AT DARTMOUT H AVENUE . WHEREAS, th e connection between tho Little Dry Creek Trail and the Mary Carte r Greenway Trail requires bicycles and pedestrians to crc,ss the Plaue River on the Dartmouth Avenue Bridge ; and WHEREAS , the Eng lewood City Council Authorized the City's applir.ation for federal funds under the "Safe Accountable Flexible Efficient Transportation Equity Act-Legacy for Users" with the passage of Resoluti on No . 77, Series vf2005 ; and WHEREAS, the Englewood City Council Authorized an IGA with COOT for $73,000 whicl· related to the design or a brid ge over the Pl r.tte River at Dartmouth /,venue with the passage of Ordinance No. 37, Se ries of2006; and WHEREAS, the pa ssage of Ordinance No . 57 , Series of 2008 authorized Con tract Amendment #I and the acceptance of an add itional $362,000 for the cons truction phase of a bridge ove r th e Platte Ri ver nt Dartmouth Avenue; and WHEREAS, the project in cu rrentl y under construction and this Amendment #2 docs not change the funding so urces or total project costs prc!»entcd to City Council at the time ot award; and WHE REAS, the passage of this proposed Ordinance will chnnge three provisions f the existing IGA as detailed below: I. Change the over-matching fund amount on Ex hib it C-2 from $1 12,750.00 to $335 ,500 . (This is a "hou sekeeping" change for the Agreement. COOT was awa re that Englewood would provide additional over-match before they issued the "Conc urren ce to Award ' for the project.) 2. Update the Special Provisio ns l< (;!)OT's current version . (These-:hnngcs arc min or and bave been re viewed and approved br the Ci ty Allomey's Office .) 3. Replace the Fund ing Lcuer with the Opti on Letter by revising Section 25 and Exhibit F. (The Option Leu er would allow CDO f and Englcwooo to make certain contract changes without a fonna l nmendmcnt to the IGA. TI,e Op tion Letter will strcnm lin c th e process for fundir.r, changes that do not affect the original terms of the IGA. One example where this cC'ulrl ha ve bee n used is the change in over-matching funds in item I above.) Th e Option Letter will streamline the process for funding changes that do not affect the original terms of th e IGA. One example where this co uld have been used is th e cha ng e in over-matching funds in item I above.) FINANCIAL IMPACT The project was awarded to Goodland Construction on October 6, 2008 and is currendy under construction. This Amendment does not change th e funding sources or total project costs prese nted to Ciiy Council at the time of award.
