WHEREAS , t/•c Englewood City Council authori zed the acceptance of a Ju stice Assistance
Grant with the pass age of Ordinance #49 . Series of2008 ; and
WHEREAS . th e Cit y of Englewood was notified th at the Police Deµ•rtment ha s been allocated
$144 ,662.00 via the Recovery Act Justice Assi s\a nce Grant Allocati on pursuant to applica ti on; and
WHEREAS , the Bu rea u of Ju sti ce Ass istance is requi ring the City to co lla borate wi th other
metro cities in th e application for the grant; and
WHEREAS . the Justice Assistance Grant is a non-matching grant ;
NOW , TH EREFORE, BE IT ORDAINED BY THE CITY COUNC IL OF THE CITY OF
ENGLEWOOD, COLO RADO. AS FOLLOWS :

The CITY OF AURORA will subm it th e grant applicat ion and tak e receipt of th e fund s
when di sb ursed . The CITY OF AURORA will th en subm it to the COUNTY and oth er
CITIES th eir all ocat ion as agreed up on in this Agreement. Said fu nds will be se nt to the
account and financi al in stitution provided to th e CITY OF AURORA by th e COUNTY
and other CITIES . The CITY OF AURORA will have fifteen business days to disburse
the allo cat ions to th e COUN TY and oth er CITlE S after th e CITY OF AURORA receives
the funds from the Un ited States Depanment of Justice .

The COUN TY and CITI ES agree to all ocate the total amo unt of JAG funds of $1,743,612
available in federa l grant moni es to all parties in th e fo ll owi ng amoun ts:

conditions ofth,, grant and for its own act ions in prov iding serv ice s und er th is agreement
and shall not be li abl e for any civil lia bility th at may arise fro m th e furnis hing of th e
se rvice s by an y other party .
Each pa rt y und erstan ds and agree s that. for purp oses of th e grant, th e CITY OF
AURORA sha ll not be co nsid ered a "pass -through entit y" withi n the meaning ofOMB
Circular A-133 . Th e CITY OF AURORA 's status shall be th at of a fi sc al agent and , as
such, th e CIT Y OF AUR ORA shall bear n J res pons ibili ty fo r monit oring the use of gran t
fu nd s by any of th e oth er panies to th is Agreement. Accordin gly, each party to thi s
Agreement shall be cons id ered a co-reci pi ent of th e grant an d, in that ,capacity , shall be
direct ly accountabl e 10 the Un ited Stat es De partm ent of Ju stice for all matters concernin g
gra nt compli ance.

The parties to this Agree mci:t do not int end fo r an y third pan y to obta in any ri gh ts by
virt ue of th is agree m~nt or to create any ri ghts in any pany not a signatory hereto.

On Sep tember 15, 2008, City Coun cil approved Ordinance #49, series 2008, acceptin g a Justi ce
Assistance Grant in tl,e am ount of $10,360, w hi ch was utilized by th e Poli ce Departm ent to
purchase techn ological tools.
REC OMMEN DED ACTION
Staff seeks Council's support for a bill for an ordinan ce approvin g th e application for and
acceptance of Justi ce Assistance Grant Funding in the amount of $144 ,662, Engle w ood's all ocati on
of Re covery Act funding th ro ugh ti,e Bureau of Justi ce Ass is tan ce .

On March 9, 2009, th e City of Englewood was notified that th e Police D epa rtment ha s been
allocated S 144,662.00 via th e Recovery Act Justi ce Ass istance Gran t All ocation, pursuant to
application.
Th e Ju sti ce As sistance Grant requires that th e City of Engl ewood Police D epartment collaborate
with th e ci ti es of Aurora, Gl endal e, Gree n wood Village, Littl eton, Sheridan, Centennial, and
Arapa h oe Coun ty. Th e total disburs ement for th ese ag encies is $1 ,743,6 12. Th ese ag enci es have
determin ed th at th e Aurora Po li ce D epartment w ill be the fisca l agent for th e grant. Aurora PD will
b e the fisca l agent and upon receipt of th e grant m oni es w ill disperse to m eml,er age ncies
accordin gly.
The Poli ce D epartment has de term ined that its allocation will be use d to procu re •h e thr ee H arley•
D avi dson m otrn cycles used by th e Traffi c Enforce m ent Tea m. Two additional poli c~ cru isers w ill be
purchas ed for th e Traffic Enfo rcement Team and Sch ool Res ource Officer. Th e Poli ce Dep artm en t
w ill als o purcha se two Flash CAMS (di gi tal ca mera sys tems) th at have rea lize d a grea t dea l of
success in th e in ves tiga tion and apprehension of indi vi du als invo lve d in graffi ti.
FINANCIAL IMPACT
Th is grant w ill provide $144,662 in fed eral funding that will be us ed to enh ance and support
services provided by th e Poli ce D epa rtm en t. Th is is a non-matchin g grant. Any expeodl •~res tt·,:
exceed th e all ocati on w il l be absorbed out of th e Poli ce D epa rtm ent's Operations Budget.

On February 17 , 200 9, President Obama signed into la w the landmark American Recovery and
Reinvestment Act of 2009 (t he "Recovery Act"). As one of its man y elements , the Recovery ,,ct
provide s the U.S . Department of Justice (DOJ ) with fund ing fo r grants to ass ist state , local, and
tribal law enforcemen t (i nclud ing support for hiring ), to combat violen c, aga inst w omen , to fight
internet crimes against ch ildren , to i:nprove th e functioning of the cri minal j ustice system , to
assist vi ctims of crime , and to support youth mentoring . DOJ is comm itted lo working with our
nationa l, state , local and tribal partners to ensure th is fund ing invest , in the A merican workforce .
Specifically , und er th is sol icitat ion , BJ A wil l be maki ng awards to assist local and tribal effo rts to
prevent or reduce cri me an d violen ce .

Registrati on w ith OJP 's Grants Management System is required ~rior to application
submirudon .
Applicants must obtain a DUNS number from Dun and Bradstreet p rior to applicati on
submission . Applicants, including those applying through GMS , must reg ister with the
Central Contractor Registration (CCR ) database .
