WHE REA • th e City of En~lewood crentcJ the oncretc Utili ty an d th e Co ncrete Util ity Enterpri1e Fund b th e p11 sst1wc o." rd lnn ncc o. 36, Series of 1997 ; and WH ERE AS, the pa ssnge of rdinnncc o. 66. cries of 2008 nmend ed the "User Fee" section of the oncrete Utilit y nn d oncretc Ent erprise Fund establishing fees for the Concrete Utility to be set by Rcso luti n: nnd WHEREAS, the City Co uncil pas ced Reso luti on No . 79 , Series of 2008, whic h provided for ar, incre,sc in the fe es, 25% in 2009 and an additiona l 25% in 20 IO ; and WHEREAS, fees for the Concrete Utilit y of $0.Q78 (7.8 cents) per square foot of concrete were es tablished in 1997; aud WHEREAS, the fee for 2009 for the Concrete Util ity is S0 .098 (9.8 cents) per sq uare foot of concrete and the City pays ap pro ximatel y thi ny percent (30%) of the total annual concrcate utilit y costs; and WHEREAS , because of the curre,tt fin ancial constraint s on the City's availa bl e funds, maintaining the 2009 fee schedule will save the Cit y approximately $56,000; and WHEREAS , the passage of thi s Resolutio n maintains the 2009 Concrete Utility Fee and cancels the Concrete Utility fee increase for 20 10: NOW, THE FORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENG LEWOOD, COLORADO, THAT : Secti on 1. Council approved Council Bill No. 73, Seri es of 2008, amending the "User Fee " section of the Concrete Utility and Con crete Enterpris e Fund . Council appnwed Res olut ion No. 79, Series 2008, establishing fees for the Concrete Util ity. RECOMMENDED ACTION Staff re co mm en ds Council approve a Resolution ca nceling the 201 O fee increase for the Con crete • Utility. • BAC:<GROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED The Cu,,crete Utility was adopted in 1997 to create a funding mec hanism to help owners with th eir respons ibility In the repair of :h e City's aging concrete infrastructure . Apµroximatel y 96% of the 11 ,2 90 eligible properti es in tl,e City participate in this voluntary program. The City parti ci pates in the costs for inters ec tion corm !rS . alley entranc es, drainage cross-pans, co ncrete pavement and all eys, and City owned prope . as. The City also pays 70% of th e cost of Ave nu e conc rete. The Ci ty's concrete infrastru cture co nsists of 7,315,000 squ are feet of concret e worth an estimated cost of $54,000,000. The cu rrent 2009 rate is $0.098 (9.8 ce nt s) per squ are foo l. A property w ith a 50 foo t fro ntage, consisting of curb/gutter and a 4' wide sidewa lk, pays $3 1.85 per year (ty pically billed qua.rt erl y w ith th e wa ter bill at $7.96 per quart er). FINANCIAL IMPACT Ca nce lin g th e 25% fee in crease for 20 10 will reduce th e required City appro pria:ion by $56,000 and save properly owners approximately $134,000 for 20 10 .
