P AR.',GRAPH 11 , PERTAINING TO PA \\'NS HOP LICENSE FEES AND CHAPTER i o, SECTION 4, SUBSECTION G, PARAGRAPH 10, PERTAINING TO AUTOMOBILE PA \\'NBROKERS LICENSE FEES ; OF THE ENGLEWOOD MUNI CIPAL CODE 2000 . \\lfEREAS , the State of Co lorado legislature passed Senate Bill 04 -1 09 in 2004 , which imposed restriction s on fee s charge<' to pawnbrokers; and WHEREAS , thi s legis lation has caused confusion regardin g City ordinan ces penaining to Pawn shop and Automobile Pawnbrokers License Fees; and WHEREAS , th e passage of this Ordinance is necessary to clarify th e City 's purpose for impo sing Pawnshop and Automobi le Pawnbrokers Licen se Fee s; NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO , AS FOLLOWS: Section I . The C11y Cowtc il of th e City of Englewood , Colorndo hereby authorize s amending Title 5, Chapter 15, Section 4, Subsection G, Paragraph 11, "Paw nbrokers and Secondhand Dealers -Special Conditions and Restrictions of the License ", of the Englewood Muni cipal Code 2000 , to rend as fo ll ows : 5-15 : Pawnbrokers and Secondha nd Dealers. 5-15-4 : Specia l Conditions and Res trictions of th e License. G. Required Acts: 11 . Every pawnbroker sha ll pay~ a fee fo r every transaction form submitted to th e Ci tx-Thi s fee is imnosed to ·offset th e cost of admioisterini:~ ~ Thi s fee sha ll be determined by the City and set by resolution . The City Co uncil he reby find s, determines, and declares that thi s Ordi nance is promulgated under tl1e general poli ce power of the Cit y of Englewoo d, that it is promu lgated for the health , safety, and welfare of th e pub\i c, and that thi s Ordinanco is necessary fo r the preserv1t ion of health and safety and for the protection of publi c convenien ce and we lfa re. The City Co uncil further determines that th e Ordinan ce bears a rationa l re lation to th e pro:•er legi slative object sought to be obtai ned . f)ec tio n 4. Sev erability . If an y clau se , sentence, paragraph , or part of thi s Ordinance or th e applica ti on thereof to any per son or circu mstances sha ll for any rea so n be adjudged by a co urt of co mpete111 ju ris di cti on in valid . suc h judgm en t shall not affec t, impair or invalidate th e rema inder of thi s Ordin ance or it app li ca tion to other perso ns or circumstances. Section 5. Inconsistent Ordi nan ces . All oth er Ordin ances or porti ons thereof in co nsistent or co nfli ctin g with thi s Ord inance or uny port ion hereof arc hereby repea led to th e ex tent of such in cons istency or confli ct. Secti on 6. Effect of rep eal or modifi ca tion . The repeal or modificat ion of any pro vision of th e Co de of th e Cit y of Englew ood by thi s Ordin ance shall not release , ex tin b'lli sh , alter, mod ify, or change in whole or in part any pe nalt y, fo rfeiture, or liabilit y, either civil or criminal , whi ch shall hove been in curred und er such provi sion, and each provision shall be trea ted and held as still remaining in force for th e purposes of sustaining an y and all proper action s, suit s, proceed in gs, and prosec uti ons fo r the enfo rcement oftl1e penalty, fo rfei ture , or liabilit y. as we ll as fo rt.h e purpose of sustaining any judgment , dec ree , or order whi ch can or ma y be rend ered , entered, or made in such acti ons, suits , proceedings, or pro secuti ons. Section 7 . Penalt v. The Pena lt y Provisio n of Secti on 1-4-1 EMC shall apply to each and every violat ion of th is Ordinan ce. RECOMMENDED ACTION Staff recommends Ci ty Council approv e the attached bill for an o rd inance clarifying that fees charged for pawn and auto pawn tran sactio ns are imposed to offset th e cos t of administering the li ce nses . BACKGROUND, ANALYSIS, AND ALTTRNATIVES IDENTIFIED In 2004, the Stale legislature passed Senate Bi ll 04-109, which imposed restrictions on certain fees charged to pawnbrokers . The City of Englewood imposes a transaction fee for each pawn transaction form submitted to th e City', ou t th e fet imposed is lo offset staff time required to aJrnin ,s ter the li ce ns e. 5-15-4-G-11 Old : Every pawnbroker shall pa y to th e City a fee for every transaction form . This fee shall be determined by th e City and se t by reso lution. New: Every pawnbroker shall pa y a fe e for every tra11sac tion form submitted to the C ty . This fee is imposed to o ffse t th ~ administra ti on of this license. This fe e sha ll be determined by the City and set by reso lution. 5-1(,.4-G-10: Old : Eve ry automobile pawnbro ker shall pay to th e City a fee for every transaction form.
