A RESOLUTION RECOM MENDI NG TO THE CITY MANAG ER OF THE CITY or-
ENGLEWOOD, CO LORADO THE ESTAB LISHM ENT OF A TEMPORARY SUSPl'NSION
OR MORATORIUM ON TH E ENFORCEMENT OF SELECT PROV ISI ONS OF THE
ENGLEWOOD MUNI CIPAL CO DE 2000 , THE SIG N CODE. PERTAIN ING TO BAN NERS
AND PORTABL E SIGNS FOR A PERIOD OF FO UR <40 Tl·IS.
WHEREAS , the Cit y ha s spent a great deal of money and effort prom otin g its downt own area
as a shopping deslination and a cultural and artistic venue; and
WHEREAS , it ha s been brought to Cou nci l's attention that some businesses in Englewood
feel the Unified Develo pment Code does not adequately address the use of banners and portable
signs in relati on to the remainder of the Sign Code; and
WHEREAS, at a public forum held on September 22, 2009 to discuss temporary signage, a
recommendati on was made lo assign the Alliance for Commerce in Englewood (ACE) with the
task of studying the issue of temporary banners and portable signs and making reco mmendation s
for changes lo the Sign Code ; and
WHEREAS , City Council has directed staff to review and revise, if necessary, provi sio ns of
the Sign Code concerning the use and di splay of banners and portable signs; and
WHEREAS , staff wi ll need sufficient time to review and coord inate recomme ndati ons relating
to the pro visio ns in the Cod e; and
WHEREAS, City Co uncil deems it neces sa ry to coordinate the review of th e Unifi ed
Development Code and finds it appropriate to tempora ril y suspend enforc ement of selc-ct
provi sions of the Sign Code relatin g to banners and port ab le sib'llS until review by th e staff and
City Counc il ; and
WH EREAS , the moratorium would tempora rily stop enforcement of th ,lse sect ions; and
WHEREAS, any review or revi sio n to the Unified De ve lop ment Code will help protect the
publi c health , sa fet y and wclfan: by pre servi ng a safe, health y, and so und environment wit hin tlw
City ; and
WHEREAS , the City Council find s that a four month moratorium or temp orary suspension of
th e enforce ment of certai n provisions of the Eng lewood Muni cipn l Code 2000 pertaining to
ban ners and portable signs is necessary to implement and begin review of th e Unified
Development Code: and
WHEREAS, after a review of th e effect of the mora tori um rel ating to banners and portable
signs on the co mmw1i ty, thl' recommendation may be to keep the Code as it current ly exist s so
any perso n who purchases, erects or maintains a banner during the moral ori um peri od in
co nt ravention of the ex isting Sign Code wil l do so at the ri sk of being subj ect 10 enforcement at
the tcnninatio n of the fo ur month mora torium ;

NOW , THEREFORE . BE IT RESOLVED BY TI-IE CITY COUNC IL OF THE CIT Y OF
ENGLEWOOD , COLORADO , THAT:
Section I . The City Co uncil of the City of Englewood, Colorado recommend s the Cit y
Manager establish a moratorium or temporary suspension on the enforcement of the Englewoo d
Municipal Code 2000 pertaining to banner and portable signs from October 5, 2009 to February
I , 2010 .
Section 2. This moratorium shall not app ly lo nny part of the Englewood Sign Code except for
the following section s:
I 6-6-13(!)) Penni! required
16-6-13(G)(I)(b) Prohibited signs,
Ban.ners
16-6-13(G)(l)(d) Prohibited signs,
Portat-le signs
16-6-13(G)(l)(g) Signs on fences
No pennit shall be requireo for banners during
the four (4) month moratorium .
These signs , normally prohibited shall be
allowed during the four (4) month moratorium
period.
These signs, nonnally prohibited shall be
allowed during the four (4) month moratorium
period .
Signs on fences, including banners , shall remain
prohibited except for banners , on penniued
fences, erected in the public right-of-way ,
pursuant to l l-3-4(E) which allows comm orcin l
occupancy of the public right-of-way for urcct
furniture .
Section 3. All banners , even those subject to this moratorium, shnl! sti ll be required to comply
with 16-6-13(N) Prohibited , Hazardous , and Abandoned Sib'llS as well as I 6-6-13(M)
Maintenance.
Section 4. The City Council find ,. the provisions of this Resolution arc temporary in nature
and arc hllended lo be replaced by subseque-t legislative enactment so that the moratorium or
temporary suspension as specified in this R,<ol utio n should termirate on February I, 20 I 0.
