CITY OF ENGLEWOOD, a ( 1 c, ,do :nunicipal corp oration ("Grantor'') whose addxess is I 000
Englewood Parkway, Englewood, Co lorado 801 JO , to the QWEST CORPORATION, a Colorado
Corporation, (K.N.A. US WEST Communications, Inc.) ("Grantee) whose addxess is I oO I
California Street, Suite 5 I OC, Denver, CO 80202 .
The partie.s covenant and a~ ns follows:
I. Easement Propcrtv. 'f\,e "Easement Property" shall mean the real prop erty located
in the County of Arapahoe, State of Colorado, in the NE ¼ of Section 5, T.5S ,
R68W of the 61h P.M ., more particularly described on Legal Description attached
hereto as Exhibi t A, cons isting of one (I) page and incorporated herein by
reference,
2. Consideraticm. II>. consideration of the sum of fiv e hundxed dollars ($500), due on
execution of this grant of easement .
3. Grant of ~.sement. Gran tor hereby grants to Grantee, il!I su.ocessora and cs signs, a
perpetual nonexclus ive easement over, under, across and thrcugh the Easement
P:operty for :he purpose of constructing, operating, maintaining, repairing ,
replacing, modifying and removing, telecommunication facilitie s as described in
Exhibit A
4. Access. Grantee shaU have the perpetual, nonexclus 've right of ingress and eg,f:ss
in, to, over, through and across th e Easement Property for any purpo se necessaJ')
or desirabl e for the full enjoyment of the rights granted to Grantee und er this
Grant.
J. Restoration. Gmnt<..-e agrer.s that after the construction, maintenance, repair,
rep lacement, if any, for the telecommunication fac iliti es, Grantee shall restore th e
surface of the Easemout Pro perty as nearly as possible tc the grade and conditions
existing immediately prior to said construction, maintenance, repair or
replacement, except as may be necessary to accommodate the facility. Grar ee
further agrees to replace any topsoil and sod removed from any cultivated ' r
agric ultural areas un the Easement Property end to remove any ex cess ea, .h
r 51.1lting from SJ1id construct ion, maintenance, repair or repla cement, at Grantee1s
•ole cost and expense.
6. No Improvements. Grantor covenants and agrees not to constru ct, erect, place or
plan any "Improvements," as hereinafter defin ed, on the Easement R"Operty other
then that described in ExhJbi t A, witho ut obtaining the prior written consent of
Granter:. "Improvements" shall mean any structure.

RECOMMENDED ACTI ON
Staff recommends that Council adopt a bill fo r an ordi nance authorizing a Grant of Easement to
Qwest for t elecommunica tion faci lities a, the Broken Tee Englewood Golf Course .
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Th e telecommunica ti o n facili ties will be located at 37 12 So uth Clay Street. Qwest sha ll have
nonexclusive rights to th e ease ment parcel fo r th e purposes of cons trvcting and maintaini ng th eir
equipment. Qwest will restore th e a; ea as nearly as possible to th e gra de and condi tions exis ting
prior to the c.,ns truc tion. In th e event that Qwest aba ndons th e right s gra nted to it un de r thi s
easeme nt ag reem ent, th e City wi ll assume full righ ts of the easement property.
FINANCIAL IMPACT
Qwest will pay th e City $500 upon executi on of this grant of easement.
