnmagc, of
anr kind whatsoever, whi ch arise out of or arc in any manner connected with
Trainer, if such injlL"')', loss, or damogc is cntLCied in whole or in pnrt by the ocl,
omission, or other fault of Trainer, or nny officer or employee of Trainer. Trainer
agrees to invcsligntc , handle, r~pond to, and to provide defense for any such
linbility, chllm", or dcm nnds nt the so le expe nse of Trainer, and agrees to bear all

carried by or provided through any self-insurance pool of U,e City of

Trainer.

The certificate shall id entify this Agreement and shall provide that the
coverage's afforded under the policies shall not be canceled, terminated or
materially changed until at least 30 days prior writ ten notice has been given to
the City of Englewood. The completed certificate of insu ran ce shal l be sent

Broke n T Partners LLC to operat e th e Br oken Tee Eng lewood Indoor Golf Trai nin g Ce nt er.

The Broken Tee Coli Course indoor training ce nter was part of th e cl ubh ouse expansion in 1995.
Si x hittin g ba ys with two compu ter swing analyzers were put in place. While th e faci li ty ha s been a
positive addition to the clubh ouse, th e revenue stream has been minimal. Monthly use passes were
c reated in 19 99 to ge nerate participation and re venue in th e faci li ty. In the fi rst year approximately
ni nety (90) passes were so ld. The fo ll owing yea r that number was cut in half. A t th at time, it was
realized th at in order fo r th e tr ai ning cen ter to be successful , additional staff was ne eded to be on
site du;in g upe rating hours due to golf sw ing anal ys is and to operate th e computers prop erl y.
Reve nu e from the Learning Cen ter was approximately S 10,000 annually.
In October of 2002, Tim G rove (owner T T) leased this space l o offer indoor lessons, r!ub fittings
and golf trainin g sessions. TNT decided to terminate th eir contrar t in th e fa ll of 200f du e to la :k of
sales and usag e.
In April 2007, staff sent ou t an RF! (Requ est for Information) to determine if an y area re tail
busi nesses we re interest ed in a loca ti on al the golf course. Six tee n vendors picked up th e
documents but none were submitted. At that time, th e golf course was undergoing a renovation
and most of the fadli ties were closed .
In December of 2007, McGetrick Golf Academy (MCA) and Ortega Golf both expressed an
interes t in offering lesso n programs through th e indoor teachi ng facility. Each group subm itted a
pr oposa l and met wi th staff on num ero us occasions . Intervi ews we re co ndu c ie d ar.d MGA was
selected. MGA was se lected for th e fo ll owi n g re•sons : higher revenue stream from lease r ,yment,
free instruc tion 10 o ur H ole-N-One junior golf p rogram, discocrnted lessons to di Engl ewooa
residents .
McGetnck Golf Academ\ termin ated its contract wi th tn e Cit) effecti , e ove mber 30" 2009. Ste, e •
Bur etz and Kevin Hollern, im es tors with MCA, approached staff and proposed a ne\\ agreement
th :.t includes many oi th e same benefi ts that are in place plus new progrJm ideas. Thes e benefi ts
in cl ud e dis co un ted less o n to Englewood residents, free Hole--O ne instru cti on, emp ha sis o n junior
goh, imprO\ ments to the iacil1tv, seeki ng sponsorships for the Hole-N-One program and o ther
benefits.
FINANC IAL IMPACT
