I, ARAPAHO E COUNTY whose address is 4101 Sou th Bannock Street, Englewod, Co lorado , ("Lessee"). WJTNESSETH: 1. PREMISES: In consideration of the payment of rent and the keeping ad performance of the covenants and agreements by the Lessee hereinafter ct forth, the Lessor hereby leases unto Lessee the following described premiss , hereafter referred to as the "Premises": That building situated in the City of Englewood , County of Arapahoe, State of Colorado, with an address of 4800 South Pennsylvania Street, Englewood, Colorado, and more kn own as the Duncan School Buildin g 2. Lessee shall give notice to Lessor in case of des tru cti on or sub stanti al damage to th e Premi ses by fire an d oth er cas ualt y. In U1e eve nt of fire or 0U1er ph ys ical ha zard dan1age, Lesse e may termina te thi s lease with no further ob ligati on. (d) Reimbursement Obligation s. Lessee agrees to reimburse Lessor for any expense in c urred by it in repai ring any dam age to the Premi ses ca used by Lessee, its direc tors, offi cers, empl oyee s, age nts , invite es or clients . Lessee wi ll not make or pennit any alterations or additi ons to th e Premi ses or pla ce :rn y add iti onal stru ctures , fa cilit:es or equipment on the Premi ses with out Lesso r's pri or wr itten app rova l, wh ich approval sha ll not be unrea so nably withheld . ADDIT IONAL PROVISIONS: The Lessor and Lessee further agree that: a) Tem1i nati on on Account of Damage to Premises . If the Premises becom e untenantable on acco unt of dam age by fire, flood or act of God, the Lessee may terminate the Lease and be released from its obligations thereunder. b) Abandonment of Premises. If the Premises are left vacan t, and any part of the Rent be unpaid , th e Lessor may, wit'.10ut being obligated to do so and without terminating this Lease, retake possession of the Pren1ises and rent the same for such rent and upon such terms and conditions as Lessor may think best, making such changes and repairs as may be required , giving credit for the amount of rent so received , less all expenses of such change and rep airs, and the Lessee shal l be liable for the balance of rent herein reserved until the expiration of the term of thi s Lease. c) Remedies upon Default. If the rent above reserved, or any part thereof, shall be in arrears , or if default shall be made in any of the covenants and agreements herein contained, to be kept by Lessee, after reasonable notice of such default and an opportunity for Lessee to cure such default, it shall be lawful fo r Lessor to declare the term ended and to reposses s the Premises in ccordance with ~late law. d) Insolvency . If Lessee becomes insolvent, or is declared bankrupt, Lessor may declare this Lease ended and all rights of the Lessee hereunder shall thereupon terminate . e) Lease Amendments. Modifications to th e terms of this lease shall be effective only if reduced to writing and signed by both Lessor and Lessee. f) Applicable Law . Colorado law shal l govern thi s Lease. g) Co untemarts. This Lease maybe executed in counterparts, all of which together shall constitute one Lease .
