SERIES OF 20 I 0 BY AUTHORITY COUNCIL BILL NO. 11 INTRODUCED BY COUNCIL MEMBER GILLIT/WILSON AN ORDINANCE AMENDING mLE 16, CHAPTER 5, SUBSECTION 1.1, AND CHAPTER 11, SUBSECTIONS I AND 2, OF THE ENGLEWOOD MUNICIPAL CODE 2000 , TO PERMIT BUY-BACK, SECOND-HAND, TIIRIFT AND CONSIGNMENT USES AS USES-BY-RIGHT IN THE MU-B-1 ZONE DISTRICT. WHEREAS, a business requested a review of the Englewood Municipal Code relating to consignment stores in the MU-l:l-1 Zone District ; and \'/HEREAS, the Englewood Planning and Zoning Commission held a public hearii:,; on April 6, 2010 and received evidence relating to the subject ; and WHEREAS, the roning change conforms to Ro.1dmap Englewooc : 2003 Englewood Comprehensive Plan Objective 1-2 : which objective is lo actively engage in attracting new businesses to the City and Objective 1-3 : Create a balanced mix ofbusu,.:<ses that complement each other; and WHEREAS , the Englewood Planning and Zoning Commission decide'.! i,II four of these uses • were appropriate in the MU-B-1 Zone as well as all other Business Distric .s; and • WHEREAS , the Englewood Planning and Zoning Commission has referred this Ordinance to Council with a favorable recommendation; and WHEREAS , passage of this Ordinance will also transform an existing non-conforming thrift store use in the MU-B-1 Zone to a conforming status. NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO, AS FOLLOWS : Sec1jon I. Section 4. Sa fety Claus es. The Cit y Council hereby find s, detennines, and dec lares nat thi s Ordinan ce is promulgated under the general police power of the Ci ty of Englewood, Ih a, it is promulgat ed fo r the health, safety , and welfare of the public , an d that thi s Ordinance is necessary for th e preservation of health aud safety and fo r the prowc ti on of public convenience and welfare. TI1e Cit y Counci l funhe r detennines that the Ordinance bears a rational re lation 10 the proper legi ;lative object sought 10 be obtained . 13 Section 5 Severability. If any clause, sentence, paragraph, or part of this Ordinance or the ,, ap plication thereof to any person or circumstances shall for any reason be adjudged by a court of com petent jurisdiction invalid, such judgment shall not affect , impair or invalidate the remainder of this Ordinance I it application to other persons or circumstances. Section 6. ~consistent Ordinances. All other Ordinances or portions thereof inconsi stent or conflicting with thi s Ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. Section 7. Effect of repea l or modification . The repeal or modification of any provision of the Code of the City of Englewood by thi s Ordinance shall not release, extinguish , alter , modi fy , or change in whole or in part any penalt y, forfeiture , or liability. either civil or criminal , which shall have been incurred under such provision , and each provision sha ll be treated and he ld as still remaining in force for the purposes of sustaining any and all proper actions, sui ts, proceedings, and pro sec uti ons for the enforcement of the penalty , forfeitu re, or liabi lity, as well as for ti:e purpose of sustaining any judgment, decree , or order which can or may be rendered , entered , 01 made in such actions , suits , proceedings, or prosecutions . Section 8 Penalty . The Penalty Provision of Section 1-4-1 EMC shall apply to each and every violat:on of thi s Ordinance.
