' / • • • • SUBGRANTEE AGREEMENT FOR ·ARAPAHOE COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS SUBGRANTEE: CITY OF ENGLEWOOD PROJECT NAME: ENERGY EFFICIENT ENGLEWOOD (EJ) PROJECT NUMBER: ENHS 1012 Thi s Agreement is made by and between the Board of County Commissioners of the County of Arapahoe, State of Colorado , for the Community Development Block Grant Program in the Community Resources Department (herein after refetTed to as the County) and th e City of Englewood (hereinaft er referred to as the SubGrantee) for the con duct of a Comm uni ty Develo pment Block Grant (CDBG) Project. I. PURPOSE The primary objective of Ti t;e I of the Housi ng and Co mmuni ty Devel opment Act of 1974 , as amended , and of the Community Development Block Grant (1.:DB G) Program under thi s Title is the development of viable urban communities, 1:>y providin g decen•. housing, a suitable Ii •ing environment and expanding economic opportunities , principall y for low :;;,d moderate in co me peTSo ns. The project by the SubGrantee known as the Energy Efficient Englewood (E 3) program (Project ) has been categori zed as a Housi ng Rehabilitation project and th e SubGrantee will maintain documentati on with th e • national objective of Low/Moderate Income Housing activities . • The SubGrantee may proceed to incur costs for th e Project upon receip t of an offic ial "Notice to Proceed" from the Coun ty. IL WORK TO BE COMPLETED BY THE SUB GRANTEE The fo ll owing prov ision s outlin e th e sco pe of th e work to be comp leted: 11,e SubGran tee will utili ze CDBG funding to provi de grants to nin e (9) low to moderat e in come homeo wners for energy effic iency interi or and exterio r home improvem ents, 11,e intent of th e project is bo th to improv e the energy efficie ncy of homes th at focuses on work items th at qualify for fed era l tax credits or any other sta te or local rebate progran1 , includi ng, but not lim ited to Energy Star furnace s, wu ter heat ers , windows, doo rs, skyl ights, insul ati on , roofing, sidin g, evapora tiv e coo lers, and refr iera tors. A maximum of $8,000 will be grunt ed per hous ehold and th e grant requi res u 20% matd1 from th e homeow ner. If th e homeowner does not have th e requi red match , th · n th e grant wi ll be sec ured by a declining deed of trust reco rded on the propert y th at will be forg iven over a five year period . A, Payment It is ex prt:ss ly greed and understood that the total run unt to be paid by the Co unty under this co ntract shall not exceed S77 ,S00 . The parties exp ress ly reco gni ze that the SubGrantee is to be paid with CDBG fund s rece ived from the federal govern ment, and th at the obli gati on of the Co un ty to make payment to SubG rantee is co ntin gen t upon rece ipt of such fund s. In th e even t that sa id funds , or nny part thereo f, are, or become , un avai labl e, then th e Co unty ma y immedi ate ly terminate or, amen d thi s agreement. To th e extent C.R.S. § 29-1-1 IO is ap plicab le, an y financial obligatio n of the Co un ty to th e SubGrantee heyo nd the cu rrent fiscal year is also co ntin gent upon adeq uate fund s being app ro pri ated, budgeted .1d otherwise avail ab le. Upon expiratior. of th is Agreement , as id entified by th e deadline in Secti on II . C. 3. below , th e SubGrantee shall transfer tc, th e Count y any CDBG fund s on hand at the time of ex pi r ti on and any accounts rece iva bl e attribu ta ble to th e use of CDBG fund s. These tran sfe rred fund s shall revert to th e Co un ty and be utili zed fo r ot her purpo ses . B. TimeUne All Project acti viti es will be co mplet ed, and dra w requests submitted, by April 30, 2011 unl ess th e Subgrantee notifies th e Coun ty in writing by Apri l 15,201 I that the project cannot be co mpleted , and all dra,•1 request s submitted , until May, 31,20 1 I. In the event that th e co mpl etion deadlin e fal ls on a weekend or holiday, th e deadlin e will be co nsidered th e work day pri or to the scheduled co mpletion date. If th e proj ect requires addition al tim e pas t May 31, 201 I, the Agreement mu st be modified by mutual agreement of th e County and SubGrantee. C. Performance Criteria In accc rdance wit11 the fun ding appli cat ion subm itt ed by the SubG rantee fo r th e Project, th e criteria li sted be low are to be met durin g th e exec ut ion of th e Projec t. I. Quanti fiable Goals: Th e SubGmnt ee wi ll utili ze CDBG fundin g to prov ide grant s :o nine (9) low to moderate in come homeowners for energy effi cien cy interio r and ex terior home impro vem en ts. Tris referral will r.e documented and kept in the client file . In cases where appliances or systerr.s are purchased or installed with funds covered under thi s grant, the ap pliances ur system s must meet energy star standards . All improvement s funded under this grant ore to be performed in accocdance with applicabl e industry and local codes and standards , as well as the Americ..uo with Disabilities Act. All contractors , subcon tractors and vendors paid through this grant must be checked again st the federal excluded parties list to insure e!igi bility to receive federal funds. T. Verification of Lawful Presence The SubGrantee shall be responsibl ,, fo r ensuring comp li ance with C.R.S . Section 24-76.5-103 by verifying the lawful presence of all persons eighteen years of age or old er who apply fo r any benefits funded in whole or in pan by the grant fund s that are the subject of thi s Agreement. SubGrantee shall verify law fu l presence in the mann er required by the statute , and shall provide proof of compliance upon th e request of the County. IV . RESPONSIBILITIES OF THE COUNTY A. Adminis trativ e Control Th e Parties recogni ze and und erstand th at the Co ~n ty will be th e governmental entity required to execute all gra nt agreements received from HUD pursuant to th e Co un ty's reouests for CDBG funds .
