AN ORDI NANCE AMENDING TITLE 16, CHAPTERS 5 AND 11 , OF THE ENG LE NOOD
MUNICIPAL CO DE PERTAINING TO MASSAGE PARLOR AND MASSAGE. THERAPY .
WHEREAS , th e Sta te of Co lorado ha s declared that th e registrati on of massage thera pi sts is a
matter of sta tewide conce rn and has adopt ed require ments for the sta tewid e regi strati on of ma ssage
therapi sts; and
WHEREAS , thi s legisl at ion pre-empt s the City ordinances licensing massa ge therapists; and
WHEREAS , this Ordinance is necessary to coordinate the State regulation and remaining City
regulations concerning massage therapists ;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO . AS FOLLOWS :
Section I. The City Co un cil of the City of Englewood , Colorado hereby authorizes amending
Title 16, Chapter 5, Secti on l(C), "Table of Allowed Uses " of the Englewood Municipal Code
2000 , to read us follows :
16-S-1: Table of Allowed Uses.
Table 16-5-1.1 bel ow se ts forth the categories and types of us,s allowed withi n the respective
zoning di stricts .
!EDITORS NOTE: Only the Commercial Use Section of the Table of Allowed Uses is
amendecl and the Residential, Public/Institutional, Manufacturing/Industrial, Accessory,

F. Co mm ercia I Uses.
I. Adult Use .
a. Characteristics . Adult use shall mean a use of propert y where the principal us e, or a
significant or substantial adjunct to another :ise of the property, is the sale, rental ,
di splay or other offering of live entertainment , dancing or mat erial which is
distinguished or characterized :,y its emphasis on depicting, exhibiting , describing or
rel ating to "specified sexual activities" or "specified anatomical areas" 8!, t: ~ p:i.iuary
attract ion to the premises.
b. Specific Use Typ es. Examples include adult arcades , ad ult bookst ores , adult cabaret,
adult dancing es tabli shment, and other similar facili ties, including those defined bel ow.
(I) Adult Arca de . An C'..la blishment where, for any form of consideration, one (I) or
more rr.otion picture projectors, slide projectors or si mi lar machines, for viewing
by five (5) or fewer persons each, arc used to show films , motion pictures, vi deo
cassettes , slides or other photographi c reproductions which are characterized by
an emphasi s upon the depiction or desc ripti on o~ "specified sexual activi ties" or
"sp eci fied anatomica l ar\!8S11

(2) Adult Bookstore . A pl ace where books , magazines, moti on pi ctures , videos,
print s, photographs, periodical s, recordings, novelties and devices , or any of these
things, which have as their primary or dominant theme, matter depicting,
illustrating, describing or rel at ing to specified sex ual activities , are so ld , rented or
offered for sa le to adu lts.
(3) Adult Cabaret. A nightclub, bar, restaurant or simi lar establishment which
regularly features live perfoITnances which are characteri zed by the ex pos ure of
11specified anatomical areas" or by "specified sexua l octivitiesi" or films , motion
pictures , video casse ltes, slides or other photographi c reprodu ctions which are
characteri zed by an emphasis upon th e depiction or desc ripti on of "s pecified
sexua l activities 11 or "specified anatomical areas".
(4) Adult Danc ing Es tabli shme nt. A business that features dancers di spl ay ing or
exposing "spec ified 11natomica l areas".
(5) Adul t Entertainment or Service Facility. An adult bookstore, massage parla,, adult
mo tion picture booth , adult motion pi cture theater, adult danc ing es tabli shment ,
odult cabaret , or adult arcade .

enclosed building, or an open-air th eater designed to pennit view in g by patrons
seated in automobi les, used for prese nting on a regu lar bas is, film materi al which
has as its primary or dr,minant them e, matters depicting , illu stratin g or relating to
"specified sexual activities" fo r observa ti on by ad ult pa tro ns thereof, znd inc lud es
any hotel or motel, boardin g house, rooming house, or oth er lodging fo r tr,nsicm
customers.

12. Reta il Sales and Service (Personal Servi ce).
a. Characteri stics. Retail establishments engaged in the provision of informationa l,
instructional , personal improvement , pe rso nal care, and similar services, such as portra it
shops, photograph y studio s, art and music schoo ls, licensed massage therapists, dri vi ng
sc hool s, riding academies, health and fitne.ss stucbs, handicraft or hobby instructio n,
laundry and dry-cleaning ret ai l outl ets, portrait/phot ogra phic studios, beauty and barber
shops, shoe repair, and tail or/alt erati ons shops. Acee ;sory uses may includ e offices,
storage of goods, manufacture or rep ackaging of~"' <i s for on-site sa le, and parking .
b. Specific Use '/)•pes . This cate gory includes the fo ll owing use types:
(I) Cremat orium . A serv ice estab li shment co ntai ni ng properly installed , ce rt ified
ap paratus inten ded for, or us ed for, th e ac t of cremati on.
(2) Dry Cleaner, Drop-Off Site On ly. An estab li shment or b;:s iness mai ntained for the
pi ckup and delivery of dry clea ning and/or laundry without th e maintenance or
operation of any laundry or dry-cleaning equ ipm ent or machi nery on th e premises .
(3) In st ructi ona l Service. A specia li zed instru cti onal establishment th at prov ides on-
si te trai ning of busi ness, arti stic , or co mm erc ial skill s. Examples includ e dri ving
sc hoo ls, dance, 1m1sic 1 and computer instruct io nal services.
(4) Ma ssage Th erapy ~-A faeili1y that is An estab lis hment opera ted for the

or individual that offers or perform s tattooing or bod y piercing for any fee,
charge, or remuneration of any kind. Fo r the purposes of !hi s Title, thi s docs nCll
include establishments pe rfo~ing car piercing as an incidenta l servi ce to the
pcnnitted principa l use.
(9) Temporary Emp loymen• Dusiness. Any pers on, firm , partnership , assoc iation or
CC'rporation that maintains a central location where da y labo rers assemble and arc
dispatched to work for a third-part y user .

pu rpo ses of th e Zoning Ordi nance.
Section 6. Severa bili ty . I f any cln use, se nt ence, paragra ph , or part of thi s Ordi nance or the
appli catio n thereo f to any person or circum stances shall fo r any reaso n be adjudged by d court of
co mpetent jurisdi c1ion inva lid , such jud gmcnl shall not affect, impair or in va lidat e the re maind er of
this Ordina nce or it s app li ca ti on to oth er perso ns or circumstances.
Sec tio n 7. In co nsistent Ordin ances. All ot her Ordin ances or porti ons thereof inco nsistent or

Section 8. Effec t of rep eal or modificat ion. The repea l or modifi cat ion of any . Jro vision of th e
Code of th e Ci ty of Eng lewood by thi s Ordin ance shall not release , ex tinb'lli sh, nit er, mod ify, or
change in who le or in part any pena lt y, forfe itu re, or li abilit y, either civ il or cri minal, whic h shall
have been in curred und er suc h prov ision, and each provision shal l be lrca tcd and·hcld as sti ll
remaining in fo rce fo r th e pu rposes of sustai ning any and all prope r ac ti ons, sui ts, proceedings, and

In th e interes t of health, welfare and safety, th e Sla te of Colo rado recently enacted legis lati on lo
li ce nse all M assage Th erapists . Stat ewide li ce nsi ng supers edes current Englewood Municip.il Code
li ce nsin g requirements and prohibits any municipality fr om enac ting or enforci ng local ordin aoccs
th at li ce ns e th e p rac ti ce of massage th era py. In o rd er to comply with th e Stal e legis lation, Coun ci l
repea led th e Ci ty's massa ge th erapy li ce nse contained in Title 5, Chapter 5 of th e Englewood
Municipal Code.
The ahove acti on req uires Title 16: Unified D eve l opm ent Code amendm en ts b eca use refe rences l o

BACKGROUND:
Re ce ntly the Stat 0 enacted legisla tion to li cense Mass age The rap ists . The new
sta tewide li ce nsing supersedes current En glewood Muni cipal Code lice nsing
req uire ments of Title 5: Business and Li cense Requ irement s. It furth er pr oh ibits an y
municipa lity from enacting or enforcing loca l ordina nces th at regulate th e practi ce of
massage th erapy. Counci l is in the process of repea ling City licen sing requirements
to co mpl y wi th State requ irements.
The above actions require mod ifi catio ns to Title 16: Unified Development Code
rega rding. Pur suan t to 16-2-6: Amendments to the Text of Tit le 16 (UDC) any

Lang on said th e City does allow massage therapy as a home occupa tion in all dis tricts
except R-1-A. Ms . Kriege r asked why it is no t th en li sted as an allowed use in all dis tri cts.
She asked if a faci li ty i5 different than the o cc upation . Ms . Lan go n said yes, a hom e
occ upat io n is not a faci lity.
Mr. Welker ask ed if a tr ave ling ma ss ag e therapist is an all owed use. Ms . Lan gon stat ed it is.
Ms . Kri eger asked if it is st~t ed in the Code that it is an all owed home occupation. Ms .
Lango n said no, because it is an all owed us e. Under th e gen eral catego ry of home
occupa tio n there is a list of hom e occ upation s that are no t perm itted . What is not all owed
is li sted in the Code ra ther th an what is all owed. M s. Krieger stated she unde rstood.
